Abstract

This subject descript about Abuse of Power in maintaining, accountability, transparency and government financial report. First, Chief of Unit (SKPD) should be able to distribute job description for their units and make commitment with Chief of Region to Determination of Performance (Penetapan Kinerja) on his unit of works. Determination of performance as a tool to planning, to doing program and to use budgeting by APBD. If Chief of Unit (SKPD) have not determination of performance on job description for units of work, certainly the SKPD make Abuse of Power. Secondly, without determination of performance, it will be corrupt or disclaimer. Key words: Abuse of power; Determination of performance; Government financial reportABSTRAKTulisan ini berisi tentang Penyalahgunaan Kekuasaan dalam menjaga, akuntabilitas, transparansi, dan laporan keuangan pemerintah. Pertama, Kepala Unit (SKPD) harus mampu mendistribusikan deskripsi pekerjaan untuk unit mereka dan membuat komitmen dengan Kepala Daerah untuk Penentuan Kinerja (Penetapan Kinerja) pada unitnya. Penetapan kinerja sebagai alat untuk perencanaan, untuk melaksanakan program dan menggunakan anggaran dengan APBD. Jika Kepala Unit (SKPD) tidak menentukan beban kerja kepada unit di bawahnya,  SKPD telah melakukan Penyalahgunaan Kekuasaan. Kedua, tanpa penentuan kinerja, maka akan terjadi suatu perusakan sistem.Kata kunci: Penyalahgunaan kekuasaan; Penentuan kinerja Laporan keuangan pemerintah daerah

Abstract

ASN neutrality in elections actually does not cause a loss of political rights either to run as a candidate or to vote. ASN neutrality is more likely for limited involvement of the bureaucracy in socializing or campaigning for certain candidates or political parties. This is intended to make ASN still able to separate its position as ASN which has an important position as a state administration officer. Considering that ASNs are carrying out their duties to serve the needs of the community in relation to certain parties, including in elections or local elections, this has the potential to influence or even pressure the community to follow the direction of support. Apart from that, of course there are concerns about prohibiting support for the opposing party Law Number 5 of 2014 Concerning State Civil Apparatus (UU ASN) does not include the offense of violating ASN neutrality in the prohibition nomenclature but is regulated in principles (principles) and obligations, however principles and obligations can also be interpreted as prohibitions because anyone who is subject to a definite obligation also subject to restrictions to comply with these obligations. Apart from not formulating a prohibition offense, the ASN Law also does not formulate in too much detail the principles or obligations that bind ASN. The formulation of offenses in the ASN Law is still very general in nature and requires details of the derivative regulations, therefore the author invites readers to look at the derivative regulations, including Government Regulation Number 53 of 2010, which was amended to Government Regulation Number 94 of 2021 concerning Civil Servant Discipline and Regulations Government Number 42 of 2004 concerning the Development of the Corps Spirit and Code of Ethics for Civil Servants, and other derivative regulations issued by the government, the President and by ministries.

Abstract

This study aims to analyze law enforcement related to ASN Neutrality in the elections at the national and regional levels based on laws and regulations. This study uses a normative juridical method. The collection of primary, secondary, and tertiary legal materials is carried out using literature study techniques. The collected legal material is then analyzed using qualitative data analysis methods with a statute approach. The results show that the law enforcement related to ASN Neutrality in the elections at the national and regional levels consists of Law No. 5 of 2014, Law No. 7 of 2017, Law No. 6 of 2020, and Government Regulation No. 94 of 2021. Servants proven to have committed violations related to ASN neutrality will be imposed disciplinary and criminal punishment. In this case, the disciplinary punishment levels consist of moderate or severe. At the same time, the most severe criminal punishment is imprisonment for 24 (twenty-four) months and/or fines of IDR 1,000,000,000.00 (one billion rupiahs). In contrast, if ASN Servants are proven to have committed violations but are not followed up, then KASN recommends to the President to punish PPK/Executors/Officials and Authorized Officials by the provisions of laws and regulations. Therefore, it is recommended that the ASN Servants Neutrality Supervising Task Force monitors and evaluates the follow-up results of KASN recommendations. Furthermore, it is necessary to impose strict punishment on Servants who violate the provisions regarding the neutrality of ASN to make the bureaucracy clean from abuse of authority during future elections.

Abstract

Sejak berlakunya PP 53/2010 tentang Disiplin PNS, Pemda Kab. HALBAR belum melaksanakan ketentuan tersebut terhadap Pelaksanaan Hukuman Disiplin PNS baik Hukuman Ringan, Sedang maupun Berat, dan bahkan ada PNS yang tidak bekerja selama setahun masih tetap aktif dan menerima gaji yang utuh. Tujuan, Untuk mengetahui Penegakan Hukum terhadap PP No. 94/2021 Lingkup Pemda HALBAR. Manfaat penelitian memberikan kontribusi pemikiran dan pedoman bagi yang ingin mengkaji di bidang ilmu hukum. Jenis penelitian ini merupakan penelitian hukum normatif empiris. Kesimpulan, Penegakan hukum terhadap disiplin PNS belumlah dilaksanakan sepenuhnya oleh Pemda HALBAR Pada BKDD memiliki absensi seluruh OPD, namun absensi tersebut tidak direkap sehingga penjatuhan hukuman disiplin PNS tidak dilaksanakan sesuai PP 94/2021. Saran, Diharapkan dari Lembaga legislatif maupun eksekutif bisa membahas bersama Rancangan PP terkait pemberian gaji PNS sehingga Penerapan sanksi hukuman disiplin Ringan bisa di terapkan.

Abstract

Berlakunya Undang-Undang Cipta Kerja, memberikan mengalihkan kewenangan dari pemerintah daerah ke pemerintah pusat, perihal perizinan lingkungan dalam hal ini pelaksanaan reklamasi laut, Sebelumnya berdasarkan Undang-Undang Nomor 23 tahun 2014 tentang Pemerintahan Daerah yang memberikan landasan aturan otonomi daerah yang secara tegas menetapkan hak dan kewajiban Pemerintah Daerah, kemudian dengan berlakunya Undang-Undang Cipta Kerja membuat kontruksi baru yakni sentralisasi kewenangan terkait lingkungan hidup pada pemerintah pusat. Jenis penelitian yang digunakan adalah yuridis normatif,  dimana penelitian hukum yuridis normative. Hasil Penelitian ini yakni Perkembangan pengaturan pembuatan AMDAL didasarkan pada Pasal 18 UUD NRI 1945, Undang-Undang Perlindungan dan Pengelolaan Lingkungan Hidup, Undang-Undang Pemerintah Daerah yang mencerminkan prinsip Desentralisasi, dan akhirnya diubah melalui Undang-Undang Nomor Cipta Kerja, dan Implementasi kewenangan pemerintah daerah dalam pembuatan dokumen Analisis Dampak Lingkungan dalam proses reklamasi Pasca-ditetapkannya UU Cipta Kerja, mengubah paradigma izin lokasi menjadi setiap pengguna ruang kewajiban untuk memenuhi perizinan berusaha terkait pemanfaatan di laut dari Pemerintah Pusat.
