Abstract

Pelaksanaan eksekusi jaminan Fidusia selama ini masih banyak menggunakan jasa debt collector. Banyak permasalahan yang timbil dalam pelksanaan penggunaan jasa debt collector. Penelitian ini bertujuan untuk menganalisis kelemahan dalam pelaksanan eksekusi jaminan Fidusia. yang telah disebutkan sebelumnya yaitu, pelaksanaan eksekusi yang dilakukan kreditur melalui jasa debt collector kadangkala menimbulkan masalah baru antara kreditur dengan debitur. Penelitian ini menggunakan metode penelitian yuridis normatif. Hasil penelitian ini eksekusi jaminan Fidusia mempunyai kekuatan hukum mengikat yang sama dengan putusan pengadilan yang telah berkekuatan hukum tetap.  Pelaksanaan eksekusi jaminan Fidusia masih banyak ditemukan permasalahan seperti mengeksekusi barang jaminan Fidusia dengan cara kekerasan, intimidasi bahkan dengan cara merampas barang jaminan Fidusia di jalan.

Abstract

ABSTRACTAlthough BMT (Baitul Maal wat Tamwil) has not had legal peotection, but in its principle these BMT institutions have performed their function asintermediary institutions that manage funds from, for and by the society. Theproblem of Bmt is not only limited to the legal legality that protect them, but alsorelated to the law of guarantee. Based on the above background, the writer formulates the purpose ofwriting, namely To know the Implementation of Mudharabah Agreement in KSPSBaitul Maal Wattamwil "Binama" Semarang and to understand the obstacles andsolutions. The method of approach used in this study is the juridical sociologicalapproach. The specification of this study is descriptive analysis, which is expectedto be able to provide detail, systematic, and comprehensive description of allmatters related to the object to be studied. The data used in this study are primarydata and secondary data, i.e data obtained through interviews and librarymaterials collected through bibliographic data, which then analyzed qualitatively. The conclusion of this study is that the Implementation of Mudharabahagreement in KSPS BMT Binama Semarang is in the form of mudharabah savingand mudharabah financing. In the implementation, saving or mudharabah savingcan be implemented smoothly, while mudharabah financing scheme is stilldifficult to be implemented in KSPS BMT Binama because the financing ofmudharabah is difficult to be implemented due to the constraints such as thedifficulty of transparency of mudhorib regarding to the profit obtained, thusinhibiting the purpose of mudharabah financing according to Islamic sharia. Inaddition, KSPS BMT BINAMA in providing financing must be with assurance. Todeal with these obstacles, the solutions implemented by KSPS BMT BINAMA inaccordance with the principle of justice are as follows: 1) Market penetration,that is by recruiting new members and make the old members loyal throughvarious services programs in BMT; 2) Cooperate with sponsorship pattern withother agencies for synergy; 3) Public awareness on sharia saving and loan. 4)Assess prospective members or customers from various aspects. The aspects offinancing are better known as the 5 C's principles.

Abstract

Penelitian ini menelaah posisi Sentra Gakkumdu (Penegakan Hukum Terpadu) oleh penyelenggara Pilkada dalam menyelesaikan tindak pidana Pilkada yang  menui banyak masalah dalam menjamin pelaksanaan Demokrasi. Mulai dari adanya pola koordinasi yang tidak mungkin dilakukan secara sistemik antara penegak hukum sampai dengan disharmonisasi keputusan-keputusan yang dibuat berkaitan dengan implikasi terjadinya tindak pidana Pilkada yang dilakukan secara menyeluruh menjadi masalah pokok dan yang paling utama adalah tumpang tindih kewenangan antar lembaga yang tergabung dalam Gakkumdu. Sesuai kajian yuridis Normatif, maka  adanya upaya untuk review ulang kapasitas Sentra Gakkumdu sangatlah penting dilakukan, utamanya dengan mempertimbangkan kapasitas filosofis kelembagaan antara lembaga yang ada dalam Sentra Gakkumdu selama ini berangkat belajar dari pelaksanaan Pemilu 2019 di Indonesia silam. Temuan dlam penelitian ini adalah agar peran Bawaslu harus menjadi lembaga sentral dalam kelembagaan Gakkumdu sehingga nuansa harmonisasi singkronisasi yang tentunya menjadi kelemahan pelaksanaan Pemilu 2019 dapat diminimalisir melalui koordinasi terpusat oleh Bawaslu.

Abstract

 The purpose of this study is to understand the impact of Covid-19 on the world that had consequences on global economic conditions, one of which is the inflation that occurred in several developed and developing countries. Furthermore, the purpose of this study is to understand the extent of the role of the Indonesian government, which is not only considered a successful country in dealing with Covid-19 but also in 2022 Indonesia as the host of the G20 meeting and the G20 presidency. Through the normative legal approach methodology, this research has produced several results that are conveyed in the legal politics carried out by Indonesia in the context of world inflation through the G20 agreement instrument. The Indonesian government, among others, communicated to the disputing countries, namely Russia and Ukraine to maintain economic stability even though they were in a state of war. In order to build the commitments of the G20 countries, the Indonesian government should emphasize the cooperation agreement and joint commitment to building the global economy through the instrument of agreement which must later be ratified by each country.Tujuan dalam kajian ini adalah untuk memahami atas dampak Covid-19 yang ada didunia telah memberikan konsekuensi terhadap kondisi ekonomi global yang salah satunya dampak tersebut adalah dengan adanya inflasi yang terjadi di beberapa negara maju dan berkembang. Lebih lanjut tujuan dalam kajian ini untuk memahami sejauh mana peranan pemerintah Indonesia yang bukan saja dianggap negara yang berhasil dalam menangani Covid-19 akan tetapi juga pada tahun 2022 Indonesia sebagai tuan rumah pertemuan G20 dan Presidensi G20. Melalui metodologi pendekatan hukum normatif penelitian ini telah menghasilkan beberapa hasil yang disampaikan diantara politik hukum yang dilakukan oleh Indonesia dalam rangka inflasi dunia melalui instrumen kesapakatan G20. Pemerintah Indonesia diantaranya melakukan komunikasi kepada negara yang bersengketa yakni Rusia dan Ukraina untuk tetap menjaga stabilitas ekonomi meskipun sedang dalam kondisi perang. Dalam rangka membangun komitmen negara G20, sudah seharusnya pemerintah indonesia menekankan kesepakatan kerjasama dan komitmen bersama dalam membangun ekonomi global melalui instrumen perjanjian yang nantinya harus diratifikasi oleh setiap negara.
