Abstract

The settlement of village yard disputes the village head and customary bendesa play a very important role. Village Head and Bendesa Adat as the interpreter of peace is very reasonable, still included within the boundaries of its duty to make the people of their village to live in peace and peace. In view of the root of the problem, a dispute or violation of the law may be a case of pure custom, a non-custom case, or a mixed case (custom case + non-adat). Included in the category of indigenous cases are disputes whose objects are customary issues or violations which according to local dresta are disgraceful acts but not regulated in the laws and regulations of the State for example are disputes / violations relating to fathers (customary duties), Prohibition of burying corpses in setra, kasepekang case, lokika sanggraha, wrong timpal and others Thus legal certainty of customary land tenure in pakraman village is important to do because nowadays there are often conflicts of villagers pakraman back ground about the land starting from the land of inheritance, land Village yard and village wasteland (AYDS). Above the above, the authors are interested to conduct research by taking the title: "Legal Certainty of Land Ownership Adat By Pakraman Tusan Village Banjarangkan". Based on the above background, can be raised several issues as follows: How is the legal basis of land ownership of Adat by Desa Pakraman Banjarangkan Klungkung And How are the factors inhibiting legal certainty of Indigenous land ownership by Desa Pakraman Banjarangkan Klungkung. The type of research used is the study of Empirical law because in this study besides based on existing theories then also compared the theories with the existing situation in the Village Pakraman Tusan Banjarangkan Klungkung. From the discussion can be drawn the following conclusions: The legal basis of customary land tenure by the Village Pakraman is Law No. 23 of 2014 and Bylaw Bali. 3 Year 2001 and awig-awig Desa Pakraman Tusan Banjarangkan Klungkung Krama village which occupies the reef land of the village, has a strong position against its existence in traditional village, both seen from the rights and obligations. The duties include tedun mebanjar, paying rural / village fees, ngayahang village reef land, mutual assistance and the factors inhibiting legal certainty of land tenure by the village of Pakraman Tusan Banjarangkan Klungkung, among others: ground pipil / girik not clear, the existence of customary village krama Who are in other pakraman village area and others.Keywords : Legal Certainty, Customary Land and Pakraman Village

Abstract

Perkawinan merupakan perbuatan yang mempunyai akibat hukum sehingga harus dicatat secara resmi menurut hukum negara dan anak yang lahir di luar perkawinan atau “anak bebinjat” hanya bisa dilegalkan dengan “pengesahan” sejak yang bersangkutan mendapatkan akta perkawinan. Penelitian ini adalah penelitian hukum empiris yang bersifat deskriptif dengan sumber data primer diperoleh dari narasumber atau informan, sedangkan data sekunder yang dipergunakan terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Teknik pengumpulan data yang digunakan yaitu studi dokumen dan wawancara dengan metode analisis data yaitu metode kualitatif. Hasil dari penelitian hukum ini menunjukkan bahwa dasar hukum anak bebinjat dalam undang-undang Nomor 1 Tahun 1974 Tentang Perkawinan itu tidak ada/tidak diatur karena anak bebinjat ini lahir dari perkawinan yang tidak tercatat di Kantor Catatan Sipil. Kedudukan hukum anak bebinjat dalam hukum waris adat Bali adalah dengan sistem pengangkatan adat yaitu meperas / peras pianak sehingga anak bebinjat mendapat kedudukan dan hak yang sama seperti anak kandung namun untuk di desa adat Ababi, Kecamatan Abang, Kabupaten Karangasem, anak bebinjat akan dapat harta warisan jika si pewaris melakukan hibah warisan dihadapan Notaris dan tanpa mengganggu hak waris dari ahli warisnya yang sah.

