UU No. 22 Tahun 2001 tentang Migas dianggap belum cukup memadai sebagai instrumen hukum yang dapat melindungi hak rakyat secara keseluruhan sebagaimana yang diamanatkan pasal 33 UUD Tahun 1945. Abstract

AbstractThe Indonesian Constitution states that financial relations, public services, natural resources and other resources between the Central and Local Governments are regulated and carried out fairly in accordance with the law. The article is a philosophical foundation and constitutional basis for the establishment of the Law of the Republic of Indonesia Number 23 Year 2014 on Local Government. In the Law, the Central Government has granted authority to the Provincial Government to manage the mining resources. For instance, East Java Province has 24 Regencies with the potential of non-metallic mineral mining and 11 Regencies with the potential of metal mineral mining. The northern coast region of East Java is the center of the mining exploitation area, but 20–35% of the population lives below the poverty line. This normative research focuses on urgency of mining management by East Java Provincial Government that aims at regulating community-based mining so that it can overcome the problem of poverty and pay attention to environmental sustainability. AbstrakUndang-Undang Dasar Tahun 1945 menyebutkan bahwa hubungan keuangan, pelayanan umum, sumber daya alam dan sumber daya lainnya antara pemerintah pusat dan pemerintahan daerah diatur dan dilaksanakan secara adil dan selaras berdasarkan Undang-Undang. Pasal tersebut merupakan landasan filosofis dan landasan konstitusional pembentukan Undang-Undang Republik Indonesia Nomor 23 Tahun 2014 tentang Pemerintahan Daerah. Dalam Undang-Undang tersebut Pemerintah Pusat telah memberikan kewenangan kepada Pemerintah Daerah Provinsi dalam pengelolaan pertambangan. Provinsi Jawa Timur memiliki 24 Kabupaten dengan potensi pertambangan mineral non logam dan 11 kabupaten dengan potensi pertambangan mineral logam. Wilayah pantai utara provinsi Jawa Timur merupakan pusat dari wilayah eksploitasi pertambangan, namun 20–35% penduduknya hidup dibawah garis kemiskinan. Penelitian ini fokus pada urgensi pembentukan Peraturan Daerah tentang Pertambangan Mineral di Provinsi Jawa Timur, dengan metode penelitian normatif yang bertujuan adanya pengaturan pengelolaan pertambangan di Provinsi Jawa Timur yang berbasis pada masyarakat sehingga dapat mengatasi problem kemiskinan dan memperhatikan kelestarian lingkungan.

Abstract

AbstractMarriage aims to form a sakinah mawaddah warrahmah family, constitutionality issues arise when social problems occur as a result of early marriage and discriminatory differences between the age requirements of men and women. The Constitutional Court through its Decision 22/PUU-XV/2017 decided that the distinction was unconstitutional, and was ultimately followed up by the legislators. But in reality, there has been a surge in the volume of applications for dispensation for marriage, especially for women, because the age requirement has been increased. Therefore, this paper discusses: What is the ratio legis of the Marriage Law and its relationship to the development of regulations regarding the minimum age requirement for marriage? To answer that, normative research methods are used, with primary and secondary legal materials. Conclusion: The minimum age requirement for child marriage is experiencing social and legal developments. In the past, there were differences, through the Constitutional Court’s decision, finally, both men and women were equated with marriage. It is based on considerations of human rights law, particularly regarding the principle of non-discrimination based on gender. In fact, these changes have not been effectively implemented because there is a marriage dispensation instrument so that whoever submits it will surely be accepted by the court. Precisely with the addition of the minimum age requirement for marriage, it has an impact on the high volume of submissions for dispensation for marriage. AbstrakPerkawinan bertujuan membentuk keluarga sakinah mawaddah warrahmah, persoalan konstitusionalitas muncul ketika terjadi masalah sosial dampak dari pernikahan dini dan diskriminasi pembedaan antara syarat usia laki-laki dan perempuan. Mahkamah Konstitusi melalui Putusan 22/PUU-XV/2017 memutuskan bahwa pembedaan itu adalah inkonstitusional, dan akhirnya ditindakalnjuti oleh pembentuk undang-undang. Tetapi realitanya, justru terjadi lonjakan volume pengajuan dispenasasi kawin, khususnya perempuan lantaran syarat usianya dinaikan. Maka dari itu, tulisan ini membahas: Bagaimana ratio legis dari UU Perkawinan dan hubungannya dengan perkembangan pengaturan tentang syarat usia minimum perkawinan? Untuk menjawab itu, digunakan metode penelitian normatif, dengan bahan hukum primer dan sekunder. Disimpulkan: Syarat usia minimum perkawinan anak mengalami perkembangan sosial dan hukum. Dahulu terdapat perbedaaan, melalui putusan MK akhirnya keduanya disamakan antara pria dan wanita yang hendak melakukan perkawinan. Hal itu didasarkan pada pertimbangan hukum hak asasi manusia, khususnya mengenai prinsip non-diskriminasi berdasarkan gender. Dalam kenyatannya, perubahan tersebut tidak kunjung efektif dilaksanakan karena terdapat instrumen dispensasi kawin sehingga siapaun yang mengajukan pasti akan diterima oleh pengadilan. Justru dengan adanya penambahan syarat usia minimum perkawinan itu berdampak pada tingginya volume pengajuan dispensasi kawin.

