Abstract

Tujuan dari penelitian ini untuk mengidentifikasi pertanggungjawaban notaris yang melakukan penyalahgunaan tandatangan blanko kosong dalam pembuatan akta autentik dan menganalisis akibat terhadap akta autentik yang dibuat menggunakan tanda tangan di blangko kosong. Penulisan ini merujuk putusan Nomor 44/Pdt.G/2020/PN Plg. Studi ini menggunakan Metode penelitian hukum normatif dengan pendekatan perundang-undangan. Hasil Studi menunjukkan bahwa tanggung jawab notaris dalam penyalahgunaan tandatangan blangko kosong dalam pembuatan akta autentik tidak sesuai dengan perundang-undangan serta dapat diminta tanggung jawab dari perseptif administratif dan perdata, selain itu terhadap akta autentik yang dibuat berdasarkan tandantangan blangko kosong adalah batal demi hukum. The purpose of this research is to identify the responsibility of notary who misuses Blank stamp Signature in the creation of authentic deed and analyze the consequences of authentic deeds made using signatures in Blank stamps. This paper refers to Court Judgement No. 44/Pdt.G/2020/PN Plg. This study uses a normative legal method with a statute approach. The study shows that the notary's responsibility in the misuse of Blank stamp Signatures in the creation of authentic deeds is not under the law and can be held liable from an administrative and civil perceptive, in addition to authentic deeds made based on Blank stamp signatures resulting is null and void.
