Abstract

This paper aimed to respond Muslim minorities' anxiety in the West, which deals with several dilemmatic choices of daily religious life activity. Muslim minorities are required to obey the teachings of Islam. Still, on the other hand, it contradicts with the reality of how difficult practicing Islamic teachings in Western countries according to the Islamic teachings such in Muslim-majority countries. Therefore, Shaykh Yusuf al-Qardhawi saw the need to initiate fiqh that could guide Muslim minorities in the West to continue to practice Islamic law, although in a slightly different format from prevailing teachings in Muslim-majority countries. This fiqh is popularly known as Fiqh al-Aqalliyat. As initiator, Shaykh Yusuf al-Qardhawi was very concerned about the implementation of maqāṣid al-sharī‘ah. This article used library research. Based on this study, it can be concluded that the implementation of maqāṣid al-sharī‘ah in Shaykh Yusuf al-Qardhawi's Fiqh al-Aqalliyat can be seen from the basis of his arguments, which aims such as the basis of the proposition relying on the law. It is also based on the main source of maqāṣid al-sharī‘ah, the principle of paying attention to universal fiqh rules, etc. Furthermore, we can also consider his fatwas, such as the problem of overseeing the implementation of Friday prayers, the law of inheritance from non-Muslims, christmas compliment to Ahlul Kitab, and establishing Islamic institutions from zakat assets.

Abstract

The debate over whether the teachings of the Imāmah Shī'ah Imāmiyah Ithnā 'Ashariyah, including the teachings of the Prophet Muhammad, cannot be avoided. Both SAW the need for Imamat as a substitute for the position of the prophet in managing religion and the world. However, there are fundamental differences that cannot be tolerated, according to ahl sunnah (Sunni), Imāmah is fardhu kifayah, while according to Shī'ah Imāmiyah, it is one of the principles of faith that must be believed. This Shī'ah belief also experienced a deadlock due to the polemic whether Imam al-Ḥasan al-'Ashkari had descendants or not. This deadlock was answered by them by bringing up a new concept in aqidah, called Ghaybah. Therefore, the author sees the need to critically examine this concept of ghaybah, because it is the foundation of the building of the Imamate that is believed to be. In addition to strengthening the faith of Muslims (Sunni), this study will also examine how strong the argument for the concept of ghaybah is. Through a study of the type of library research with a descriptive-critical analysis approach, it can be concluded, first, that the concept of ghaybah does not have a strong argumentative basis. Second, the figure of Imam Mahdi who they believed was only a fictitious figure. Third, the essence of Imam Mahdi's ghaybah contradicts the hadiths of the Prophet SAW and statements of the Shi'ah scholars themselves

Abstract

This article aims to reveal the values of maqāṣid al-sharī'ah in al-Māwardī's concept of the caliphate. He emphasizes the relationship between politics and maqāṣid al-sharī'ah, both of which aim to realize the benefit. Through literature study using the descriptive-analytical method, this paper finds that his basic concept of the caliphate is influenced by his understanding of maqāṣid al-sharī'ah, including maqāṣid al-imāmah, wasīlah legal status, and maṣlaḥah rules. All three are criteria and conditions that a leader meets. He succeeded in formulating a series of prerequisites for a leader to realize the benefit of the people. These prerequisites are in line with the substance of maqāṣid al-sharī'ah.

