Abstract

AbstractThe Economic development is being implemented in Indonesia can fulfilled if be supported by sufficient funding and adequate. Since the beginning of the new order of government had difficulty asset and development funds, so the solution is to look for foreign loans and Foreign Investment, Indonesia has some of the factors that are potentially able to strengthening the competitiveness of Indonesia in attracting investors, so if all the existing potential be utilized and managed well, the private sector through investment, it will make a great contribution in order to economic development. In the era of regional autonomy with the authority regulated Act - Law Number 25 Year of 2007 about Investment, Then the local government become to spearhead investments.AbstrakPembangunan ekonomi yang sedang dilaksanakan di Indonesia dapat terlaksana apabila didukung dana yang cukup dan memadai. Sejak awal pemerintahan orde baru pemerintah mengalami kesulitan modal dan sumber pembiayaan pembangunan, sehingga jalan keluarnya adalah mencari pinjaman luar negeri dan penanaman modal asing (PMA). Indonesia memiliki beberapa faktor yang secara potensial mampu memperkuat daya saing Indonesia dalam menarik investor, sehingga apabila semua potensi yang ada dimanfaatkan dan dikelola dengan baik, sektor swasta berperan melalui investasi, hal tersebut akan memberikan kontribusi besar dalam rangka pembangunan ekonomi. Diera otonomi daerah dengan kewenangan yang diatur dalam Undang-Undang Nomor 25 Tahun 2007 Tentang Penanaman Modal, maka pemerintah daerah menjadi ujung tombak masuknya investasi.

Abstract

Penelitian ini bertujuan untuk mengetahui kebijakan Pemerintah Daerah Kabupaten Sukoharjo dalam menciptakan iklim investasi yang kondusif, dan untuk mengetahui apa saja hambatan yang dihadapi Pemerintah Daerah Kabupaten Sukoharjo dalam menciptakan iklim investasi yang kondusif.Penelitian ini menggunakan jenis penelitian empiris, yang diteliti pada awalnya adalah data sekunder kemudian dilanjutkan dengan penelitian terhadap data primer. Analisis data menggunakan deskripsi kualitatif, yaitu hasil pengelolahan data kualitatif ini digambarkan dengan kalimat dipisahkan berdasarkan kategori untuk memperoleh kesimpulan.Hasil penelitian menunjukan bahwa kebijakan Pemerintah Daerah Kabupaten Sukoharjo dalam menciptakan iklim investasi yang kondusif antara lain membangun gedung pusat promosi potensi daerah, menetapkan Peraturan Bupati No. 38 tahun 2015 tentang Rencana Umum Penanaman Modal Kabupaten Sukoharjo tahun 2015-2025, menetapkan Peraturan Bupati Sukoharjo No. 2 tahun 2017 tentang Standar Pelayanan Pada Dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu Kabupaten Sukoharjo, menetapkan Peraturan Bupati Sukoharjo No. 4 tahun 2017 tentang Layanan Perizinan Online dan Secara  Mandiri di Kabupaten Sukoharjo, menetapkan Peraturan Bupati Sukoharjo No. 32 tahun 2017 tentang Pendelegasian Kewenangan Di Bidang Perizinan dan Non Perizinan Kepada Kepala Dinas Penanaman Modal dan Pelayanan Terpada Satu Pintu, menetapkan Peraturan Bupati Sukoharjo No. 1 tahun 2018 tentang Perubahan Atas Peraturan Daerah Kabupaten Sukoharjo No. 14 tahun 2011 tentang Rencana Tata Ruang Wilayah Kabupaten Sukoharjo tahun 2011-2031, mengikuti promosi investasi. Kemudian juga diperoleh hasil mengenai hambatan yang dihadapi Pemerintah Daerah Kabupaten Sukoharjo dalam menciptakan iklim investasi yang kondusif antara lain Sukoharjo belum mempunyai terminal  peti kemas, ada penolakan dari masyarakat terhadap izin tertentu salah satunya adalah izin menara telekomunikasi, adanya protes dari masyarakat kepada pelaku usaha yang disebabkan kelalaian pelaku usaha.

