Abstract

The main problem discussed in this dissertation is how the implementation of qiyas for marriage isbat (confirmation of marriage).This dissertation discusses about marriage isbat from qiyas perspective, analysing three sub-problems which are the focuses of this study; first, what factors that highly influence isbat of marriage in Makassar Religious Court. Second, how Judge's consideration in the case isbat of marriage, and third, how is the implementation of qiyas related to the case of marriage sibat in Makassar Religious Court.This research is a field study. Data sources were obtained during the field research at Makassar Religious Court by doing an interview with the judges. The data was analyzed by deductive method and presented descriptively using normative, juridical, sociological and philosophical approaches. Theories used in analyzing data were theories of justice, certainty and expediency, judges, existence, progressive law, in order to implement isbat of marriage in Makassar Religious Court.The results show that the number of marriage isbat is still high in Makassar Religious Court which is driven by some factors, for instance: the case of spouses asked for marriage certificate (Marriage contract), spouses who asked for jointed-property, children who need birth certificate, or inheritance purpose. Submission of marriage isbat application to religious court is in line with the law No. 1 of 1974, Article 2 Paragraphs (1) and (2) of Marriage Compilation of Islamic Law Article 7 Paragraph (3) letter d. The application for isbat of marriage which was filed with the court and consideration of the judge the judge's consideration in granting the divorce was not bound by positive law alone, but also the consideration of justice, the sociology of law and the public good.The implication of this study recommends the importance of strengthening regulations that can accommodate present and future problems to avoid greater harm so that the problem of "Sirri marriage" that increases can be avoided. The importance of tightening up the conditions in examining the Marriage isbat case and the need for a reconstruction of Law Number 1 of 1974 Article 2 paragraph (2), Regarding Marriage in conjunction with Presidential Instruction Number 1 of 1991 Article 7 Paragraph (3) letter d Regarding Compilation of Islamic Law.

Abstract

This article will try to see how the correlation between Human Rights Obligations and Human Rights when viewed in the perspective of Islamic Criminal Law. The theme of Human Rights Obligations, by scientists and the world community, is not an issue that is considered as important as the issue of Human Rights. Even though the Human Rights Obligation is an important point of whether human rights are upright or not. The description of the relationship is in the concept of Islamic criminal law as summarized in al-Daruriyyat al-khamzah (religious preservation obligations, life obligations, obligations to preserve reason, obligations to preserve offspring and obligations to preserve property.

Abstract

Kewajiban asasi manusia menjadi tema yang tidak menarik dari semua kalangan, baik dari cendekiawan maupun bagi orang awam. Padahal hak asasi manusia akan terpelihara adanya ketika kewajiban asasi manusia itu ditunaikan. Hal itu menjadi penyebab dalam  hukum Islam ada kewajiban yang harus dipelihara, yaitu kewajiban yang tersimpul dalam al-daruriyya al-l khamzah, yaitu hifⱬ al-dῖn (kewajiban memelihara agama), hifⱬ al-nafs (kewajiban memelihara jiwa), hifⱬ al-‘aql (kewajiban memelihara akal), hifⱬ al-nasab (kewajiban memelihara keturunan) dan hifⱬ al-Mᾶl (kewajiban memelihara harta). Kewajiban asasi itu erat kaitannya dengan perintah dan larangan. Menaati perintah (al-amr) dan al-nahῖ) menjadi tujuan diturunkan syariat kepada orang-orang mukalaf untuk mengatur kehidupan, baik yang berhubungan dengan pribadi maupun dengan masyarakat sesuai dengan kehendak Allah utnuk meraih kebahagiaan dunia dan akhirat.Kata Kunci: Bentuk Kewajiban asasi manusia, Hukum Pidana Islam

Abstract

Kaboro Coi practice was originally just a tradition, but the community has considered it an obligation, not carrying out the cooboro coi will get social sanctions from the community, such as being ostracized and the community no longer cares about any event events (hajatan) conducted by families who do not carry out the Kaboro Coi tradition. Seen from the perspective of Islamic law Kaboro coi practice has a substance that shows the value of togetherness, helping each other to help each other, like the concept of "wata ᾶwanu‘ alal birri wa taqwa ". This study, does not want to see the Kaboro Coi tradition as an act that implies rewards and sins when done and not done, but just want to see why this tradition is important to do.The data used as material for analysis are field data obtained through observation, interviews, and literature studies. Abstract

Penelitian ini bertujuan untuk mengetahui mazhab fikih yang dipegang oleh masyarakat habaib, serta pandangan tokoh masyarakat terhadap perkawinan sekufu wanita syarifah dengan laki-laki biasa di Desa Pambusuang. Jenis penelitian ini menggunakan metode penelitian kualitatif dengan pendekatan penelitian yaitu; pendekatan sosial dan fenomenologi. Adapun sumber data yang digunakan adalah data primer dan data sekunder. Metode pengumpulan data yang digunakan yaitu; Library research (studi kepustakaan) dan Field research (studi lapangan). Teknik yang digunakan dalam studi lapangan yaitu observasi, wawancara, dokumentasi dan instrument penelitian serta penentuan informan. Sedangkan teknik pengolahan data dan analisis data yang akan digunakan adalah reduksi data, penyajian (display data), dan verifikasi (penarikan kesimpulan). Hasil penelitian menunjukkan bahwa mazhab fiqih yang dipegang teguh oleh masyarakat habaib di Desa Pambusuang Kecamatan Balanipa Kabupaten Polewali Mandar adalah mazhab Syafi’i ini disebabkan karena datuk-datuk mereka sejak dulu bermazhab Syafi’i, serta mereka kental dengan tradisi Nahdatul Ulama yang notabenenya bermazhab fiqih Imam Syafi’i. Sedangkan pandangan tokoh masyarakat menunjukkan bahwa wanita syarifah dilarang menikah dengan laki-laki biasa. Pandangan ini hanya dikalangan internal keluarga habaib saja. Sedangkan dari Masyarakat Pambusuang sendiri tidak pernah dibiasakan menikah dengan bukan sekufunya, disebabkan dengan kultur budaya yang sangat kental dengan adat siri’nya, serta besarnya rasa cinta dan penghormatan kepada keturunan Nabi Muhammad Saw.
