Abstract

Artikel ini secara spesifik untuk mengenal dan mengkaji tafsir Melayu Nūr al-Ihsān karya Syekh Muhammad Sa’īd al-Qadhī. Penelitian ini membuktikan bahwa tafsir berbahasa Melayu beraksara Arab-Jawi masih eksis dan bertahan hingga abad ke-20 M. Menarik untuk melihat praktik penafsiran yang diterapkan oleh Muhammad Sa’īd dalam tafsirnya. Setelah melakukan penelitian secara deskriptif-analitis, karya ini sangat kaya dengan berbagai nuansa dan corak penafsian terutama berkaitan dengan teologis, fiqh, dan sufistik. Fakta ini tidak mengherankan, karena disamping sebagai seorang agamawan, Muhammad Sa’īd merupakan seorang ahli hukum (qādhi) bermazhab Imam al-Syafi’i di negeri Kedah, dan penganut setia tarekat Naqsyabandiyah Ahmadiyah

Abstract

As a branch of the Hadith’s discipline, the study of ‘Ilal al-Hadîth must have a historical root gene that cannot separate from the figure’s intellection and ideas. The author will examine the emergence and development of that knowledge through this article, together with the paradigm shift in numbers seen from the practice of ta’lîl. In terms of tracking and analysis, the authors use genealogical theory. The results showed that the science of ‘Ilal al-Hadîth was the formulation of rules extracted from the practice of ta’lîl that existed during the companions of the Prophet. This practice documented in the second and third centuries of Hijriyah, then formulated as a scientific discipline in the fourth century to the new century. From the development of this knowledge, it can be illustrated by a pattern of shifting perspectives towards ‘illah, from defects that are general and evident, to special notes, which are not clear and found in the Hadith that seem authentic

Abstract

According to Act No. 23 of 2004, marital rape is mentioned as a variant of domestic violence. However, it still considered by some people as a reasonable action and often legitimized by religious arguments. In turn, this diversity of perception generates the contradiction between the implemented positive law and Islamic law. Through a comparative approach, this paper attempts to find the perspective of Islamic law on this critical issue by way of collecting as many Qur’ānic verses and prophetic hadith as possible, as well as the developed argumentations around it, and analyzing them accordingly in light of maqāṣid al-syarī’ah. At the end, this paper discovers that the practice of marital rape is unlawful according to Islamic law. Therefore, it can serve as a reason for divorce.Undang-Undang Nomor 23 Tahun 2004 tentang Penghapusan Kekerasan dalam Rumah Tangga (PKDRT) mengategorikan marital rape sebagai salah satu varian tindak kejahatan kekerasan dalam rumah tangga. Namun dalam tataran tertentu, marital rape masih dinilai sebagai tindakan wajar dan tak jarang dilegitimasi dengan dalil-dalil agama. Perbedaan persepsi ini telah menimbulkan kontradiksi antara hukum positif yang berlaku dengan hukum Islam yang dipahami masyarakat. Secara komparatif, tulisan ini berusaha menemukan perpektif hukum Islam dalam memandang persoalan marital rape dengan cara menghimpun sebanyak mungkin ayat Alqurān dan hadis serta argumen-argumen di sekitarnya, dan menganalisisnya dalam konteks maqāṣid al-syarī’ah. Di akhir penelitian ditemukan bahwa marital rape merupakan sesuatu yang bertentangan dengan syariat Islam. Oleh karena itu dapat dijadikan sebagai alasan perceraian.

Abstract

Abstract: Indonesia's positive law has determined that half of the joint  property will be the right of the wife, and the other half will be the husband’s right in the event of a divorce between them. This rule of law is based on the responsibility in earning a living which is the obligation of the husband, while the wife’s job is to take care of the household. However, the division of responsibilities, as contained in positive law, has undergone shifts and changes. In the present time, some wives not only acts as a housewife, but also work to earn a living or even become the family's backbone. As a result, the old rules are no longer perceived as a backdrop to the achievement of justice. Through a comparative approach, this paper seeks to find the perspective of Islamic law in assessing the issue of common property rights for working wives, by collecting the arguments and analyzing them in a unified whole through the point of maqashid asy-syari’ah’s view. Through this approach, a legal construction is made, that Islam recognizes the property the wife acquires during her work, as her private property and excludes joint property, on the basis of the concept of hifzh al-mal. This provision is different from the construction of a positive law that merges the wife's property into the common property.Abstrak: Hukum positif Indonesia menetapkan separuh harta bersama menjadi hak istri dan separuh lainnya menjadi hak suami apabila terjadi perceraian. Ketentuan ini didasarkan pada tanggung jawab untuk mencari nafkah merupakan kewajiban suami, sementara pekerjaan istri adalah mengurus rumah tangga. Akan tetapi, pembagian tanggung jawab sebagaimana dimuat dalam hukum positif telah mengalami pergeseran. Dewasa ini, sebagian istri tidak hanya berperan sebagai ibu rumah tangga, tetapi turut serta bekerja mencari nafkah atau bahkan tidak jarang menjadi tulang punggung keluarga. Oleh karena itu, norma hukum tertulis tersebut dirasa tidak lagi dapat dijadikan sandaran dalam pencapaian keadilan. Melalui pendekatan komparatif, tulisan ini berusaha menemukan perspektif hukum Islam dalam memandang persoalan hak harta bersama bagi istri yang bekerja dengan cara menghimpun dalil-dalil serta menganalisisnya dalam satu kesatuan yang utuh melalui sudut pandang maqashid al-syari’ah. Melalui pendekatan ini diperoleh suatu konstruksi hukum bahwa Islam mengakui harta yang diperoleh istri selama bekerja sebagai hak milik pribadi dan tidak termasuk harta bersama atas dasar konsep hifzh al-mal, berbeda dengan konstruksi hukum positif yang melebur harta pencarian istri ke dalam harta bersama.