Abstract

Limited human resources and technology trigger the risk of non-optimal use of peatlands. Excessive use of peatlands also encourages land destruction, which is characterized by a decrease in the production function of agricultural products. Excessive economic orientation makes farmers sometimes unable to control sustainable peatland management. However, not all farmers understand that environmental sustainability leads to local economic productivity. From this case, through this study, several objectives emerged, namely knowing the natural potential and characteristics of peatlands in Jambi province. Identifying types of agricultural commodities that can be optimized for peatland use. Also find ways to manage agricultural waste that can be used as an added value for local communities. Some of this information can be obtained through a qualitative research approach with qualitative descriptive analysis. The term optimization has not been understood as environmental balance so it is still translated as land intensification that tends to damage peatlands. The most important productive agricultural business is liberica coffee commodities. Likasih coffee is a characteristic of Jambi's agricultural symbol. Other potential crops include coconut, watermelon, cucumber, and rice. Some of these agricultural businesses indirectly encourage farmers to manage sustainable agricultural businesses. At the same time, it reduces the motivation of palm oil businesses that tend to be exploitative. In addition, agricultural waste, which has not been utilized so far, is well managed by farmers. The processed waste is an added value for the people of Jambi Province

Abstract

he unconstitutional dismissal of Aswanto as a constitutional judge by the DPR has faced much opposition from legal scholars. The actions of the DPR stem from its inherent authority as an institution that can propose three constitutional judges. Therefore, the DPR believes that as a proposing institution, it can oversee and dismiss constitutional judges during their term, which is not part of its authority. The mechanism of selecting constitutional judges with the three-branch model of government has caused problems and confusion in the constitutional law. This article will focus on discussing the Quo Vadis of the legal politics of filling the position of constitutional judges, which comes from the three branches of government and the reconstruction of the mechanism for filling the position of constitutional judges in the future. This research has produced several discussion points, including: (1) the legal politics of filling the position of constitutional judges by the three branches of judicial power, which is a reflection of the checks and balances, has been misused by the DPR as an instrument to weaken the body of the Constitutional Court, especially the independence of constitutional judges. (2) The reconstruction of the institution proposing constitutional judges can be carried out by the Judicial Commission by aligning the proposing institutions of the Supreme Court and the Constitutional Court.

Abstract

The constitutional interpretation of the regulation of State-Owned Enterprises (BUMN) is still looking for the right method, BUMN as the embodiment of the constitution for the state's responsibility in managing strategic resources that are used as wide as possible for the prosperity of the people. Submission of a judicial review to the Constitutional Court regarding BUMN can show the direction of constitutional interpretation given by the judges of the Constitutional Court. This article examines whether the constitutional interpretation of SOE arrangements is in accordance with Indonesia's national economic system. The method of approach in this writing is descriptive analysis which explains and analyzes the constitutional interpretation of SOE regulations. the results of the study reveal that the constitutional court has carried out its duties in accordance with the basic principles and principles of the constitution. The Constitutional Court in every decision in the field of BUMN dominates its interpretation by using an originalist interpretation.

Abstract

The purpose of this research is to understand and analyze the ratio legis setting the minimum education requirements for senior high school or its equivalent for a presidential candidate from the study of treatises on discussing educational needs as well as to find out the conditions that can be used in determining the ability of a presidential candidate. The research method used by the author is a normative legal research method, by researching principles, synchronization, systematics, and legal comparisons. The author uses this type of normative legal research because, in formulating the problem, the author emphasizes the legal ratio to the educational requirements of a presidential candidate in Law No. 7 of 2017 concerning General Elections. This is influenced by the emergence of the author's curiosity about reasoning (ratio legis) from the minimum requirements for senior high school school or the equivalent for presidential candidates in Law No. 7 of 2017 concerning General Elections. The Indonesian House of Representatives is expected to be able to reformulate the development of regulations on educational requirements for presidential and vice-presidential candidates in Indonesia. The burden of duties carried out by a president certainly requires more ability to carry out the mandate that the people have entrusted to him in leading the running of the government. In this case, education is one of the components to assess a president's competence and ability.
