Abstract

Land reclamation over the coast has four philosophically values, among others is that reclamation must observe prevailing regulations. An administrative lawsuit has been lodged into Jakarta Administrative Court against the Governor of Jakarta Decree No. 2485 of 2015 concerning License on K Island Reclamation. The problems arose over the case both legally, socially, and philosophically. This article will examine the Administrative Court consideration over the case, especially on the issues of the implication of Governor’s license, coastal region use in the perspective of sustainable development, and the implication of license towards the case pending before civil court. The research methodology uses normative research. The research fi nds that the license issued by the Jakarta Governor comply with Article 93(1) of Law No. 32 of 2009 concerning Protection and Management of Living Environment. The use of coastal region should be directed for the achievement of sustainability of ecology, economy, social, and cultural. The implication of license related to civil case has a correlation that the licensee cannot freely doing reclamation even though he holds a license. The licensee must observe the impact of reclamation over surrounding environment. A civil lawsuit based on unlawful act committed by the licensee can be submitted if the reclamation infl icts fi nancial loss to the surrounding community.

Abstract

This study aims to examine the effect of Capital Adequacy Ratio (CAR), Non-Performing Loan (NPL), Loan to Deposit Ratio (LDR), and Operating Costs on Operating Income (BOPO) on the profitability of Commercial Banks.  The population used in this study is Bank BRI in 2009-2018.  The data in the study were obtained from the financial statements in 2009-2018.  The analytical method used is multiple linear analysis with the classic assumption test which includes autocorrelation test, multicollinearity test, and heteroscedasticity test using SPSS version 25.0 for windows. The results showed that the variables CAR, NPL, LDR, and OEOI affect the profitability of Bank BRI. The objective of this research is to identify the effect of capital adequacy ratio (CAR), non-performing loan (NPL), loan to deposit ratio (LDR), and operational costs for operating income (BOPO) on commercial bank profitability. People's Bank of Indonesia/State-Controlled Bank (Bank BRI) was utilized as the population for this study from 2009 to 2018. Financial statements from 2009 to 2018 were used to collect data for the study. Multiple linear analysis with classical assumption tests was utilized to conduct the analysis, which included autocorrelation, multicollinearity, and heterocedasticity tests. SPSS version 25.0 for Windows was used to assist with the analysis. The findings indicated that CAR, NPL, LDR, and BOPO all had an effect on the profitability of a People's Bank of Indonesia/State-Controlled Bank (Bank BRI).

Abstract

Development of cooperatives of small and medium-sized enterprises, has become an integral part of national economic development. The presence of cooperative small and medium enterprises start since its establishment until now a a pillarnational economy, it is also reinforced in UUD1945, Article 33, however, if observed the presence and contribution can not be equated with other forms of business such as private companies and SOEs and have not been able to compete in the global market. As time goes by and the dynamic changes in all fields, the law must be able to anticipate these changes, in this case the law should not be left behind with the changes, and may be in line withdevelopment it, otherwise the development and role of law in economic development is not running optimally , Therefore, the law and the economy should be run in parallel and the law is also needed as a social control to avoid collisions with one another. Legal perspective of the running of the economy and increasing economic competitivenesscommunity, especially cooperatives, legal development is carried out through the renewal of legal materials such as the Law on Cooperatives in order to anticipate and competitive flow of globalization, particularly the economic field, but with due regard pluralistic society prevailing legal order and in an attempt to increase certainty and legal protection, law enforcement and human rights (HAM), legal awareness and legal services based on justice and truth, order and prosperity, in the framework of the implementation of state increasingly orderly, organized, smoothly, and globally competitive. Abstract