Abstract

Perjanjian Pengikatan Jual Beli (PPJB) tanah mengandung hak dan kewajiban dari para pihak yang membuatnya, sehingga apabila hal-hal yang telah disepakati dalam akta Perjanjian Pengikatan Jual Beli (PPJB) dilanggar atau tidak dipenuhi oleh para pihak yang membuatnya maka hal tersebut dapat dikatakan telah terjadi wanprestasi. Perjanjian Pengikatan Jual Beli (PPJB) dimungkinkan dibatalkan secara sepihak oleh salah satu pihak atau atas kesepakatan kedua belah pihak. Perjanjian Pengikatan Jual Beli (PPJB) tanah tersebut dapat pula dibatalkan oleh suatu keputusan pengadilan. Rumusan masalah yang diangkat dalam penelitian iniBagaimanakah akibat hukum terhadap biaya yang ditimbulkan dari adanya pembatalan akta Perjanjian Pengikatan Jual Beli (PPJB) di hadapan Notaris dan Bagaimanakah mekanisme hukum yang harus ditempuh di dalam meminta pelunasan biaya pembatalan akta Perjanjian Pengikatan Jual Beli (PPJB) di hadapan Notaris. Metode penelitian yang  digunakan ialah metode dengan jenis penelitian yuridis empiris yaitu penelitian yang berfokus pada perilaku masyarakat hukum (law in action). Metode pendekatan dilakukan dengan studi dokumentasi dari bahan-bahan literature serta wawancara terhadap informan dan memerlukan data primer sebagai data utama disamping data sekunder dan data tersier. Kesimpulan dari penelitian ini adalah para pihak dikenakan denda yang besarnya telah disepakati dari jumlah yang harus dibayar pembeli kepada penjual atau pembeli untuk tiap-tiap hari keterlambatannya dan pihak penjual wajib untuk mengembalikan uang yang telah dibayarkan oleh pihak pembeli setelah dipotong beberapa persen dari harga jual tanah dan bangunan. Mekanisme dalam meminta pelunasan biaya pembatalan akta Perjanjian Pengikatan Jual Beli (PPJB) adalah uang pembayaran tahap pertama tidak akan dikembalikan sepenuhnya. Uang pembayaran tahap pertama akan dipotong sebesar 30% dari harga yang sudah dibayarkan.

Abstract

Banks are business entities that collect funds from the public in the form of deposits and distribute them to the public in the form of loans and or other forms in order to improve the lives of the masses. The main function of Indonesian banks is as a collector and distributor of public funds. Protection of customers' funds in Indonesia is regulated in the Laws of the Republic of Indonesia Number 10 of 1998 concerning Banks. The increasing incidence of theft of bank customers' funds through the misuse of the ATM service system, reduced account balance has led to the need for further attention regarding how to guarantee the safety of use of ATMs and the prosecution of perpetrators of ATM duplication that can harm both the users of ATMs or the Bank itself. Based on this background, the problems that can be formulated to be discussed is : Are victims of ATM card duplication guaranteed refund by bank  and what is the procedure for refunding for victims of ATM card duplication.This paper uses a method with an empirical type of legal research, which is a legal research method that uses empirical facts taken from human behavior, both verbal behavior obtained from interviews and real behavior carried out through direct observationThe Conclusion if this research is Laws of the Republic of Indonesia Number 10 of 1998 concerning Banks. article 37B number (1) stated that:  “that the bank guarantees the public funds held at the bank concerned“. The following phrase of Article 37B stated that guarantee of bank customer deposits is carried out by a deposit insurance institution . Further arrangements regarding deposit insurance institutions are regulated in Laws of the Republic of Indonesia Number  10 of  2004 concerning  deposit insurance institutions .  the procedures begins by making a complaint by reporting through the BRI call center  or coming directly to nearest branch of Bank BRI to make a report about loss of funds due to victim of ATM duplication. settlement of complaints from customers is carried out entirely by the head office  of Bank BRI. After it is confirmed that the loss of funds is due to victim of ATM duplication,  Bank BRI will refund the victims' customers directly through a direct transfer to each customer's account
