Abstract

This study discusses the problem of corruption related to human rights violations that exist in Indonesia, Human Rights are a set of rights that are inherent in the nature and existence of humans as creatures of God Almighty and are His gift that must be respected, upheld and protected by state, law, government, and everyone for the sake of honor and protection of human dignity. Eradication of Corruption Crimes carried out by the Corruption Eradication Commission (KPK) is currently being intensively carried out by the KPK, this can be seen from electronic media news, both printed and online. From this news, we can see together that the KPK has never stopped carrying out its duties in eradicating corruption in Indonesia. Even though many perpetrators of corruption have been arrested by the KPK, this does not necessarily eliminate the crime of corruption, even though every year there are criminals who are arrested by the KPK. The arrests of perpetrators of criminal acts of corruption by the Corruption Eradication Commission, ranging from high-ranking state officials such as the Minister and Chairman of the DPR RI to law enforcers (police, prosecutors, judges and advocates) as well as regional officials such as governors, mayors and regents and DPRD members also did not escape the arrests. by the KPK. The crime of corruption is a crime that can be categorized as a crime of gross human rights violation because the impact caused by these criminal acts can disrupt the country's economy and also hinder the development of the country and even these crimes can also disrupt the world economy

Abstract

Recently, the people of Indonesia were shocked by the news about a top artist Nirina Zubir who had become a victim of the land mafia, as a result, she had to lose her parents' land assets, which was estimated at Rp. 17,000,000,000 (seventeen billion rupiah).  Law enforcement, in this case the Indonesian National Police, has taken a quick and precise step in exposing the crime that happened to the victim of the artist Nirina Zubir  by arresting the perpetrators of the land mafia consisting of his assistants and a notary / PPT who helped multiply the land rights and houses belonging to the artist's parents.   With the rise of land mafia crimes, the question arises how to overcome the land mafia crimes and what are the right steps to eradicate the land mafia. For this reason, this study discusses issues related to eradicating land mafia using criminal law instruments.  The research method in this study uses a statutory approach, a historical approach, and a case approach. While the Type of Research This research is normative legal research. Sources of data in this study using primary, secondary and tertiary data sources. Data collection techniques by means of document/library studies, data analysis is carried out by qualitative juridical methods.  Eradication of land mafia by using criminal law instruments is currently the right method because it can quickly uncover land mafia crimes, we can see this from the disclosure of cases experienced by the meaning of Nirina Zubir  where the police have determined the suspects for the land mafia, but in the future it is necessary to take systematic and organized steps so that the land mafia crime can be eradicated by cooperating with law enforcement agencies and the ministry of ART and related ministries and high state institutions and also requires strict supervision and in the future it is necessary to form a statutory regulation which specifically regulates crimes related to the land mafia

Abstract

The number of perpetrators of criminal acts in Indonesia who fled to other countries, especially to Singapore to avoid the entanglement of criminal law resulted in obstacles for Indonesian law enforcement officers to enforce the law against the perpetrators of these crimes. This study is to find out 1. What is the impact of the extradition treaty between Indonesia and Singapore on the perpetrators of criminal acts 2? To find out the contents of the extradition treaty between Indonesia and Singapore. This research method is normative legal research, where the author collects reading materials from books, magazine articles both printed and online, seminar papers, on extradition and legislation in the field of criminal law related to extradition. The nature of this research is descriptive, analyzes and examines, explains the extradition treaty between Indonesia and Singapore in terms of criminal law. Sources of data in this study using primary, secondary and tertiary data sources. Research Results a. The impact of the extradition agreement between Indonesia and Singapore on criminals is that it can narrow the space for criminals in Indonesia to escape. The reason is, Indonesia already has agreements with partner countries in the region including Malaysia, Thailand, the Philippines, Vietnam, Australia, the Republic of Korea, the People's Republic of China, and Hong Kong SAR, and also the perpetrators of criminal acts who fled to Singapore can be extradited to Indonesia by the government. Singapore following a request for extradition by the Indonesian government. b. The contents of the extradition agreement between Indonesia and Singapore according to this Extradition Agreement amount to 31 types, including criminal acts of corruption, money laundering, bribery, banking, narcotics, terrorism, and financing activities related to terrorism. Suggestion With the extradition agreement between Indonesia and Singapore which was signed on Tuesday, January 25, 2022 in the Bintan archipelago, which was attended by the president of Indonesia and the prime minister of Singapore, represented by the Indonesian minister of law and human rights, to follow up on this so that the DPR RI immediately ratify the extradition treaty by immediately ratifying it as a law so that it can be put into effect immediately

