Abstract

Harmonisasi hukum program penyiaran, terkait dengan penayangan pelayanan publik di bidang kesehatan masyarakat oleh lembaga penyiaran, dapat dilakukan dengan mengonstruksi secara heurestika antara UU tentang Kesehatan dan UU tentang Penyiaran. Sudah diuraikan, harmonisasi hukum program penyiaran yang diberlakukan di dalam lembaga penyiaran adalah niscaya, mengingat kesehatan kehidupan berbangsa dan bernegara dicerminkan oleh kesehatan lembaga penyiaran dalam menayangkan variasi pelbagai rubrik tentang pelananan kesehatan bagi masyarakat. Kesehatan ini patut digarisbawahi, karena lembaga penyiaran selama ini cenderung menayangkan pelbagai tayangannya hanya berdasarkan rating. Dampaknya, selama ini pula lembaga penyiaran cenderung mengidentikkan sebuah tayangan hasil produknya hanya sebagai bentuk iklan, promosi, atau bentuk lainnya yang beraroma komersial.Tidak ada yang salah terkait dengan bentuk-bentuk tersebut, asalkan berpayungkan pada sebuah konstruksi hukum yang jelas dan tegas, mengingat media massa pada hakikatnya terkonteks dengan suatu nilai luhur kebangsaan di negara tempat media massa tersebut melayani publik pemirsanya. Maka diperlukan harmonisasi pengaturan yang berkaitan dengan muatan materi hukum UU Penyiran dan UU Kesehatan beserta peraturan turunannya, dalam lingkup pengaturan iklan obat dan pengobatan sehingga memenuhi asas kepastian, kemanfaaf dan keadilan hukum dan etika.

Abstract

Criminal liability against corporations in Indonesia is still ambiguous, because the Criminal Code cannot capture corporations as legal subjects who can be convicted, because it still adheres to the principle of the subject of law is only natural man. Some laws and regulations outside the Criminal Code have begun to deviate from the general principle, by trying to put corporations as the subject of criminal law and the problem of criminal liability. In the ius constituendum perspective the subject of corporate crime and criminal liability has been formulated explicitly and in detail in the draft draft Criminal Code 2006, Article 44 to Article 50. Thus in principle the corporation has been accepted as a legal subject in criminal law, so that the corporation can be prosecuted and sentenced criminal. The acceptance of the principle which deviates from the principle of error is not contrary to the philosophy of the Pancasila. In other words, the deviation of the principle of error has juridical, sociological, and philosophical relevance.

Abstract

Public services in the legal aid field for underprivileged people facing legal problems is a constitutional obligation based on the 1945 Constitution. Through legal instruments and regulations within the scope of the linkages of laws and regulations, it is perceived that they are complete, significantly as imperatively regulated in Law Number 25 of 2009 concerning Public Services and Law Number 16 of 2011 concerning Legal Aid. Regulatory arrangements related to public services in the legal aid field are regulated within the scope of the authority of the Menkumham through National Legal Development Agency (BPHN). Procedures for filing legal aid. Institutions that are given the authority to provide legal assistance on condition that they have been accredited by the Ministry of Law and Human Rights, criteria that have the right to obtain legal aid services. In this study, researchers have taken a normative juridical approach by describing procedures for providing public services in the field of legal aid and the instruments and regulations that cover them or regulate them to fulfill the principles of legal certainty, legal justice, and legal benefits for underprivileged people who face law problem.