Cooperatives in Indonesia through a partnership system are felt to be increasingly urgent to implement if it is considered that the indications of the country's economy are not yet optimal. Because it has not been maximized, it is very important to immediately improve the business climate in order to create a conducive and healthy economic climate. The problems in this research are, How is the implementation of partnerships in increasing the competitiveness of cooperative businesses, especially in Pasirjambu village, Pasirjambu district, Bandung district. What factors hinder the development of cooperatives in Pasirjambu village, Pasirjambu district, Bandung, while the purpose of this study is to know and analyze how the implementation of the partnership system in increasing the competitiveness of cooperative businesses, especially in Pasirjambu village, Pasirjambu district, Bandung district. In this study, the method used was the empirical normative legal research method, namely research conducted by conducting secondary research first and then proceeding with conducting research on primary data in the field. Results and discussion the creation of such an economic climate allows economic activity to develop. Evenly, both investment activities, production and distribution activities as well as other economic activities. The role of the law is very important to create certainty in the legal relationship of the parties who enter into a partnership, therefore the law must be able to encourage and be able to provide legal certainty in increasing competitiveness. In increasing competitiveness in the form of partnerships without a definite rule of law, the relationship between the two parties suffers from setbacks and uncertainty. Conclusion The perspective of partnership implementation, based on legal aspects that can provide justice, with the aim of empowering small businesses, cooperatives in nation building, namely equitable development, employment and business opportunities, income distribution, and increasing business capacity, increasing competitiveness, increasing exports, equitable ownership business and strengthen the structure of the national economy. Through the national business partnership movement, all development actors will jointly renew their determination to mobilize all potentials and strengths to accelerate the rate of growth of the just Indonesian nation.

Abstract

Penyebaran Coronavirus Disease 2019 sangat memberikan dampak yang meluas di beberapa Negara salah satunya di Indonesia. Dampak ditetapkan sebagai pandemi oleh Organisasi Kesehatan Dunia (WHO) pada tanggal 11 Maret 2020, tidak hanya berdampak pada kesehatan tetapi berpengaruh secara ekonomi yang berakibat kegiatan ekonomi menjadi terhambat salah satunya usaha dibidang non perbankkan yakni Leasing. Adapun masalah bagaimana dampak Covid-19 terhadap Perjanjian Kredit antara masyarakat dan Perusahaan Leasing. Dengan demikian terkait dengan kegiatan pengabdian kepada masyarakat, yang merupakan salah satu tugas Tri Dharma Pergurun Tinggi, maka dilaksanakan penyuluhan. Dengan tujuan memberikan ilmu pengetahuan kepada masyarakat tentang dampak covid-19 terhadap perjanjian kredit oleh perusahaan Leasing di masa pandemi covid 19. Metode pelaksanaan penyuluhan yaitu narasumber dalam hal ini Dosen menyampaikan materi penyuluhannya dan dilakukan sesi tanyajawab. Kegiatan penyuluhan dilaksanakan di Desa Mekarmaju dengan sasaran sebagai peserta yaitu masyarakat dan dihadiri sejumlah 21 orang. Desa Mekarmaju ini merupakan Desa Binaan Lembaga Pengabdian kepada Masyarakat Universitas Islam Jakarta. Hasil kegiatan pengabdian kepada masyarakat dapat dilihat dengan antusias masyarakat untuk mengikuti kegiatan pengabdian ini sampai selesai.

Abstract

Gerakan perkoperasi di Indonesia melalui sistem kemitraan dirasakan semakin perlu di tingkatkan hal ini dikarenakan indikasi ekonomi negara yang belum maksimal. Karena belum maksimal maka sangat penting untuk segera memperbaiki iklim usaha agar tercipta suatu iklim ekonomi yang kondusif dan sehat, di mana pertumbuhan ekonomi berjalan di atas landasan kebersamaan dari berbagai pelaku ekonomi yang ada. Penciptaan iklim ekonomi seperti ini memungkinkan aktifitas ekonomi dapat berkembang. secara merata, baik kegiatan investasi, kegiatan produksi dan distribusi maupun kegiatan ekonomi lainnya. Permasalahan dalam penelitian ini menemukan persoalan yang berkaitan dengan persfektif kemitraan Koperasi dalam peningkatan daya saing koperasi di desa Pasirjambu, dan factor-faktor pengahambat koperasi, dan diharapkan dapat memberikan solusi terhadap faktor penghambat koperasi tidak dapat berkembang di desa pasirjambu Bandung Jawa Barat. Dalam meningkatkan daya saing dalam bentuk kemitraan tanpa adanya aturan hukum yang pasti, maka hubungan kedua pihak mengalami kemunduran dan ketidak pastian. Perspektif pelaksanaan kemitraan, dilandasi aspek hukum yang dapat memberikan keadilan, dengan tujuan untuk pemberdayaan usaha kecil, koperasi dalam pembanguan bangsa yaitu pemerataan pembangunan, kesempatan kerja dan berusaha, pemerataan pendapatan, dan peningkatan kemampuan usaha, meningkatkan daya saing, meningkatkan eksport, pemerataan kepemilikan usaha serta memperkokoh struktur perekonomian nasional. Melalui gerakan kemitraan usaha nasional semua pelaku pembangunan bersama-sama memperbaharui tekad untuk menggalang seluruh potensi dan kekuatan guna mempercepat laju pertumbuhan ekonomi bangsa yang berkeadilan. Melalui gerakan ini bangsa Indonesia besiap-siap dalam menghadapi tantangan dan peluang dalam perdagangan bebas dan globalisasi ekonomi.