Abstract

The government, as the party that has the mandate from the people tosa feguar ditsso vereignty, has revoked permits for the establish men to social organizations which are deemed contrary to the ideology of the State. The Ministryof Law and Human Rights as the party that grants the permit can immediately revokethelicense on the basis of the contractus actus principle  contained in the Perppu No. 2 of 2017 concerning Amendmentsto Law No. 17 of 2013 concerning Community Organization. Even though they have taken repressive steps, the Ministry of Law and Human Rights has not taken any preventiveaction in obstructing and preventing theemergence of social organizations that are contrary to the ideology of the State. There fore the authors providean effective solution in theformofan E-Integrative Control System as a Social Organization Supervision Design to Realize the Concept of State Sovereignty so that the Government as the party responsible for granting perm its for the establish men to social organizations and contradicting stateideology. Which could threaten theso vereigntyandintegrity of the Unitary State of the Republic of Indonesia.

Abstract

This research discusses analytical studies regarding the use of alkohol in the medical world, in which alkohol in the Qur'an is haram. However, this thesis describes using the istihsan method which can change the law of origin from alkohol if it is used in the medical world, such as disinfectants and as a washing machine for medical devices. The purpose of this research is to examine the method of istihsan which can change the law of origin of alkohol.The research method used in this research is literary qualitative which requires a lot of library data. This is where the study in this study discusses the use of alkohol in the medical world. So the source of this research is able to present an analysis of the use of alkohol for medical purposes using the istihsan method.The results of research on the use of alkohol for medical purposes istihsan review. Alkohol is used in medical use only outside the body, as a disinfectant and also as a detergent for medical devices and as an external wound wash.

Abstract

 Dispute resolution through the judicial process is considered ineffective and efficient, because it is slow and convoluted. This is not in accordance with the basic principles in the judiciary, namely the judiciary is carried out in a simple, fast and low cost way. However, with the establishment of PERMA No. 2 of 2015 concerning Procedures for Settlement of Simple Lawsuits, the settlement of simple lawsuits disputes through Litigation can run more efficiently with all the provisions contained therein, including the elimination of exceptions. This study uses a literature study research method with a normative juridical approach. The data obtained from primary and secondary legal materials were collected using the library method for further analysis to determine the urgency of removing exceptions in PERMA No. 2 of 2015 concerning Procedures for Settlement of Simple Lawsuits. Based on the analysis carried out, the elimination of exceptions in the regulation is in accordance with the principles of simplicity, speed and low cost in court. Where this principle aims to make it easier for people to find the truth without injuring the rights of the parties because the entire process to be carried out has been explained in advance by the judge. In this case, it also avoids procrastination by the parties so that disputes can be resolved more quickly. Eliminating this exception is in line with the goal of maslahah mursalah. Because the purpose of maslahah mursalah with the use of simple, fast and low-cost principles is the same, namely for benefit by providing convenience in seeking the truth.

Abstract

This research aims to find out how the policies of the district government of Sukoharjo in supporting the implementation of decentralization and regional autonomy,regions in the context of decentralization and regional autonomy. This research uses empirical research. In empirical research, what is examined initially is secondary data, and then it is continued with research on primary data in the field. Data analysis using qualitative descriptions, the results of qualitative data processing is described by the sentence separated by categories to obtain conclusions. Then the results of the analysis serve as answers to the problems raised. The results of the study show that the Government of Sukoharjo Regency's policy in supporting the implementation of decentralization and regional autonomy, among others Establishing Regional Regulation of Sukoharjo District Number 3 of 2010 concerning Long-term Regional Development Plans Year 2005-2025, Establishing Regional Regulation of Sukoharjo District Number 10 of 2010 Concerning Development Plans Medium-Term Regional Year 2016-2012, Establishing Regulation of Sukoharjo Regent Number 40 Year 2018 Regarding the Work Plan of the Regional Government of Sukoharjo Regency in 2019. Then also obtained the results of problems in regional development in the context of the implementation of decentralization and regional autonomy, among others, there is an imbalance of community income and between regions , poverty, not yet optimal workforce social security, lack of education, optimal implementation of the health service system, a large number of population growth and movement, unhealthy and less organized settlements, are still limited over clean water sources, environmental pollution, investment climate, empowerment of UMKM-Cooperatives that have not been optimal, have not received attention related to food security, not yet optimal implementation of bureaucratic reforms, not yet optimal empowerment of women and child protection, political development is not optimal, transportation conditions are not optimal , and disaster vulnerability. Abstract

