Abstract

As the population grows rapidly, more and more illegal settlements are built on state land that prohibits shelter, specifically in the Ciliwung River area. The Jakarta Provincial Government has a policy to relocate the residents of Ciliwung River, to ensure that the river and Ciliwung river functions return to normal. The government provides for relocation and the construction of flats, so residents may have increased wellbeing. We explore whether the relocation of Ciliwung River residents is in accordance with Law No. 2 of 2012, on Land Procurement for the Public Interest and Regional Regulation of the Special Capital Province of Jakarta No. 1 of 2012 on Spatial Plans. Normative juridical research concludes that the relocation of the settlement is in accordance with Law No. 2 of 2012 on Land Procurement for the Public Interest and Regional Regulation of the Province of Jakarta Capital Special Region No. 1 of 2012 on Spatial Planning. Abstract

Environmental Impact Analysis or called EIA is a preventive measure to prevent environmental damage as well as a prerequisite for getting an environmental license. The EIA in its preparation should involve the society, but there are still many societies that have not been fully involved by investors/business actors and the government. Whereas the society has the right and obligation to keep environment. The lack of social involvement to result in further about an assessment of social participation in the process of preparing EIA. The written uses normative juridical methods in addressing issues related to guarantees of protection concerning society involvement in the process of preparing to EIA and the legal consequences of non-involvement of the society. Discussion results show that society involvement in the EIA compilation process has been protected and guaranteed its rights by regulation but the implications of the regulation are still minimal. Consequently, the involvement of the public with the implications of EIA documents may be submitted to the Administrative Court and investors/business actors shall be required to improve the phase of the non-involvement of the society in the process of preparing the EIA in accordance with the court's verdict. Abstract

Mines that have high economic value make various circles of society are encouraged to explore and exploit the natural resources that contains the value of the mine, including in the government both central and local governments at the provincial, regency / municipality assumed to get the local revenue of funding sources of mining in the area. Post implementation of Law No. 9 Year 2015 on the second amendment of Law No. 23 Year 2014 on Regional Government where it is implicated in the change of authority in the regions in terms of mining licensing authority in the area. Where the regime of local government legislation old one is still under the authority of the district / city, but after the enactment of new local government authority for granting mining licenses are no longer under the authority of district / city yet become the authority of the provincial government. The above conditions provide regulatory impact in the region to immediately follow up the enforcement of laws that the new government as a new regulation

Abstract

Abstract: competition some areas as improving the quality of services and satisfaction of the people became the target of the government’s success in serving the community. Ombudsman to monitor the implementation of public service held by the organizer of state and government at both central and local levels including those organized by the State Owned Enterprises, Regional-Owned Enter-prises and State Owned Legal Entity as well as private entities or individuals who were given the task of organizing certain public services , The establishment of Ombudsman background for the empow-erment of people concerned about state administration, the implementation of the idea of democ-racy, and as a protection of the rights of community members. The apparatus of government, includ-ing the judiciary in charge of creating justice and prosperity. Abstract

Indonesia is a country that has abundant natural resources, both renewable and non-renewable. The wealth of natural resources contained in the motherland can be utilized for the needs and welfare of the people of Indonesia under Article 33 paragraph (3) of the 1945 Constitution. One of the natural resources in Indonesia is forests. The government establishes a forest area as a protected forest area for a benefit that is expected by law. There is a violation of the use of protected forest areas for interests outside the forestry sector, namely the conversion of the function of protected forests used as mining land violations that are contrary to Article 38 Paragraph 4 of Law Number 41 of 1999. Mining business activities have negative impacts as well as positive impacts that arise. Mining will harm environmental conditions that can affect the social life of the community, reducing the environmental quality of the positive impact of the existence of mining business activities in an area will cause changes to the economic level, the legal basis for protecting the affected communities in the mining sector, as mandated by Article 28G Paragraph (1) and Article 28H Paragraph (1) of the 1945 Constitution. Abstract

Gumuk masuk dalam pertambangan galian c harganya pun bisa dilihat dari segi jarak yang strategis, luas lahan, tingginya gumuk serta kandungan yang tersimpan dalam gumuk. Hal ini yang kemudian menarik perhatian dari  pelaku usaha di bidang properti terutama dalam pembangunan perumahan. Alasan tersebut menjadi perhatian dikarenakan jumlah pasir jenis pasir sungai atau pantai  yang semakin mahal dan semakin langka, sedangkan permintaan dari masyarakat (konsumen dalam hal ini adalah pelaku usaha di bidang properti) semakin tinggi. Namun di sisi lain ternyata lambat laun juga berpengaruh pada keberadaan dan ekosistem gumuk sebagai salah satu faktor pendukung kehidupan masyarakat. Karena dengan adanya gumuk maka terdapat lahan untuk dijadikan sebagai area resapan air. Penelitian pengaruh bisnis properti terhadap keberlanjutan gumuk ini menggunakan metode sosio legal. Metode ini dipilih untuk menjawab beberapa permasalahan yang ada di masyarakat atas keberlanjutan gumuk yang semakin menurun dan terdegradasi baik secara fisik maupun psikis. Perkembangan bisnis properti yang identik dengan real estate, rumah, tanah, ruko, gedung atau gudang saat ini juga merupakan salah satu bidang bisnis yang banyak dugeluti oleh generasi muda. Terdapat anggapan dari masyarakat bahwa semakin banyak seseorang memiliki properti, maka seseorang memilik strata sosialnya semakin tinggi.