Abstract

Kesenjangan ekonomi merupakan suatu ketidakseimbangan yang menjadi pemisah antara si kaya dan si miskin. Ia merupakan masalah sosial ekonomi yang terjadi di ranah global saat ini, termasuk di Indonesia sendiri. Karenanya kesenjangan ekonomi merupakan masalah serius yang harus dicari solusinya. Menurut Islam, kesenjangan ekonomi antara kaya dan miskin adalah sunnatullah. Karena pada hakikatnya manusia berbeda-beda keadaannya, ada yang ditakdirkan kaya dan adapula sebaliknya. Akan tetapi Allah melarang setiap perilaku yang menyebabkan kemiskinan dan kesenjangan, seperti tidak mau membantu fakir, miskin dan membiarkan mereka dalam kelaparan. Di antara solusi yang ditawarkan Islam dalam menjawab kesenjangan ekonomi yang ada adalah filantropi Islam. Melalui kajian kepustakaan atau library research yang otoritatif dapat disimpulkan bahwa, pertama, penyebab terjadinya kesenjangan ekonomi diakibatkan oleh tiga faktor yaitu: faktor natural, kultural dan struktural. Hal ini disebabkan dari pengaruh sistem kapitalisme dan materialisme. Kedua, ada banyak dampak yang sangat buruk dari kesenjangan ekonomi seperti, terjadi pemberontakan, kriminalitas, radikalisme, kemiskinan, pendapatan nasional menurut, dan pembagunan nasional terhambat. Ketiga, Islam menyelesaikan kesenjangan dengan cara berperilaku adil khususnya dalam ekonomi, adanya saling tolong-menolong antar sesama, dan meningkatkan kesadaran tentang pentingnya zakat, wakaf, infaq dan sedekah yang kesemuanya merupakan filantropi Islam

Abstract

Baitul Maqdis adalah kota suci, bersih dan diberkahi, terletak di pertengahan wilayah Palestina. Kota ini dahulu merupakan ibu kota Syam yang disifati oleh Allah SWT dengan keberkahan. Bahkan, penyebutannya sebagai kota atau tanah barakah sebanyak lima kali dalam empat surat Makkiyah. Hal ini menunjukkan betapa pentingnya kedudukan Baitul Maqdis bagi umat Islam. Namun disayangkan, penjajahan terhadap Baitul Maqdis kini terulang kembali, dilakukan oleh kaum Yahudi. Dari sini penulis melihat perlunya untuk menulis artikel tentang kedudukan penting Baitul Maqdis bagi umat Islam, sehingga akan tumbuh kesadaran untuk membantu kaum Muslimin yang terjajah di tanah barakah tersebut. Artikel ini merupakan penelitian kualitatif dengan mengumpulkan berbagai data dari perpustakaan (library research). Berdasarkan kajian tersebut, dapat disimpulkan, Baitul Maqdis memiliki kedudukan penting bagi umat Islam karena ia merupakan kiblat pertama kaum Muslimin; tempat diutus dan singgahnya kebanyakan para nabi; dan terdapat banyak keutamaan. Kedudukan penting ini diperkuat dengan langkah-langkah yang dilakukan Rasulullah dan para sahabat untuk menaklukkannya. Ditambah dengan respon kaum Muslimin baik dari kalangan ulama, hakim, penyair, dan panglima perang pasca penjajahan atau invasi Pasukan Salib terhadap Baitul Maqdis. Selain itu, Baitul Maqdis merupakan bukti toleransi umat Islam terhadap agama lain.

Abstract

Setiap syariat Islam pasti bertujuan mendatangkan maslahat dan menolak mudarat. Dalam salah satu aturan syariat, Allah Ta’ala memberikan sebuah aturan bersafar yang khusus ditujukan untuk wanita, yaitu harus bersama mahram ketika bersafar. Namun, melihat zaman dan kondisi hari ini yang berbeda dengan zaman dulu, banyak para wanita yang masih dilema keraguan mengenai status hukum safar wanita tanpa mahram. Untuk itu para ulama berbeda pendapat terkait ‘illah larangan wanita bersafar tanpa mahram. Penelitian ini merupakan penelitian berjenis library reseach, dengan pendekatan deskriptif-analisis. Adapun hasil dari penelitian ini, para ulama terbagi menjadi dua pandangan terkait hukum wanita bersafar tanpa mahram; sebagian berpendapat bahwa ‘illah-nya adalah safar tanpa mahram itu sendiri. Sehingga berkonsekuensi haramnya safar bagi wanita tanpa mahram, baik dalam kondisi safar wajib, sunnah maupun mubah. Sedangkan, sebagian yang lain berpendapat bahwa ‘illah, larangan safar bagi wanita tanpa mahram adalah keamanan untuk bersafar. Hal ini berkonsekuensi pada bolehnya safar baik dalam kondisi safar wajib, sunnah ataupun mubah. Adapun safar yang ditujukan untuk keharaman, maka jelas hukumnya adalah haram.

