Abstract

Hukum, pertama-tama tata hukum negara, t ampak dalam teori Positivisme, khususnya Jhon Austin (1790-1859), dengan analitical legal positivism. Jhon Austin yang dikenal sebagai the founding father of legal positivism, bertolak dari kenyataan bahwa terdapat suatu kekuasaan yang memberikan perintah, dan ada pada umumnya orang mentaati perintah-perintah pemerintah. Pandangan positivisme hukum, tidak akan memberikan pelayanan kepada masyarakat, hukum lebih represif. Bagaimanakah kritik terhadap teori positivisme hukum dalammemenuhi keadilan substantif. Permasalahan akan dikaji secara yuridis filosofis dengan menekankan pada analisa terhadap teori-teori hukum dan peraturan perundang-udangan yang berkaitan dengan hukum positif. Kajian kritis positifisme hukum, pembentukan hukum didasarkan pada nilai-nilai yang abstrak, bukan nilai-nilai yang hidup dan berkembang dalam masyarakat, sehingga hukumnya lebih represif, dan bukan responsive. Hukum tidak fungsional dan tidak pragmatis, Ia hanya melindungi sekelompok warga masyarakat elit, sehingga equality before the law dan rule of law, tidak jalan. Memprioritaskan doktrin kepastian hukum dibandingkan dengan keadilan dan kemanfaatan. Putusan hakim menempatkan keadilan legal formal (Legal justice) prosedural dibandingkan keadilan substantive dan keadilan sosial (social justice).Kata kunci: positivisme hukum, keadilan susbstantif, prakt ik hukum.

Abstract

Penelitian ini bertujuan untuk menjawab permasalahan tentang: 1) Bagaimanakah implikasi UU Administrasi Pemerintahan terhadap fungsi PTUN, apakah keberadaan UU Administrasi Pemerintahan memperlemah atau memperkuat fungsi PTUN sebagai lembaga pengawasan? 2) Apakah perlu dilakukan upaya penguatan fungsi PTUN seiring dengan meluasnya kompetensi absolut PTUN setelah berlakunya UU Administrasi Pemerintahan? Penelitian ini merupakan penelitian hukum normatif, yaitu menganalisis bahan-bahan hukum primer, sekunder, dan tersier. Bahan hukum dianalisis secara yuridis kualitatif. Hasil penelitian menyimpulkan bahwa: 1) Perluasan kompetensi absolut PTUN dapat menimbulkan implikasi memperlemah atau menguatkan fungsi PTUN bergantung pada integritas SDM termasuk hakim; dan 2) Perlu penguatan fungsi PTUN seiring dengan meluasnya komptensi PTUN berdasarkan UU Administrasi Pemerintahan yaitu dengan: a) segera dilakukan perubahan UU PTUN menyesuaikan dengan UU Administrasi Pemerintahan dan meningkatkan daya paksa pelaksanaan putusan dengan membentuk lembaga eksekusi untuk melaksanakan putusan PTUN;  b) meningkatkan independensi hakim PTUN dalam memeriksa, memutus dan menyelesaikan sengketa atau permohonan.

Abstract

The 1945 Constitution of Republic of Indonesia states that it is mandatory for government to ensure all of citizen life and well-being in any conditions and to protect them. This mandate take its concrete form by constructing the relevant National Development Plan. The government responsibility in disaster management is in the hands of central and local government—it is supposedly in well-planned and integrated manner. However, in reality, there is still a lot of overlapping authority and bureaucracy from both the central and local or regional governments in disaster management. The harmonization is needed between the central and regional governments, with the basis of granting the widest possible autonomy within the framework of a unitary state. The purpose of this research is to identify the central and regional relationship arrangements in disaster management in the prevailing regulations and to identify steps that must be taken to realize the harmonization of regulation arrangement between the central government and the regions in disaster management. This research is a normative juridical research and uses a basic, systematic approach and the law synchronization approach. From this paper, it is found that the legal politics of central and regional relations in the planning document have been designed to always be synchronous and consistent and have a high level of harmonization, but in the implementation stage it still needs to be reviewed because there are still disharmony caused by the lack of involvement of local governments as partners and communication between the central government and the local government.

Abstract

The Repression and Persecution of Ethnic Rohingnya in Myanmar is a very crucial problem of International Law and Human Rights. Conflict between citizenship and thejurisdiction of state sovereignty is a fundamental polemic of international law and human rights. Repression and persecution on an ethnic group in a country is discriminatory and contrary to International Law and Human Rights. This thesis aims to identify the Repression and Persecution by Myanmar on Rohingnya Ethnic Group and Human Rights protection for Rohingnya Ethnic Group that has been Repressed and Persecuted by Myanmar. Accordingly, this research employed normative juridical methods that emphasized on the rules of law and international agreements and analyzed using prescriptive qualitative method. It can be concluded from the results of research and analysis that the Repression and Persecution on Rohingnya Ethnic Group by Myanmar is a violation of International Law and Human Rights. The State has the sovereignty to regulate and implement its own laws and determine who deserves to be its citizen, which is recognized in International Law. However, the protection of Ethnic groups and the right of citizenship have also been regulated in the instruments of International Law such as the Anti-discrimination Convention and the Citizenship Convention in order to protect human rights. Myanmar is responsible for the Repression and Persecution on Rohingnya Ethnic Group because it is a violation of the norms of jus cogens of International Law and other instruments of human rights. Such Repression and Persecution can be categorized into Crimes Against Humanity, so that the International Criminal Court has a Jurisdiction to adjudicate Myanmar for the Repression and Persecution on Rohingnya Ethnic Group.Keywords : rural areas, university services, human resource improvement, village regulations.

Abstract

Civil servants as civil state apparatus is one of the tools or facilities of the state in performing its functions to achieve the national goals. For that required adequate arrangements to be obtained professional civil state apparatus, clean from collusion, corruption and nepotism and able to provide maximum public service for society and carrying out governmental and developmental tasks. In carrying out duties and functioni it is not infrequent clashes and disputes that cause employment disputes. The settlement of personnel congress is in fact both in the old Personnel Law and in the ASN Act has been regulated separately in order to provide protection law against ASN, however, because both institutions such as ASN Advisory Board in charge of resolving disputes and regulations derived from the Act of ASN has not been made , so that procedures for dispute resolution of personnel still use the old institutions and regulations such as the Employment Advisory Board.Keywords: Settlement, Dispute, Personnel Affairs, Civil State Apparatus
