Abstract

The main issue to be discussed in this study is the development of epistemology in feminist perspective in the academic context. Gender bias still dominates in Islamic study. Ahwal Syaikhsiyah study program or also known as Islamic Family law study program in Indonesia is closely related to internalization of gender equality values. The subjects in this study programare related to family and relations in the family according to Islamic Law. Therefore, the development of feminist epistemology in Ahwal Syaikhsiyah study program is inevitable in Indonesia. Some of the development is performed by Ahwal Syaikhsiyah study program of Darussalam Islamic Institute, Ciamis. The development of feminist epistemology starts from developing a curriculum designed with a feminist perspective, learning subjects with feminist perspective and implementation of research model with feminist perspective for lecturers and students. The result, students can respond to the development of feminist epistemology starting from a class lesson, critical analysis on issues based on misogynistic Islamic perspective which marginalizes, subordinates, and contains elements of violence against women. The analysis result of various problems of the relation between gender and Islam in the study of Ahwal Syaikhsiyah was studied in this research. The students who focused on the study of relation in the family used feminist perspective as an analysis tool in undergraduate theses. However, for lecturers, feminist perspective wasn’t used as perspective in research. The development of feminist epistemology can be a systematic way in creating a women-friendly academic atmosphere which supports gender equality and equity.Masalah pokok yang dibahas dalam kajian ini adalah pengembangan epistemologi berperspektif feminis dalam ranah akademis. Di Indonesia bias gender masih mendominasi kajian Islam. Program Studi Ahwal Syaikhsiyah atau yang disebut dengan Program Studi Hukum Keluarga Islam, di Indonesia termasuk yang memiliki keeratan dengan internalisasi nila-nilai kesetaraan gender. Sebab pada program studi ini mata kuliahnya terkait relasi-relasi dalam keluarga menurut hukum Islam. Oleh karena itu pengembangan epistemologi feminis pada program studi Ahwal Syaikhsiyah menjadi keniscayaan di Institut Agama Islam Darussalam Ciamis. Pengembangan epistemologi feminis diawali dari pengembangan kurikulum yang dirancang dengan perspektif feminis, pembelajaran matakuliah dengan perspektif feminis, dan penerapan model penelitian dengan perspektif feminis bagi dosen dan mahasiswa. Hasilnya, untuk para mahasiswa dapat merespon pengembangan epistemologi feminis dari mulai pembelajaran di kelas, analisis kritis pada masalah-masalah yang didasari oleh perspektif Islam yang misoginis, memarjinalkan, mensubordinasi, dan mengandung unsur kekerasan terhadap perempuan. Hasil analisis terhadap berbagai masalah relasi gender dan Islam dalam kajian Ahwal Syaikhsiyah dijadikan sebagai masalah yang dikaji dalam bentuk penelitian. Para mahasiswa yang memfokuskan pada kajian relasi dalam keluarga menjadikan perspektif feminis sebagai alat analisis dalam penelitian-penelitian dalam bentuk skripsi. Akan tetapi untuk para dosen, perspektif feminis cenderung belum menjadi perspektif dalam penelitian. Pengembangan epistemologi feminis dapat menjadi jalan secara sistematis dalam mewujudkan atmosfir akademik yang ramah perempuan dengan menjunjung kesetaraan dan keadilan gender.

Abstract

This paper is based on the background that peace is a necessity which should always be maintained. Surveys often show West Java as a province with the highest cases and events of discrimination compared with other regions in Indonesia. However, people of West Java have established many peace building movements at central and grassroots levels. Interestingly, peace building movements are often started by women. Peace building can be an area of gender equality. This study was a qualitative study with in-depth interview and observation. The research result showed that women with care ethics who joined peace building were able to contribute as strong social glue in the field. The care ethics of women in their activities also institutionalized equality.

