Abstract

Islamic boarding school has been recently exposed with negative issues: becoming a source of terrorists and teaching radical ideologies that will disrupt the nation security stabilization. This article encourages to reveal the fact behind those issues based on the pattern of education adopted at the Islamic education system. Five Islamic schools in the province of Jambi will be the data source. It shows that in one side, Islamic education curriculum tends to be an understanding of belief of the conservative religious-dogmatic, while on the other side, tends to be moderate principle. The subjects of Fikh, tafsir (interpretation), and akidah (belief) lead to a conservative attitude in religious issues and politics. While in the social field, the curriculum is taught in a moderate way. Meanwhile, the tutor or ustaz encourages students to have a conservative attitude in praying and partly in the political field. However, the tutor or ustaz does not encourage students to act radically.

Abstract

The article offers a fresh perspective to analyze the conflict through observation of media coverage, proposing that through this close observation, the form, factors and motives of conflict can be easily identified. Through its observation, this paper records that the clash between Ahmadiyyah and other religious groups has predominated social conflict in Indonesia since 2005 until 2011. It argues that the conflict persistence is due to a weak law enforcement. The state is deemed to be failed to protect the minority group against the violent acts of other religious groups and it is this failure that this artcile associates with the escalation and development of the conflict.

Abstract

This research aims to show up the local islamic society tradition named Ritual Mandi Safor which getfocusfrom various community of islam itself. Riual Mandi Safar represents one of local area ancestor heritage assumed can refuse misfortunes (accident, disaster and disease epidemic). However as the local tradition which is related to islam, it generate pros and contra among the society that support and also refuse it. Relating to that reason, this research aims tofind the meaning of symbol and function of Ritual Mandi Safar for the society that support it. How far their understanding to this rittral and the advantages for their daily life and also the role of local government to remain this tradition.

Abstract

Gender inequity is not the failure subjected to the Prophet Muhammad. The interpretations, thoughts, legal opinions, imaginations of His successors were the causes of the bias as they interpreted the Holy Qur’an and the Sunnah based on the prevailing facts and situation when the Qur’an was revealed, at the time. To reinterpret the doctrinal teachings which allegedly considered bias, one can use many approaches, namely hermeneutical and historical and other comprehensive ones. The result of this endeavor is a living-text function as the guidance for a forever life of human beings.

Abstract

Desa Karang Berahi merupakan desa dengan history yang tinggi dengan adanya Prasasti Karang Berahi penginggalan kerajaan Sriwijaya. Desa ini merupakan masyoritas perkebunan kelapa sawit dengan potensi kelimpahan tumbuhan pakis yang tinggi namun belum dimanfaatkan secara optimal. Masyarakat cenderung hanya memanfaatkan tumbuhan pakis sebagai sayur mayur. Studi etnobotani menyebutkan bahwa tumbuhan pakis dapat dijadikan sebagai obat diantara sebagai obat kencing darah, obat penurun panas pada anak, dan obat sakit kepala. Tumbuhan pakis juga memiliki kandungan Vitamin A yang tidak rusak jika melalui proses pemanasan/penggorengan yang wajar. Pengabdian masyarakat yang ada di Desa Karang Berahi memberikan inovasi dalam pengelolaan tumbuhan pakis menjadi keripik pakis yang lebih ekonomis dengan kemasan yang lebih menarik. Kegiatan pengabdian masyarakat dilakukan dengan metode sosialisasi. Kegiatan pengabdian masyarakat melalu beberapa tahapan observasi, persiapan, dan pelaksanaan. Hasil dari akhir dari pengabdian ini merupakan adanya produk inovatif dari bahan baku tumbuhan pakis menjadi keripik pakis yang memiliki nilai ekonomi yang tinggi.

Abstract

In Indonesian society, interfaith marriages always spark controversy. Due to this fact, some people who are planning or have already begun an interfaith marriage turn to the court to ask for the legalization of their marriage. Through a doctrinal analysis using a comparative law approach, this article aims to examine the arguments of judges in adjudicating and deciding on the legality of interfaith marriages in three court institutions: the Primary Court, the Supreme Court, and the Constitutional Court. Even though the three court institutions have distinct absolute competencies, it is vital to analyze them to identify any inconsistencies or harmonies in the legal arguments, as this would have a significant impact on views and even access to public law in the case. This paper argues that, on the one hand, there is a legal conflict between the factors considered in the Supreme Court's judgment and those considered in the Primary Court's decision in situations involving interfaith marriages. While the Supreme Court, which initially permitted interfaith marriages, now tends to forbid them, the Primary Court's reasoning generally tends to support interfaith marriages. The Constitutional Court's ruling in 2015 regarding the judicial review of the Marriage Law of 1974 against the Constitution of 1945, which in essence forbids interfaith marriage but does not violate the right to establish a family, appears to have caused a change in the justification for the Supreme Court's decision. Abstrak Legalitas perkawinan beda agama di Indonesia masih terus menjadi polemik di tengah masyarakat. Fakta ini menyebabkan sebagian mereka yang akan atau telah melangsungkan perkawinan beda agama untuk meminta pengadilan sebagai forum yang bisa mengesahkan perkawinannya. Melalui kajian doktrinal dengan pendekatan perbandingan hukum, artikel ini akan mengungkap argumen hakim dalam mengadili dan memutus legalitas perkawinan beda agama pada tiga lembaga pengadilan yang berbeda, yaitu Pengadilan Negeri, Mahkamah Agung, dan Mahkamah Konstitusi. Meski ketiga lembaga pengadilan tersebut memiliki kompetensi absolut yang berbeda, kajian terhadapnya menjadi penting dalam upaya menemukan keselarasan atau ketidakselarasan argumentasi hukum, dan ini akan sangat menentukan sikap dan bahkan akses hukum masyarakat dalam perkara tersebut. Hasil kajian menunjukkan adanya ketidakselarasan logika hukum antara putusan-putusan Pengadilan Negeri dan Mahkamah Agung maupun Mahkamah Konstitusi terhadap perkara legalitas perkawinan beda agama yang diajukan para pemohon. Putusan-putusan Pengadilan Negeri pada umumnya cenderung membolehkan perkawinan beda agama, sedangkan Mahkamah Agung, yang awalnya membolehkan perkawinan beda agama, sekarang memiliki kecenderungan untuk melarangnya. Pergeseran kecenderungan Putusan Mahkamah Agung ini baru terjadi pasca-putusan Mahkamah Konstitusi tentang uji materiil Undang-Undang Perkawinan 1974 terhadap Undang-Undang Dasar 1945 di tahun 2015 yang pada intinya pelarangan perkawinan beda agama tidak melanggar hak asasi manusia untuk membangun sebuah rumah tangga.
