Abstract

AbstractIn 2019 The US President was signing space policy directive IV which raised controversies across the globe. This decision is astonishing in recall that the 1968 Outer Space Treaty (the OST) in Art IV was prohibited from using the military by aggressive means. Furthermore, the space force will threaten the third-tier country like Indonesia and others to secure its own space assets, and since long ago Indonesia has actively promoted use of outer space peacefully. Finally, this paper will examine what the position of space force under the OST 1968 and how Indonesia should deal with it through socio-legal approach. IntisariPada tahun 2019 Presiden Amerika Serikat menandatangani Space Policy Directive IV yang menimbulkan beragam kontroversi dari berbagai negara. Keputusan ini cukup mengherankan dikarenakan dalam Pasal IV 1968 Outer Space Treaty (the OST) dengan jelas melarang penggunaan kekuatan militer dalam makna kekuatan yang bersifat agresif. Selanjutnya, keberadaan Space Force dapat mengancam negara tier ke-tiga seperti Indonesia untuk menjaga dan mengamankan asetnya di ruangangkasa, selain itu sejak dahulu Indonesia sangat aktif dalam mempromosikan penggunaan damai di ruangangkasa. Sebagai informasi, artikel ini akan menguji posisi Space Force dengan menggunakan the OST 1968 dan bagaimana posisi yangharus disikapi oleh Indonesia tentang hal tersebut dengan menggunakan pendekatan Socio-Legal.

Abstract

In this paper, the authors provide an overview and comparison of the ASEAN dispute settlement mechanism (DSM) in the 2004 Protocol on EDSM and the ASEAN Comprehensive Investment Agreement (ACIA 2009) and review ASEAN's experience with investor-state dispute settlement (ISDS). The paper then examines the challenges and possibilities of restructuring ASEAN DSM through a Regional Investment Court. This includes discussing the potential benefits and drawbacks of such restructuring and its potential implications for regional integration. Finally, the paper offers some thoughts on possible future developments in this area, including the potential impact of a Regional Investment Court on the overall stability and effectiveness of the ASEAN DSM.

Abstract

This article presents a study of the validity of asymmetrical arbitration clauses, a clause that combines arbitration and a choice of court option, in international commercial contracts. These clauses designate a method of dispute settlement that gives a more favorable position for one of the parties to a contract, hence, creating a debate on its validity on an international level. Despite the convenience the trend has brought in business, this form of arbitration clause has been called into doubt by courts in numerous jurisdictions. Unfortunately, Indonesia itself has yet to have a firm legal standing on this matter as asymmetrical arbitration clauses are not explicitly regulated by the Indonesian arbitration law. This research is conducted by exploring the relation between theories and practices concerning asymmetrical arbitration clauses through analyzing case law and provisions of international arbitration law and the Indonesian arbitration law, and are also analyzed through principles of international and Indonesian contract law. This article aims to provide an analysis regarding the legal effects of having asymmetrical arbitration clauses in commercial contracts and commercial arbitration. Lastly, this study offers a method of interpretation towards such clauses that favors their validity under both international arbitration law and Indonesian arbitration law.

Abstract

Infrastructure projects are expected to deliver positive economic and social impact to the community. However, the model to analyze the economic and social impact is still limited. Therefore, this study aims to develop an economic and social impact model to be used for study the impact of infrastructure projects. The research focuses on several case studies of infrastructure projects which guaranteed by Indonesia Infrastructure Guarantee Fund (IIGF) both PPP (Public-Private-Partnership) Scheme and non-PPP Scheme on telco, water, tourism Sector. These sectors are believed to represented the major infrastructure development that cover both local, national, and international perspectives. The analytical method used to measure economic impacts from infrastructure development is a quantitative approach by using following attributes: Sectoral Economic Analysis, Potential Economic Analysis, Growth Accounting, Input-Output Table Analysis, and Statistical Forecasting. While, to analyse the social impact of infrastructure development, quantitative and qualitative approaches are used by In-depth Interview through questionnaire filling technique and Social Impact Assessment (SIA) method. In addition, this study also used legal approach method. The results show various economic impacts of project investment development, both in terms of potential and realization. Meanwhile, in terms of social impacts, there are various community responses to the realization of project development.