This article aims to examine the importance of realizing responsive land registration in the era of disruption to support people's welfare and examine the form of responsive land registration in the era of disruption to support people's welfare. Land registration has a high urgency because it is one of the elements in supporting the welfare of the people. This welfare is related to legal certainty and the fulfillment of governance needs which is manifested in guaranteeing legal protection for land management. However, there are still various problems related to land registration, especially in the era of disruption that demands optimization of technology. Therefore, changes are needed with responsive land registration as a solution. This article includes normative legal research with a statutory and conceptual approach. The urgency is to show a prescriptive on what should be applied to the legal issues under study, especially finding a form of land registration that is responsive in the era of disruption. The results show: (i) The urgency of realizing responsive land registration in the era of disruption to support people's welfare is that there are still land conflicts, the need for an efficient land registration mechanism and maximizing technology; (ii) Responsive forms of land registration in the era of disruption to support people's welfare are realized by: efficiency of land registration by means of information technology, optimization of responsive land registration by expanding community participation facilities, and accountability of land registration by revitalizing land stakeholders.Artikel ini bertujuan untuk mengkaji  pentingnya mewujudkan pendaftaran tanah responsif pada era disrupsi sebagai penunjang kesejahteraan rakyat, dan mengkaji tentang bentuk pendaftaran tanah responsif pada era disrupsi sebagai penunjang kesejahteraan rakyat. Pendaftaran tanah penting untuk menunjang kesejahteraan rakyat. Kesejahteraan berkaitan dengan jaminan perlindungan hukum pengelolaan tanah. Masih terdapat permasalahan pendaftaran tanah pada era disrupsi yang menuntut optimalisasi teknologi menghadapi perubahan. Diperlukan perubahan pendaftaran tanah responsif sebagai jalan keluar. Artikel ini termasuk penelitian hukum normatif, menggunakan bahan hukum primer dan sekunder, analisis deduktif dengan pendekatan perundangan serta konseptual. Hasil penelitian menunjukkan: urgensi mewujudkan pendaftaran tanah responsif pada era disrupsi sebagai penunjang kesejahteraan rakyat adalah maraknya konflik pertanahan, kebutuhan mekanisme pendaftaran tanah yang efisien dan memaksimalkan teknologi;  bentuk pendaftaran tanah responsif pada era disrupsi diwujudkan dengan efisiensi pendaftaran tanah dengan teknologi informasi, optimalisasi pendaftaran tanah responsif dengan memperluas partisipasi masyarakat, akuntabilitas pendaftaran tanah dengan revitalisasi stakeholder pertanahan.

Abstract

Pancasila merupakan norma dasar sebagai sumber dari segala sumber hukum. Sifat abstrak Pancasila menjadi problem-solving yang cepat meresap ke dalam ranah alam konsep pemikiran bangsa menghadapi hoax. Urgensi Pancasila sebagai bangunan utama penyusun Pembukaan Konstitusi, menunjukkan peraturan tidak dapat dipisahkan dengan nilai Pancasila. Penelitian hokum ini normatif dengan menggunakan pendekatan konseptual untuk menemukan aktualisasi Pancasila sebagai problem-solving menghadapi fenomena hoax melalui refleksinya. Hasil penelitian menunjukkan: (i) aktualisasi nilai Pancasila sebagai problem-solving pembentukan karakter bangsa menghadapi fenomena hoax menggunakan etika dari rasa kemanusiaan, sikap jujur, saling peduli, memahami, menghargai, mencintai, tolong menolong; (ii) antinomi hoax dengan karakter bangsa Indonesia dibuktikan ketidaksesuaiannya dengan kepribadian Indonesia diamati dari nilai yang masih eksis dalam masyarakat.

