Abstract

Critical attention toward migrant worker issues in the regional level grows in accordance with the universalization of human rights principle. There is no exception in Southeast Asia, where the level of interstate labour migration shows an increasing trend. Cases of exploitation and violence on migrant workers in recipient countries clearly indicate the existence of basic “humanity threat”, which intimidate migrant workers, on social, economic and political structures. Legal protection initiatives have been conducted by international regimes, especially through the Convention on the Protection of the Rights of all Migrant Workers and Members of their Families (1990). However, in ASEAN level, strong interests from each state member has caused difficulties in the ratification of the ASEAN Instrument of the Protection of the Rights of Migrant Workers. Why do most ASEAN countries refuse to ratify the instrument? What is the role of ASEAN in this initiative? This paper examines how far ASEAN countries will protect their workers, which further test their commitment on ASEAN Social Cultural Community 2025’s goal of increasing the quality of people’s life through people-centred and people-oriented cooperation. This paper applies qualitative approach with descriptive analysis method by exploring and understanding the meaning of primary and secondary data. This paper further argues that national interests of recipient countries are the main factor in preventing the ratification of the Instrument of the Protection of the Rights of Migrant Workers in ASEAN. Initiator nations like Indonesia and the Philippines must keep trying to approach other ASEAN state members to encourage creating National Law and standardizing the National Policy for migrant workers as one centralized Customary Law through the Regional Agreement. Centralization will ensure that protection to all migrant workers can be shouldered through risk-sharing practice by all ASEAN state members.

Abstract

This article examines Indonesia’s initiatives in combating and preventing drugs abuse which has reached the level of ‘drugs emergency’. Although there are many advantages in this new approach, this article argues that the implementation of the rehabilitation approach still faces various challenges such as policy implementation priority, mindset changing of the executors, un-fully operational system, infrastructure availability, reliable rehabilitation method test, which generate questions on the effectiveness of the decriminalization policy. In the future, continuous evaluation is needed to make sure that the policy is well implemented and provides impact as is expected, which is to decrease the number of drug abusers.

Abstract

AbstractAs a regional-level organization that was founded in 1967 with 10 South East Asia state members (Indonesia, Malaysia, Philippines, Singapore, Thailand, Brunei, Vietnam, Laos, Myanmar, Cambodia), ASEAN is frequently seen as a unique case of regional integration manifested politically and economically. When society interconnection and integration are more globally intense and bring more serious attentions for social theorists through “Globalization” concept, it cannot be denied that regionalism phenomenon is part of critical observation due to many unanswered questions: How does the regionalism process form? To what extend “globalization” forms regionalism? How do state member actors face globalization process which is sometimes uncontrolled and unregulated with huge consequence such as 1997 Asia Financial Crisis? How is arrangement system of a regional community set up considering no one cannot ensure the final process of globalization in the future, etc.ASEAN – proven not only an economic block – possesses its own formula in effort to achieve its economic, politic and sociocultural goals and in theoretical understanding and praxis of globalization phenomenon are hoped to give significant contribution for ASEAN regional integration process while still being faithful to the main goal: to push development in various aspects through regional collaboration with every state member for social welfare. Keywords: regionalism, globalization, functional integration