Abstract

This study examined the hadith regarding the determination of mahram status for adult men due to breastfeeding (al-radhāah). It was needed to be conducted because the hadiths are contradictory to one another. Using the mukhtalif al-hadith science method, this study tried to find the right and correct understanding, avoiding visible outward contradictions, with two forms of settlement, namely non-compromising and compromise. The majority of scholars prioritize a compromise settlement first, then a non-compromising one. The determination of the hadith "maqbul-ma'mulbih" and "maqbul-ghayru ma'mulbih" is a consequence of the application of non-compromising settlement through the nasakh or tarjih method approach. The findings show that contradictory hadiths on adult breastfeeding due to al-radhāah can be resolved by the compromise method (al-jam'u) using takhshis al-'am. The Prophet's command to Sahlah bint Suhail to breastfeed the adult Salim so that he becomes a mahram because of al-radhaah, is only a form of the Prophet's specialness to Salim and not for other adult men

Abstract

This paper aims to explore aspects of the legitimacy of limiting the age of marriage from the perspective of maqâshid al-syarî'ah. Early marriage is regarded as highly common ini Indonesia. According to data for 2020, 1 in 9 or almost 11% of Indonesian girls get married before becoming 18 years old. Through Law Number 16 of 2019 about Amendments to Law Number 1 of 1974 about Marriage, the government is trying to suppress the practice of early marriage  through limiting the age of marriage to 19 years. Research methods are qualitative-explanative method, this paper attempts to analyze the texts and doctrines of fiqh scholars relating to the age of marriage and relate them to the purpose of marriage through the point of view of maqâshid al-syarî'ah. Through this method, it has been discovered that that marriage is a noble Islamic law and the only institution that legalizes sexual relations as a primary need (daruri) for human being in order to realize the maintenance of religion (hifzh al-dîn) through the avoidance of the practice of adultery, as well as maintaining the sustainability of mankind (hifzh al-nasl). Considering that marriage is closely related to responsibilities, it can be concluded that arrangement 19 years as the ideal age for marriage is considered to be in line with the maqâshid of marriage. Carrying out underage marriages will cause mafsadah, because it has negatives effect on health, fertility and causes bad social impacts so that maqâshid marriage cannot be realized.

Abstract

Analysis of 'Ashâbah Hadiths in the Context of Islamic Inheritance (A Study of Interpretation and ImplementationThe concept of 'asabah which is based on hadith “give the inheritance to the rightful people” (zāwul furϋd) and give the rest to the more primal of the male relatives” is considered discriminatory by many parties as well as it’s reducing the percentage of women's inheritance rights as heirs of dzawul furûdh which have been determined in absolute terms (qaht'i). This paper aims to analyze the hadith about 'ashabah through the ma'anil hadith approach using the takhrîj method as well as textual, contextual and intertextual interpretations. The results of the study concluded that the hadiths of 'ashabah are categorized as valid (sahih) hadiths and can be used as evidence (hujjah) regarding the legitimacy of the 'ashabah system in Islamic inheritance. The application of the ‘asabah inheritance system does not have discriminatory implications. On the contrary, it actually contains the value of distributive justice, because justice in inheritance is not always measured by the similarity of designation between heirs, but is also determined by proportionality based on the size of the burden of responsibility assigned to each heir, the balance between rights and obligations and the balance between what is obtained with needs and uses. In order to measure the aspect of justice, the 'ashabah inheritance system must be understood integrally by placing the position of inheritance as a sub-system of the overall family law system within the Islamic legal system which is intact and comprehensive.