Abstract

The theft case is one of the four most common crimes in the Purworejo Police Legal Area. Among them are theft, embezzlement, fraud, and narcotics. In handling the theft case at the Purworejo Police, there is a legal process that can be completed at the investigation level, although in the Criminal Procedure Code it is not stated but in other laws it has been regulated. So, in this paper, we will discuss how the investigation of the crime of theft is carried out in the jurisdiction of the Purworejo Police and the view of Islamic law on the crime of theft. This study aims to describe how the investigation of the crime of theft is carried out in the jurisdiction of the Purworejo Police. And describe the views of Islamic law on the crime of theft. This research is a field research. Research data in the form of primary and secondary data. In collecting data the author uses interviews and documentation. While in the analysis using descriptive qualitative analysis method with a normative juridical approach. Based on the results of the research conducted by the author, it can be concluded that the completion of the investigation into the criminal act of theft at the Purworejo Police is in accordance with legal provisions where the internal police use the reference to Perkap Number 6 of 2019 concerning criminal investigations. In the view of Islamic law, the criminal act of theft for stealing in secret and theft by committing violence is the same, namely, with the punishment of cutting off hands (had punishment). If the theft is not carried out in secret, the punishment is not had or cut off hands, but ta'zir punishment (a punishment handed over to Ulil Amri to deter the perpetrators and as a preventive measure). Abstrak Kasus Pencurian merupakan satu dari empat tindak pidana terbanyak di Wilayah Hukum Polres Purworejo. Diantaranya yaitu pencurian, penggelapan, penipuan, dan narkotika. Dalam penanganan kasus pencurian di Polres Purworejo ada yang proses hukumnya dapat diselesaikan ditingkat penyidikan meskipun di KUHAP tidak disebutkan namun dalam Undang-Undang lain sudah diatur. Maka, dalam penulisan ini akan membahas tentang bagaimana pelaksanaan Penyidikan tindak pidana pencurian diwilayah hukum Polres Purworejo dan pandangan hukum Islam terhadap tindak pidana pencurian. Penelitian ini bertujuan untuk mendiskripsikan bagaimana pelaksanaan penyidikan tindak pidana pencurian di wilayah hukum Polres Purworejo dan mendeskripsikan mengenai pandangan hukum Islam terhadap tindak pidana Pencurian. Penelitian ini merupakan penelitian lapangan. Data penelitian berupa data primer dan sekunder. Dalam pengumpulan data penulis menggunakan metode wawancara dan dokumentasi. Sedangkan dalam analisis menggunakan metode analisis deskriptif kualitatif dengan pendekatan yuridis normatif. Berdasarkan hasil penelitian yang dilakukan oleh penulis, maka dapat disimpulkan bahwa Penyelesaian penyidikan tindak pidana pencurian di Polres Purworejo sudah sesuai dengan ketentuan hukum dimana internal kepolisian menggunakan rujukan Perkap Nomor 6 Tahun 2019 tentang penyidikan tindak pidana. Dalam pandangan hukum Islam terhadap tindak pidana pencurian bagi pencurian secara sembunyi-sembunyi dan pencurian dengan melakukan kekerasan sama yaitu, dengan hukuman potong tangan (hukuman had). Jika pencurian itu tidak dilakukan secara sembunyi-sembunyi maka hukumannya bukan hukuman had atau potong tangan melainkan hukuman ta’zir (hukuman yang diserahkan kepada Ulil Amri untuk membuat jera pelaku dan sebagai tindak pencegahan).

Abstract

Political dynasties can be interpreted as the distribution of power based on familisme. The phenomenon of this political dynasty was often found in the era of regional autonomy. The enactment of regional autonomy is utilized by political elites to strengthen their power in the region. The phenomenon of this political dynasty certainly has a negative impact on the sustainability of democracy in Indonesia. To conduct this research, the authors used a qualitative literary research method by reviewing literature related to regional autonomy, democracy and political dynasties. Data collection techniques using documentation techniques. Then the data is analyzed through three stages, namely data condensation, data display and conclusion. Based on the research conducted, it was found that the number of political dynasties that occurred in the era of regional autonomy was increasing. What's more, the practice of political dynasties also has a negative impact on the sustainability of democracy. Because political dynasties lead to stagnation of leadership in just one group. In addition, political dynasties also tend to lead to the emergence of corruption dynasties.
