Abstract

Penelitian ini dilaksanakan dengan tujuan untuk membahas mengenai perlindungan hukum bagi Notaris selaku PPAT perihal penitipan sertipikat terkait proses jual beli peralihan hak atas tanah dengan studi kasus Putusan Pengadilan Negeri Bukit Tinggi Nomor : 53/Pid.B/2017/PN.Bkt. Metode penelitian yang digunakan ialah penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan, pendekatan analitis, dan pendekatan kasus. Dari hasil penelitian menjelaskan bahwa Notaris selaku PPAT perihal penahanan sertifikat untuk dilakukan proses jual beli bukan suatu perbuatan melawan hukum dan mengenai akibat hukum PPJB yang telah dibuat belum berakhir jika para pihak yang terkait belum memenuhi prestasinya. This study was carried out with the aim of discussing legal protection for Notaries as well as PPAT regarding certificate deposition related to the buying and selling process of the transfer of land rights with a case study of the Bukit Tinggi District Court Decision Number: 53/Pid.B/2017/PN.Bkt. The research method used is normative legal research using a statutory approach, an analytical approach, and a case approach. From the results of the study, it was explained that the Notary as PPAT regarding the detention of certificates for the sale and purchase process was not an unlawful act and regarding the legal consequences of PPJB that have been made have not ended if the parties involved have not fulfilled their achievements.
