Abstract

The electoral justice system has been established in Law Number 7 of 2017. It is marked the electoral justice system has been established in Law Number 7 of 2017. It is marked by the regulation of all procedures for implementing the election stages and the mechanism for handling election violations or disputes. The settlement of violations and election disputes is carried out by Election Supervisory Body (Bawaslu). In resolving violations and conflicts, Bawaslu has the authority to issue final decisions. With this authority, the role of Bawaslu is strengthened in the framework of law enforcement for election justice. This study would like to examine how this authority is exercised, especially in West Sumatra. West Sumatra has chosen because this province has become one of the most vulnerable areas in terms of organizing free and fair elections. Furthermore, there has also been an increase in the number of cases handled by Bawaslu in the 2019 elections compared to 2014 in West Sumatera. Therefore, how election law enforcement is carried out by Bawaslu to realize electoral justice, particularly in handling election violations and disputes. This article using normative legal research methods by relying on legal materials in the form of court decisions and decisions of the Bawaslu in province and city. In this study, it was concluded that the electoral justice system had implemented in the process of handling violations and disputes by Bawaslu in West Sumatra. All complaint report indicated it, i.e., administrative offenses, alleged criminal acts, and election disputes have been passed based on procedures determined by statutory regulations. However, there are still some weaknesses that must be evaluated because the election justice can not maximize.

Abstract

The regulations of campaign finance have highly problematic for local electios (Pilkada) in Indonesia. However, the campaign finance system changed gradually over the following years, many alleged campaign violations committed by candidates during local elections. In this study, the researcher wants to assess campaign finance regulations based on the accountability concept. The measurement of accountability in the campaign finance regulations has been divided into two perspectives, which are legal and finance. The study used a qualitative method with a case study approach in Jambi's three regions, which held local elections (Pilkada) in 2018. This study argues that the current regulations have not solved the whole problem of campaign funds. The level of corruption by candidates remains stubbornly high due to less authority and weak sanctions. At the same time, most campaign finance regulations have never been enforced. As a result, revising Acts on the election, enhancing law enforcement, and raising public awareness need to promote for ensuring the quality of local democracy.

Abstract

ABSTRACTThe relationship between state and religion is the main key to grasp the idea of democracy in a pluralistik state, like Indonesia. There is human right dimension in the relation, including the right to exist for any religion or religious streams. In the case of Al qiyadah sect, the judge should consider that wisely. This article analyses the lack concideration in the judge’s decision. In addition, among three objectives of law, namely legal certaninty, legal justice, and legal utility, apparently that of the fist mentioned is less given a place, as a result of differences in the roles of rhe accused in the crime of blasphemyKeywords: freedom of faith, human right, blasphemyABSTRAKKeterkaitan antara negara dan merupakan kunci yang perlu dipegang oleh negara yang menganut faham demokrasi seperti Indonesia. Di dalam hubungan keduanya terdapat dimensi erat dengan hak asasi manusia, termasuk hak atas eksistensi kehidupan beragama. Dalam kajian ini, penulis mengambil kasus perkara yang melibatkan sekte Al qiyadah, hakim seyogyanya mempertimbangkan dengan sangat bijaksana. Penulis menilai ada kekurangan dalam memutuskan perkara. Sebagai tambahan, di antara tiga tujuan hukum yaitu kepastian hukum, keadilan sosial, dan kemanfaatan hukum, ada yang dilupakan yaitu keadilan terhadap subjek-subjek pelaku tindak pidana karena melupakan peran kedua terdakwa yang berbeda dalam kejahatan penghinaan terhadap agama.Kata kunci: kekebasan beragama, hak asasi manusia, penghujatan/pemfitnahan

Abstract

Penyelenggara Pemilu harus dipastikan mentaati kode etik. Korbannya akan terlalu besar jika etik itu diabaikan. Proses demokrasi dan penyelenggaraan negara adalah hilir dari Pemilu. Namun masalahnya adalah proses penegakan etik juga bermasalah, terutama sejak hadirnya Dewan Kehormatan Penyelenggara Pemilu (DKPP). Tulisan ini hendak membahas permasalahan etik yang terjadi dan proses pembuktiannya serta dampaknya bagi penyelenggara Pemilu. Dengan menggunakan metode penelitian yuridis normatif dengan pendekatan yuridis terhadap putusan peradilan, tulisan ini berupaya menarasikan gagasan-gagasan hukum terkait penegakan etik penyelenggara Pemilu.

Abstract

Human rights are the basis of a country in forming all provisions in the life of the nation and state which are the natural rights of every human being. The establishment of the National Human Rights Commission as an independent institution, is also based on Article 28 of the 1945 Constitution of the Republic of Indonesia which confirms that; protecting, promoting, upholding and fulfilling human rights is the responsibility of the state. This article analyzes one of the functions of Komnas HAM, namely having the authority to investigate alleged cases of human rights violations and issuing recommendations based on the investigation. The purpose of this article is to find out the effectiveness of providing state institutions with the results of investigation recommendations by the National Human Rights Commission on alleged human rights violations. This article uses a research method. This type of empirical juridical research. The results of the study found that first, according to Law Number 39 of 1999 concerning Human Rights and Law Number 26 of 2000 concerning Human Rights Courts that in protecting and guaranteeing human rights, the National Human Rights Commission has a role and function of reviewing , research, counseling, monitoring, mediation, and has the authority to investigate alleged cases of gross human rights violations, as well as issue recommendations afterward. Second, the recommendations issued by Komnas HAM after the investigation was carried out were public law acts because they resulted in a legal relationship between Komnas HAM and the Government as the recipient of the recommendations and the substance of Komnas HAM's recommendations regarding the existence of a case of human rights violations and various solutions in its settlement as well as the results of recommendations issued by Komnas HAM does not have binding and coercive legal force like court decisions which have executorial value. For this reason, some recommendations from the National Commission on Human Rights were followed up by the target state agencies, some were not.

Abstract

In general elections, the public has the right, namely, not to vote, and the right to be elected. The right to be elected is the right of citizens to be elected as members of deliberative bodies or representatives of the people in a general election. Article 240 paragraph (1) letter g of the General Election Law regulates restrictions on the right to vote for former corruption convicts. Regarding the norms in this article, the Constitutional Court and the Supreme Court have different views. This is formulated in the Constitutional Court Decision Number 87/PUU-XX/2022 and the Supreme Court Decision Number 46P/HUM/2018. This article analyzes the views of Constitutional Justices and Supreme Court Justices regarding the norms in article 240, paragraph (1) letter g. The purpose of this article is to find out how voting rights are limited for former corruption convicts. This article uses a normative juridical research method. The research results found that first, restrictions on the right to vote for former convicts may be carried out in the interests of ensuring the freedom of disadvantaged groups. Second, in deciding a decision, the judge is obliged to explore, follow and understand the legal values ​​and sense of justice that exist in society as well as pay attention to the juridical aspect.
