ABSTRACT The purpose of this study is to analyze the nullification of mut'ah by judges. This research is a type of empirical juridical research conducted by the author on the considerations of the Bangil Religious Court Judges in the Elimination of Mut'ah in Divorce Divorce Decisions from the perspective of John Rawls' theory of justice. The consideration of eliminating mut'ah by the Bangil Religious Court judge in the decision of the divorce divorce case had several considerations, namely a) Equal liberty of principle (equal liberty principle) Everyone has the same basic freedoms, b) Difference principle (difference principle) social inequality and the economy is regulated in such a way, so that the maximum benefit is obtained for the least advantaged members of society, and c) the Equal opportunity principle, positions and positions must be opened to everyone in a situation where there is equality of opportunity. fair.Keywords: divorce, judge, mut'ah, justice John Raws ABSTRAKTujuan penelitian ini adalah untuk menganalisa peniadaan mut’ah oleh hakim. Penelitian ini merupakan jenis penelitian yuridis empiris yang dilakukan oleh penulis terhadap Pertimbangan Hakim Pengadilan Agama Bangil Dalam Peniadaan Mut’ah Pada Putusan Perkara Cerai Talak perspektif teori keadilan John Rawls. Pertimbangan peniadaan mut’ah oleh hakim Pengadilan Agama Bangil dalam putusan perkara cerai talak memiliki beberapa pertimbangan yaitu a) Equal liberty of principle (prinsip kebebasan yang sama) Setiap orang mempunyai kebebasan dasar yang sama, b) Difference principle (prinsip perbedaan) ketidaksamaan sosial dan ekonomi diatur sedemikian rupa, sehingga diperoleh manfaat sebesar-besarnya bagi anggota masyarakat yang paling tidak diuntungkan, dan c) Equal opportunity principle (prinsip persamaan kesempatan), jabatan-jabatan dan posisi-posisi harus dibuka bagi semua orang dalam keadaan di mana adanya persamaan kesempatan yang adil.
