Abstract

The Indonesian government in dealing with the COVID-19 has created various legal instruments for policy implementation. One of those instruments is the Government Regulation in Lieu of Law Number 1 of 2020 which regulates the financial policy for COVID-19 which has been passed as Law Number 2 of 2020. However, there is a provision that is contrary to the administrative law principles, precisely in Article 27 paragraph (3). The norm is considered to close the gap of public access to take legal remedies to correct or examine decisions that have potential to cause harm related to actions or decisions. Even though Article 49 of Law Number 5 of 1986 also provides the similar meaning, however because the COVID-19 pandemic is categorized as a non-natural disaster, the COVID-19 Financial Policy Law should provide an expansion of state administrative court's (PTUN) absolute competence in examine and adjudicate administrative dispute cases. Therefore, this study tries to parse how the Regulations and Options for Public Legal Remedies towards Government Actions and Decisions in Non-Natural Disaster Emergencies in Indonesia. Second, what is the idea for expanding the absolute competence of PTUN in non-natural disaster emergencies in Indonesia. This research uses normative legal research methods with descriptive research specifications and analyzed through literature study and data analysis methods using juridical-qualitative. The result shows that it is time for redesigning in order to fulfill the community legal means in dealing with non-natural disaster conditions of COVID-19. The design can be rearrange the provisions in the COVID-19 Financial Policy Law and the Law of PTUN, so that the capability of PTUN in the future is not limited to state administrative decisions, including all the actions of state administrative bodies / Officials based on public law that cause harm for a person or civil legal entity either in normal conditions or in conditions of non-natural disasters

Abstract

Penyelenggara Pemilu harus dipastikan mentaati kode etik. Korbannya akan terlalu besar jika etik itu diabaikan. Proses demokrasi dan penyelenggaraan negara adalah hilir dari Pemilu. Namun masalahnya adalah proses penegakan etik juga bermasalah, terutama sejak hadirnya Dewan Kehormatan Penyelenggara Pemilu (DKPP). Tulisan ini hendak membahas permasalahan etik yang terjadi dan proses pembuktiannya serta dampaknya bagi penyelenggara Pemilu. Dengan menggunakan metode penelitian yuridis normatif dengan pendekatan yuridis terhadap putusan peradilan, tulisan ini berupaya menarasikan gagasan-gagasan hukum terkait penegakan etik penyelenggara Pemilu.

Abstract

Pemilihan umum (pemilu) merupakan ihwal yang mesti dikawal dalam ruang publik. Pemilu bahkan dalam implementasinya telah bertransformasi menjadi komoditas bisnis yang menggiurkan. Itu sebabnya, proses pemilu yang jujur dan adil merupakan kunci keberhasilan demokrasi. Sebagai wujud kedaulatan rakyat, sistem pemilu yang didesain termasuk penyelenggaranya harus mencerminkan sikap integritas dan terbebas dari praktik kecurangan. Munculnya pelbagai aksi kecurangan dan pelanggaran yang terjadi massif, menggambarkan masih belum efektifnya penegakan hukum pemilu padasetiap pesta demokrasi. Salah satu pelanggaran yang menjadi perhatian publik yaitu praktik korupsi kampanye yang dilakukan oleh penyelenggara negara. Secara yuridis, aturan yang mengatur soal larangan penyelenggara negara untuk turut serta melakukan kampanye sudah diakomodir, namun aturan tersebut masih terdapat celah hitam sehingga praktik korupsi kampanye oleh penyelenggara negara masih saja menjamur. Itu sebabnya, merupakan suatu hal yang menarik jika dikaji berdasarkan harmonisasi aturan dengan meninjau praktik dan mencari desain ideal dalam rangka mencegah dan menindakpelanggaran tersebut melalui penataan ulang pengaturan pencegahan praktik kampanye dalam pemilihan umum oleh penyelenggara negara.

Itu sebabnya, merupakan suatu hal yang menarik jika dikaji berdasarkan harmonisasi aturan dengan meninjau praktik dan mencari desain ideal dalam rangka mencegah dan menindakpelanggaran tersebut melalui penataan ulang pengaturan pencegahan praktik kampanye dalam pemilihan umum oleh penyelenggara negara.

Abstract

The existence of the village is a starting point to develop and determine its position, role, and authority autonomously by developing a tourist village. Legally, Law Number 6 of 2014 concerning Villages has given positive energy to the sustainability of community welfare in the village through the development of tourist villages. The potential of tourism resources in Bengkulu is quite large, especially in Rindu Hati Village. This village has 11 types of tourism that are rarely found, including glamping, waterfalls, camping ground, tubing, rock climbing, rice fields, Putri Lake, stone boats, Supit waterfalls, the funeral of Tuanku Gagok and Raja Pembesar Alam, etc. The stages of this community service include first, identification and preliminary studies by the team, second, doing service with several techniques, which are focus group discussions, field observations, and socialization. This service resulted in Village Regulations regarding Tourism Villages and Village promotion media consisting of tourist maps and videos that would lead to village welfare.

Abstract

As a country that maintains a presidential system of government, it is essential to concentrate on creating the framework and structure of government. This is closely tied to the establishment, evolution, and dissolution of such institutions. As a consequence, the President and the DPR will be capable of determining responsive and constitutional legal politics. This legal policy study focuses on how the growth and regulation of state ministries and state institutions were connected to the constitutional system's establishment, modification, and dissolution. Second, how can legal politics address this in a manner that seems to be constitutional? The objective of this study is to assess the arrangements pertaining to the formation, alteration, and dissolution of ministries and state institutions under the constitutional system in order to define the ideal political legislation.This research uses normative legal research methods with descriptive research specifications and is analyzed through library research and data analysis methods using juridical-qualitative. The results of the research and discussion in this study include: First, the arrangements regarding the formation, modification, and dissolution of ministries and state institutions do not yet have a clear legal basis so that the President as the holder of power, is irregular in issuing his policies. Second, the legal politics that was initiated wanted the Government and the DPR to be more synergized in terms of drafting legal considerations and normalizing them based on statutory regulations and principles in a presidential system of government.

Abstract

Increasing regulation is unavoidable in Indonesia. This study will discuss one of the problems in the formation of legislation, which are the characteristics of the formation of ministerial regulations in carrying out government affairs. As referred to in Article 8 paragraph (2) of Law Number 12 of 2011 concerning the Establishment of Legislation, it states that the Ministerial Regulation is formed based on 2 things, the first is ordered by a higher statutory regulation, the second is formed based on the authority. This is intended to answer the following questions, does the minister have the authority to formulate legislation based on the 1945 Constitution. Then how to determine and design the characteristics of the formation of ministerial regulations that are formed based on orders from higher laws and regulations and ministerial regulations that are formed based on the decree of authority according to the 1945 Constitution. This research uses normative legal research methods with descriptive research specifications and is analyzed through literature study and data analysis methods using juridical-qualitative. The results of the research will later find the characteristics of the formation of ministerial regulations which are formed based on orders from higher legislation and which are formed based on orders of authority according to the 1945 Constitution. This is expected as a proposal/idea to lawmakers to try to rearrange the limits of authority in the formation of legislation based on the 1945 Constitution.
