Abstract

AbstractPeople in the society would have never been living afar from crime or misdemeanor. At the same time, people in the society have also never ceased to think and making every effort within the law to prevent and eradicate crimes and misdemeanors. Not only things such us found in this 21th century, which is the century accompanied with sophisticated telecommunication and information technology revolution. But also with all types of crimes and misdemeanor, or in this article has been given specific attention on the typology of crimes and misdemeanor which are essentially by nature business and economic, or in this article has been considered as the oldest crimes as old as mankind itself. Many kind of efforts to prevent or to eradicate the crime with rules of law have begun since the Garden of Eden, from there until this sophisticated telecommunication and information technological age the law has already been existed. In the essence, the law which governs the typology of handling all kinds of business and economic crimes and misdemeanor are themselves running from the basic ideas of contract, or the agreement based on Pancasila. In Indonesia, Pancasila is the First Agreement and the highest law in the legal system.Keywords: crime; dignified justice; economicAbstrakManusia dalam masyarakat tidak pernah hidup sepi kehidupannya dari kejahatan dan atau pun pelanggaran. Bersamaan dengan itu pula manusia di dalam masyarakat tidak pernah berhenti berpikir dan mengupayakan pencegahan, maupun penanggulangan kejahatan dan atau pun pelanggaran menurut hukum.Tidak saja seperti yang dapat disaksikan berlangsung di abad 21, yaitu abad yang penuh dengan kompleksitas kecanggihan revolusi teknologi informasi dan telekomunikasi. Namun, segala bentuk kejahatan, maupun pelanggaran, atau dalam artikel ini diberikan perhatian terhadap tipologi kejahatan dan pelanggaran yang bercorak Tindak Pidana Ekonomi (TPE) sudah sama tuanya dengan keberadaan manusia itu sendiri. Berbagai macam usaha untuk mencegah terjadinya tindak Kejahatan dan Pelanggaran maupun menanggulanginya dengan pengaturan berupa kaidah hukum sudah dimulai sejak taman Eden, di sana pun hingga zaman teknonologi informasi dan telekomunikasi super canggih ini sudah ada hukum untuk itu. Pada hakikatnya, hukum yang mengatur tipologi penanganan atas berbagai kejahatan ekonomi-bisnis dilakukan melalui kesepakatan atau Perjanjian. Di Indonesia, Kesepakatan atau Perjanjian Pertama tersebut tidak lain adalah Pancasila hukum tertinggi, dan sumber dari segala sumber hukum.Kata kunci: delik; ekonomi, keadilan bermartabat

Abstract

Modern civilization dictates that the police have to adapt to a frame work of a modern police. In this research we argued that the Police should change from the traditional policing to a Dignified Justice Policing. In this perspective, based on the findings in the spirit of the people manifested throughout the existing rules and regulations relating to the community policing (CP) the police must always be able to develop the social defence system. In this scheme, the policy is obliged to serve and to protect the society; and in particular to create a concept of justice, in which human should be treated humane. In the modern concept of policing, the Police must have a close and built a strong cooperation or partnership with society. With a close and strong partnership with the society, the modern police would be able to overcome the threat of any criminalities, particularly the religious radicalism and extremism in its society. This is particularly relevant in the rescent times where religious radicalism is a concern within any societies. Efforts to find a strategy to pursue such an aim has been drawn to a new construction or legal ideas which in this work has been coined as the Dignified Justice philosophy. This paper will describe and analise the findings with the utilization of the Dignified Justice philosophy as an alternative policy to justify a close and strong cooperation between the police and society in an effort to combat or overcome criminalities in the society and simultaneously protect the society from dangerous elements in it. One of the concern that has drawn serious attention is the phenomenon of religious extremism in the community. Key words : Police, Society, Religous Radicalism.

Abstract

In the Indonesian land law, individual right of lands are subject to the public interest. A right of land must have a social function. Nowadays, this policy is taking the form in the Land Procurement Act. One therefore could argue that the legal basic of a compulsory land procurement policy is stronger at the meantime, compare to the one before. Aspects which are regulated in the Law, among other things are the mandatory purchase procedures of land purchasing; the price of the land and these further schedulled in the generally Government regulations. The price of the land is prescribed one- sided by the Government as the purchaserwhois the party in the government contract, representing or acting on behalf of the State. This law has been long recognized in the Indonesian legal system. There are several types of Government compulsory purchases of land rights. The first category is a purchasing of a land right from the temporary holder and the second category is the compulsory purchase of an ownership of land from the permanent holder. In this article, this principle will be briefly examined. For this purpose, the writers use a homegrown but internationally recognised legal philosophy called as Dignified Justice Theory or Philosophy.

Abstract

The legal issue that is raised and examined in this article is the concern that has recently emerged behind the development of (international) economic law. As if the (international) economic law would threaten the sovereignty of countries. This type of research is normative legal research. The results of the research and discussion conclude that the anxiety over such (international) economic law developments is excessive. Even though it is necessary to make efforts as a sign of caution. It is proven that in (international) economic law does not override national law. The theory of dignified as a pure legal theory becomes a tool kit to describe at a glance the “face” of (international) economic law that should not be worried about. Each sovereign state must give consent before the rules and legal principles are applied and enforced within and among the countries that are binding themselves in a form of international agreement. It is at this stage of the approval that the filter with legal values in the soul of the nation (Volksgeist) that safeguards the sovereignty of a nation and state can be used to select (international) economic law.

