Abstract

Studi ini bertujuan untuk menjabarkan lebih jelas mengenai kedaulatan pada Perairan Natuna dan konflik oleh Cina atas pelanggaran hak berdaulat pada Perairan Natuna beserta pelanggaran hukum internasional UNCLOS 1982. Metode penulisan yang digunakan dalam penulisan ini adalah metode penelitian normatif karena memuat ketentuan-ketentuan hukum internasional maupun nasional yang berhubungan dengan konflik yang sedang dibahas oleh penulis. Selebihnya lagi penelitian ini juga menggunakan pendekatan peraturan perundang-undangan yang memiliki arti menelaah peraturan perundang-undangan yang bersangkutan dengan peristiwa hukum yang diangkat oleh penulis. Hasil studi ini meliputi Pelanggaran Cina yang melakukan klaim sepihak menggunakan peta nine dash line pada Perairan Natuna dan melakukan illegal fishing di yuridiksi Indonesia, sedangkan ZEE Indonesia di Laut Natuna Utara pun telah mendapat pengakuan secara internasional berlandaskan keputusan UNCLOS tahun 1982. Dasar hukum yang digunakan atas tindakan pelanggaran hak berdaulat dan melanggar tersebut adalah konvensi Hukum Laut 1982. Kata Kunci: UNCLOS 1982, Nine Dash Line, Illegal Fishing, Pelanggaran Hak Berdaulat ABSTRACT The purpose of the study is telling and explain further regarding sovereignty of Natuna Waters also reffering to the conflict in which offense of sovereign rights in Natuna Waters and offense of international law UNCLOS 1982 by China. The writing method that used in this study is a normative research method because it contains provisions of international law as well as national conflicts that are being discussed by the author. Furthermore, in this research also uses a legislation approach which means examining laws and regulations related to law case that developed by the author. The results of this study include China’s offense who has make unilateral claims using the nine dash line map on Natuna waters and carry out illegal fishing in Indonesian jurisdiction, while Indonesia's EEZ in the North Natuna Sea has also has acknowledgement based on the 1982 UNCLOS decision. The legal basis that used for offense of sovereign rights is the United Nations Convention on The Law of the Sea 1982 (UNCLOS). Abstract

This study aims to analyze the provisions of Indonesian legislation governing the protection of personal data relating to cybercrime or cybercrime and conduct an analysis with international instruments in the field of Cybercrime, namely the Convention on Cybercrime which has not been ratified by Indonesia and the urgency of ratifying this Convention for the harmonization of Indonesian national law. Researchers used normative legal research in this study. Researchers use laws and regulations, articles, scientific journals, and books as sources of information and library materials so that legal research is known as formative law. This study used a statutory approach and a case approach. The study findings show that Indonesia already has several types of personal data protection arrangements spread across several regulations and laws. But in fact, this does not make cases of personal data leakage in Indonesia subside. Therefore, the strategy that Indonesia must take is to first ratify or access the Convention on Cybercrime, Budapest, 2001, so that the cooperation mechanism stipulated in the convention ultimately benefits and helps Indonesia in eradicating borderless cybercrime.