Abstract

Artikel ini berangkat dari kesalahpahaman sebagian masyarakat yang menganggap hadis tentang perincian al-asmā’ al-husnā (sard al-asmā’) merupakan hadis shahīh. Sehingga mereka sangat bersemangat dalam menghafal perincian al-asmā’ al-ḥusnā tersebut dengan keyakinan, siapa yang menghafalnya akan masuk ke dalam surga. Padahal hadis tersebut bertentangan dengan berbagai hadis lain yang sahīh dan juga menuai banyak kritik dari para ulama. Oleh karenanya penulis melihat perlu untuk men-takhrīj hadis tentang perincian al-asmā’ al-husnā ini dalam al-kutub al-tis‘ah. Melalui kajian kepustakaan atau library reseach dengan pendekatan deskriptif-analisis dapat disimpulkan, pertama hadis tentang perincian al-asma’ al-husna didapati dalam dua tempat, riwayat Ibnu Majah dan Tirmidzi. Kedua: hadis riwayat Ibnu Majah ḍa‘īf disebabkan adanya Abdul Malik, seorang yang ḍa‘īf. Ketiga hadis riwayat tirmidzi dinyatakan ḍa‘īf tersebab adanya perbedaan redaksi, kemungkinan idrāj dan tadlīs dari Walid bin Muslim, seorang mudallis. Keempat, baik dalam matan riwayat Ibnu Majah maupun Tirmidzi memiliki redaksi yang berbeda satu dengan lainnya, dan bertentangan dengan yang lebih kuat.

Abstract

The social contract is a critical concept in the democratic system brought by the West. This concept agrees with the existence of agreements and the transfer of power from the people to the authorities based on the principle of the general will, in the form of individual freedoms that must be protected and realized. It is then very contrary to the conception of Islamic politics, which has a concept equivalent to a social contract in the form of the Bai’at concept. Therefore, this research objectives were to examine the Bai’at concept put forward by Ibn Khaldun to be a mirror for comparison of the Western social contract; and to see its implementation in the state system. Based on the library research method with a descriptive-analytical approach, it could be concluded that: first, the Western social contract contained three interconnected concepts, namely: society, sovereignty, and liberty. Second, according to Ibn Khaldun, Bai’at was very relevant to be referred to as a social contract with three pieces of evidence: the ummah or society in the position of giving the bai'at; power aimed to maintain the benefit of the ummah; and shari’a which is the agreement value. Third, its implementation in the state system was seen in the appointment of leaders in Islam: the existence of a contract between the leader and the community to benefit the hereafter

Abstract

In the book of Qur'anic Studies: Sources and Methods of Scriptural Interpretation, John Wansbrough gives a very sharp critique of the Qur'an. He argues, the Qur'an originates from the Judeo-Christian tradition and the intervention of the Prophet Muhammad on the contents of the Qur'an. Furthermore, it is understood in the view of the life of Muslims that the Qur'an is a holy book sourced from God without any human intervention. For this reason, This paper aims to provide a critical note on John Wansbrough's thoughts on the Qur'an with an overview of the Islamic worldview. This study is a literature study, tracing the works of John Wansbrough both from primary and secondary sources. The results of this study show the evidence: first of all, John Wansbrough's thought is not appropriate for studying and criticizing Qur'an, because he used the methods of historical criticism and literary criticism. Second, both methods have the same result, namely the questionable authenticity of the Qur'an, as in Jewish and Christian scriptures. Third, Wansbrough's fallacy is based on a wrong perspective on key concepts in Islam, i.e, the concepts of God, Prophethood, and Revelation in Islam.