Abstract

Abstrak“Setiap orang berhak atas perlindungan diri pribadi, keluarga, kehormatan, martabat, dan harta benda yang di bawah kekuasaannya, serta berhak atas rasa aman dan perlindungan dari ancaman ketakutan untuk berbuat atau tidak berbuat sesuatu yang merupakan hak asasi”. Inilah rumusan dari Pasal 28 G Ayat (1) dari Undang-Undang Dasar, yang dinyatakan Perubahannya yang Kedua dalam suatu Ketetapan Majelis Permusyawaratan Rakyat Republik Indonesia. Dalam rumusan ketentuan ini orang dapat menyuling semua asas yang mengatur perlindungan data dalam Sistem Hukum Pancasila.Di samping rumusan ketentuan di atas, sejumlah rumusan kaedah hukum lainnya berisi asas-asas yang sama dapat juga ditemukan dalam beberapa Undang-Undang yang berlaku dalam sistem hukum Indonesia. Antara lain, UU No. 8 tahun 2011 tentang ITE. Penulis artikel ini berpendapat bahwa seluruh rumusan ketentuan dimaksud adalah bentuk-bentuk perwujudan diri dari jiwa bangsa (Volksgeist) tempat orang dapat menemukan asas-asas dan kaidah yang mengatur perlindungan data dalam Sistem Hukum Pancasila. Satu dari asas hukum yang melindungi data pribadi dapat digunakan untuk memecahkan skandal terkini, yaitu Panamapapers.Abstract“Every person has the rights to get protection on his personal/privacy, family, honor, dignity and properties under his power, and has rights to feel secure and to get protection from fear of any threat in order to do or not to do something related to their fundamental rights. This is the formulation of the Article 28 G (1) of the Indonesian Basic Act, mentioned in its Second Amendment mentioned in the Decision of the People's Consultative Assembly of the Republic of Indonesia. In this stipulation one could distil all the legal principles governing data protection in the Pancasila Legal System. Apart from the stipulation mentioned above, some further formulation of legal rules contained similar principles may also be found in several Acts in the Indonesian legal system. Among those Acts, is the Act number 8 of 2011 concerning Information and Electronic Transaction. This writer argues that all of the stipulations are forms of manifestation of the spirit of the Indonesian people (Volksgeist) in which one could find rules and principles governing data protection in the Pancasila Legal System. One of the principles of Law that protect the personal data could be used in order to solve the rescent scandal called Panamapapers.

Abstract

There have been an existing problem in Indonesia. We have been told that Indonesia’s social security system, particularly its national health social insurance (JKN) is not equipped to deal with the health and economic shocks associated with a pandemic such as Covid-19. In this article we look at how Indonesia must prepare to face a possible chalanges, post Covid-19 Pandemic. We argue that the government need to focus on a clear legal strategy to address the medium-and longer-term implications of a pandemic such as Covid-19. Since the pandemic has ended, appart from technicals efforts such as continuing reducing the rate endemic of infection through effective testing and tracing and enforcing social distancing and mobility restrictions, the government need to reform the JKN in order to be able to support all the populations particularly the poor and near-poor. A legal philosophy for the reform scheme is needed to reducing long-term poverty and preventing structural changes in unemployment that undermining the JKN. As a report of a legal research, this paper used normative methodology to examine primary legal material such as legislations pertaining to the JKN. It has been found that the Covid-19 pandemic undermines the JKN in the form of legislations regulating this particular field, and it is needed to be reformed.Keywords: Indonesia, Social Health Insurance, Dignified Justice Jurisprudence.

Abstract

There has not arisen any case laws post-Decision of the Constitutional Court No. 012/PUU-I/2003 and enactment of Article 52 paragraph (2) of Government Regulation No. 35 of 2021 to show how the Constitutional Court decision is being interpreted and applied by judges. The authors propose a future model for judges who will be adjudicating disputes in the Industrial Relations Court, that they may set aside rules which conflict with principles of law. The decision of the Constitutional Court stated that a reason for termination of employment due to serious violations pertaining to criminal acts perpetrated by workers as detailed in Article 158 of the Employment Law contradicting the 1945 Constitution having no binding force. Using normative legal research the authors argue that judges, based on several principles of law with independence of judiciary principle on their top, may disregard controversial regulation as the basis to justify the employment termination. It is argued as such, although the rule is still in full force as implementing law of a new Law on Job Creation. The new Law seemingly re-legalizes the right of employers to terminate employment due to acts of violation committed by workers as regulated in employment agreements, company regulations, or collective labor agreements. Based on the theory of Dignified Justice judges if any future disputes on termination of employment due to the controversial rule occurred may decide in favor of the employee based on important principles of law rather than the controversial rule. This will clarify the uncertainty of understanding among some circles that the Constitutional Court Decision could simply be annulled by Article 52 of Regulation No. 35 of 2021.

Abstract

The fundamental issue in every general election, for instance the Indonesia’s 2024 election, is the existence of stipulated principle of neutrality of the State Civil Apparatus (SCA) in election laws. The principle has been in conflict with the highest values which should govern it. The purpose of this research is to describe and discuss the idea or effective legal theory for solving the conflict of SCA with the highest values that should govern it. The research applied the Indonesian legal theory known as Dignified Justice to navigate the finding. The methods used is pure legal research or the normative legal research. It has found that the root problem of violations of the principle of SCA in, for instance the 2024 is that election laws is in conflict with the Pancasila, which has long been understood as not as the highest law, but an ideology, while an ideology has been argued as a manipulative tool of a ruling elite to control its subject. In order to solve the problem, this study proposes that Pancasila should be treated as containing the highest values or the inner morality of law to govern the principle of SCA stated in the country’s election laws.