Abstract

Tujuan penyuluhan peranan Lembaga Keuangan Bank dan bukan Bank adalah agar masyarakat dapat memahami peranan perbankan dan bukan Bank dan juga perbedaan kedua Lembaga tersebut karena lembaga keuangan mempunyai peran yang sangat strategis sebagai wadah menghimpun dan menyalurkan dana secara efektif dan efisien untuk memenuhi kebutuhan masyarakat. Selain itu peranan lembaga keuangan bank dan bukan bank berbeda, tetapi kedua Lembaga keuangan tersebut memberi kontribusi bagi perekonomian negara. Jadi masyarakat perlu memahami hal tersebut. Metode pelaksanaan yaitu narasumber dalam hal ini Dosen menyampaikan materi dan dilakukan melalui pendekatan problem solving melalui diskusi dan tanyajawab. Kegiatan penyuluhan dilaksanakan di Desa Mekarmaju Kecamatan Pasirjambu Kabupaten Bandung. Sasaran kegiatan ini  yaitu masyarakat dan dihadiri oleh 21 orang. Desa Mekarmaju. Hasil penyuluhan ini bahwa masyarakat memberikan respon yang positif, dengan semangat dan antusias masyarakat bertanya yang melihatkan ketertarikan masyarakat untuk mengetahui lebih dalam tentang Lembaga keuangan dan implementasinya.

Abstract

National legislation is the requirement established by the International Seabed Authority (ISA) for each country sponsoring Deep-seabed Mining (DSM) and criminal provisions and sanctions are an inseparable part of it. A total of 38 states are listed as sponsoring states, while Indonesia, with its potential as a maritime country and member of UNCLOS 1982, has not participated in DSM activities. This article aims to explore and compare the criminal provisions in the national legislation of sponsoring states that have been approved by the ISA so that the formulation of sanctions in Indonesian national legislation can be illustrated in order to prepare Indonesia’s contribution as a sponsoring state for DSM activities in the International Seabed Area. The research method used is normative juridical with a statute and comparative approach. The research results show that the majority of sponsoring states in their criminal provisions stipulate criminal sanctions in the form of fines as well as the possibility of imprisonment and several administrative sanctions. Based on the results of this comparative study, it can be concluded that the formulation of sanctions that can be regulated in Indonesian national legislation is a maximum fine of more than 100 billion Rupiah and a maximum prison sentence of not less than 5 years, as well as additional criminal penalties and administrative sanctions in the form of termination or revocation of DSM activity permits, confiscation of profits resulting from illegal DSM acquisition, and compensation for environmental damage caused by DSM activities.

Abstract

Powers of the President as Chief Executive in Determining the Number of State Ministries According to the 1945 Constitution. With the amendments to the 1945 Constitution, the President and his partner, namely the Vice President, are directly elected by the people. And the pair that gets the most votes will be sworn in as President and Vice President. Thus began a new chapter in a government led by the President and Vice President. In addition to the President being assisted by the Vice President, based on article 17 paragraph (1) of the 1945 Constitution "The President is assisted by state ministers.". Whereas paragraph (2) based on the first amendment to the 1945 Constitution contains "Ministers are appointed and dismissed by the President" which is actually the same as the contents of the 1945 Constitution before the amendment. The only difference is the word "dismissed" with the change to "dismissed." Then in paragraph (3) of the 1945 Constitution before the change, the contents were "Those ministers lead government departments" were changed to "Each minister is in charge of certain affairs in government." That the article meant that only ministers were in charge of certain affairs/certain tasks. In addition, there is the addition of one paragraph to the third amendment to the 1945 Constitution, namely paragraph (4) which contains "The formation, change and dissolution of state ministries is regulated in law." This is intended to form new departments and dissolve departments that need to be regulated by law so that it is not too easy to dissolve them. Based on the addition of paragraph (4) in the third amendment to article 17 LJIJD 1945, the President is limited in terms of how to form, change and dissolve state ministries. If the state ministries are regulated in law, this will limit the prerogative of the President as the head of the executive power in determining the state ministries, where apart from having the right to determine the ministers who lead the departments, the President also has the right to determine the departments