Abstract

One of the discourse of modernization ideas that rejected in Pesantren Miftahul Huda is gender. At least there are four problems related to gender in communication in pesantren, namely: (a) the source of ideological discourse of gender bias, (b) agents of ideology of gender bias, (c) communication that is gender bias, (d) and gender inequality. To explain the issue a critical ethnographic approach was used through the theory of ideology (deep unconsciousness), the theory of communication performance (performance), and feminist theory. The research findings indicate the occurrence of gender bias in communication in The Pesantren of Miftahul Huda in various aspects.

Abstract

This research is motivated by the low knowledge about the importance of involving children in choosing a partner for themselves and determining their readiness for marriage, both mental and material readiness. And to inform the public that marriage on the basis of coercion is included in domestic violence. The research method used is the field research method, in which this research focuses on the results of data collection from predetermined informants. While the data collection techniques used were interviews, observation and documentation. After conducting the research, the results obtained were parents who forcibly married their children to reduce their burden materially and responsibly. Because children who are already married they consider it no longer their responsibility

Abstract

In living a married life, there are always problems that arise and can trigger the desire and courage of a husband to choose to leave a wife and child or what is called household abandonment. This article mainly focuses on the views of the Ulama of Ciherang Village, Banjarsari District, Ciamis Regency, about the Psychological Impacts of neglecting their wives by their husbands. This study uses a qualitative method. The application of this method includes the stages of data collection through observation, interviews, documentation, data analysis and research reports. This study also uses an anthropological approach. This research is the basis for understanding human behavior according to cultural backgrounds and beliefs humanely. The Ulama of Ciherang Village is of the view that it is a legal sin for a husband who abandons his wife without giving any news even though a husband loves the birth support, because basically it is not only the physical income that must be fulfilled but also the internal income. The inner life does not have to be intimate, but also gives advice, comforting the wife is also part of the inner support. If indeed the wife sincerely accepts it then there is no problem, otherwise the husband will sin. The psychological impact of the wife arising from her husband's abandonment in Ciherang Village, Banjarsari District is as follows: (a). The wife feels a deep hurt, resentment and hatred as a result of being neglected by her husband for more than 2 years. (b). The habit of crying because the incident seemed unexpected. In other words, she still did not believe her husband left her without giving news. And this has an effect on reduced appetite. (c). The wife feels hopeless in living with her child because she is depressed by circumstances. (d). Feeling embarrassed when leaving the house because it is the topic of the neighbors' conversation. (e). The wife more often tells about her family problems to other people, be it neighbors or relatives, this is only to vent her feelings of annoyance to her husband.

Abstract

Fikih (Islamic jurisprudence) within the Indonesian Islamic Society has a strong inclination to be placed as the main source of Islamic law understood without interpretation. Though the fikih that developed in Indonesia is the Islamic jurisprudence Arabic social and cultural-geographical background. Of course the fikih atmosphere refers more to the Arab land that places men more particularly than women. The study of this paper will analyze the popular fikih books in Indonesia using a feminist perspective with gender analysis. Fikih as a source of norm for Muslim society regulates the relations of men and women. But because of the long history of fikih along with the male environment, the male culture, and the interests of men, the fiqh that develops and is believed to contain truths that construct the ideology of gender bias. Fikih di lingkungan Masyarakat Islam Indonesia kecederungan kuatnya ditempatkan sebagai sumber utama hukum Islam yang dipahami tanpa interpretasi. Padahal fikih yang berkembang di Indonesia adalah fikih-fikih berlatar sosial budaya dan geografis Arab. Tentu atmosfir fikih lebih merujuk ke tanah Arab yang lebih menempatkan laki-laki secara istimewa dibanding perempuan. Kajian pada tulisan ini akan menganalisis kitab-kitab fikih yang populer di Indonesia dengan menggunakan perspektif feminis dengan analisis gender. Fikih sebagai sumber norma bagi masyarakat muslim mengatur relasi laki-laki dan perempuan. Abstract

Hadis-hadis jika dibaca secara tekstual banyak bertentangan dengan prinsip dan visi Al-Qur’an yang membela kesetaraan perempuan. Oleh karena itu diperlukan bacaan yang kritis. Yaitu membaca hadis dengan perspektif ramah perempuan. Banyak kitab-kitab hadis di pesantren di Indonesia yang secara tekstual mengandung ideologi bias gender. Tulisan ini akan mengkaji berbagai bunyi teks hadis dalam kitab-kitab yang popular di pesantren yang mengandung unsur bias gender. Oleh karena itu memahami hadis dalam konteks kekinian, khususnya hadis-hadis berkaitan dengan relasi laki-laki dan perempuan harus mempertimbangan aspek keadilan dan kesetaraan gender. Sebab banyak bunyi teks hadis yang jika dibaca secara tekstual dengan menafikan interpretasi dan konteks jaman akan mengakibatkan pandangan yang bias gender yang merugikan pada perempuan. Abstract Hadiths when read in a textual way contrary to the principles and visions of the Qur'an that defend women's equality. Therefore, critical reading is required. That is reading the hadith with a woman-friendly perspective. Many of the books of hadith in pesantren in Indonesia which textually contain the ideology of gender bias. This paper will examine the various texts of the hadith in popular books in pesantren that contain elements of gender bias. Therefore, to understand the hadith in the contemporary context, especially the hadiths relating to male and female relations must consider the aspects of justice and gender equality. For many texts of Hadith which, when read textually, by denying the interpretation and contexts of the time will result in a gender-biased view which is detrimental to women.

Abstract

Marriage can be a bridge to the happiness of every culprit, if marriage is based on voluntary, compassionate, mutual protection. But it can also be a bridge of destruction if marriage is done with mere compulsion. The coercion of parents or one of the parents of their children to marry someone whom the child does not want is including psychological violence in the household. Violations of the rights of women in choosing their husbands and mates, which we have often heard is a tyranny, deprives them of their rights, seizes their special decisions, and does not include them in determining the most important choices in their lives.

Abstract

Ba'i Bitsaman Ajil (BBA) financing is widely practiced by Islamic financial institutions including the BMT Al-Istiqomah. However, in the application of the Ba'i Bitsaman Ajil (BBA) contract at BMT Al-Istiqomah, it is different from other financial institutions. As in BMT AM-MU Pasuruan this financing is used to finance micro businesses and also at BMT Hudatama Semarang is used to finance home renovations. While at BMT Al-Istiqomah, the Ba'i Bitsaman Ajil contract was practiced to meet the needs of the community in financing vehicles in the form of motorbikes or cars. BMT Al-Istiqomah can contribute to helping people to have transportation vehicles. Therefore, the authors are interested in conducting research on the Influence of the Ba'i Bitsaman Agreement on the Vehicle Against Increasing Income of BMT Al-Istiqomah Ciamis. The research method used is descriptive-qualitative and quantitative methods (mixed method). While the data collection techniques used are observation, interviews, and documentation. To test the validity of the data, this research uses triangulation method. After analyzing the data, the authors draw the following conclusions: 1) the procedure for financing the Ba'i Bitsaman Ajil agreement that must be fulfilled by each prospective customer begins with the submission of the application until the approval of the realization of financing and using the principle of 5C financing (caracter, capital, condition) analysis. , capacity, and coreteral); 2) How to determine the Margin in the Ba'i Bitsaman Ajil agreement on vehicle financing at BMT Al-Istiqomah has fulfilled the requirements in calculating the sale and purchase by installments or installments as well as determining the margin of the principal price based on the agreement of both parties. (BMT and customers); 3) After data analysis which includes testing the hypothesis, the average income figure in BMT Al-Istiqomah Ciamis in the June-May 2016-2017 period is highest at the Ba'i Bitsaman Ajil agreement with an average number of 10,827,917 while from the other contract is the Murabahah contract 10,236,667, pawn contract 3,259,917, Rahn agreement 2,371,500. Musyarakah agreement 1,660,750, Hasan Qordu agreement 1,157,833. then it can be concluded that the contract of Ba'i Bitsaman Ajil greatly influences the increase in income of BMT Al-Istiqimah Ciamis compared to other contract products found on the BMT.