Abstract

Penelitian ini mengkaji tentang Bagaimana dampak putusan MK Nomor: 20/PUU-XXI/2023 terhadap kewenangan jaksa dalam mengajukan permohonan Peninjauan Kembali (PK) dan Siapa yang berhak mengajukan PK dalam perkara pidana di Indonesia tujuan penelitian ini adalah untuk mengetahui dampak putusan MK Nomor: 20/PUU-XXI/2023 terhadap kewenangan Jaksa dalam mengajukan peninjauan kembali. Metode penelitian ini adalah penelitian hukum normatif dengan pendekatan studi kasus analisa. Analisa yuridis normatif. Adapun hasil penelitian ini adalah 1.bahwa kewenangan Jaksa dalam mengajukan PK berdasarkan Pasal 30C huruf h dan Penjelasan Pasal 30C huruf h Undang-Undang Nomor 11 Tahun 2021 tentang Perubahan Atas Undang-Undang Nomor 16 Tahun 2004 tentang Kejaksaan Republik Indonesia [Lembaran Negara Republik Indonesia Tahun 2021 Nomor 298, Tambahan Lembaran Negara Republik Indonesia Nomor 6755] bertentangan dengan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 dan tidak mempunyai kekuatan hukum mengikat. 2. Mengajukan PK yang berhak adalah terpidana atau ahli warisnya.

Abstract

The development of industrial areas has resulted in changes in the social and economic aspects of people in rural areas. Over a significant period, villagers were generally limited to one type of work, resulting in many villages being left behind in development. Increases in rural industrial areas are usually accompanied by further development of roads and other infrastructure. With this increase in facilities, strengthening the capacity of Human Resources through community empowerment and supporting Micro, Small and Medium Enterprises (MSMEs) are three different elements but have the same goal, namely increasing productivity. Based on Law No. 12 of 2012, HR management is an important competency for MSME actors. In addition, to face business challenges in the digital era, MSMEs need to be adaptive and responsive to technological developments. Therefore, this community service program aims to provide an understanding of HR capabilities in the digital era in Nambo Udik Village, Cikande District, Serang Regency. This is done through collaboration with the Bina Bangsa University 2023 KKM group which has a focus on community empowerment and MSMEs. This activity includes presentations, practical training, and mentoring. This method has proven to be very relevant for adoption because the results of this activity show that the target audience has succeeded in recognizing the process of empowering human resources through mentoring assistance

Abstract

The article discusses the impact analysis of the PUU Procedural Law Guidance held by the Constitutional Court on Peradi Advocates throughout Indonesia. The purpose of the study, first is to find out how the impact of the PUU Procedural Law Guidance held by the Constitutional Court on the understanding of Peradi Advocates? Second, to find out the benefits for peradi advocates who follow Bimtek? This research method is normative law, with a statutory approach, a historical approach and a case approach. Primary, secondary and tertiary data sources. Data collection techniques by means of literature study, qualitative juridical data analysis. The results of the first study can increase the understanding and knowledge of lawyers peradi about the authority of the Constitutional Court. Secondly, they can construct a good and correct PUU application, can comprehensively control the PUU application material, get a conference overview of the PUU application flow starting from registration, document preparation and preliminary trial to the verdict trial. Suggestions for the future of the technical guidance are still carried out considering the magnitude of the impact and benefits of the technical guidance for advocates throughout Indonesia.

Abstract

This study discusses problems related to the crime of premeditated murder committed by the former Head of the Propam Polri Inspector General Pol. Ferdy Sambo, S.H., S.I.K., M.H against his own adjutant Brigadier Nofriansyah Yosua at the Police Service's house. The purpose of this research is to find out 1. What is the motive of the perpetrators of the premeditated murder? 2. What are the criminal sanctions imposed on the perpetrators of the crime of premeditated murder? This research method is normative legal research, with a case study approach based on the decision of the South Jakarta District Court No. 796/Pid.B/2022/PN JKT.SEL. Sources of data in this study using Primary, Secondary and Tertiary data sources. Normative juridical analysis. Research Results 1. The perpetrator's motive for premeditated murder of the victim was based on the story of the perpetrator's wife named Putri Candrawathi who claimed to have been abused by the victim in Magelang, which made the perpetrator angry and killed the victim by shooting the victim with a firearm. 2. The defendant Ferdy Sambo, S.H., S.I.K., M.H., in court has been proven legally and convincingly guilty of committing the crime of "participating in premeditated murder" AND "without the right to take action which results in the electronic system not working properly which was carried out jointly same” as the First Primary Charge and the Second First Primary Charge from the Public Prosecutor, so that the perpetrator by the panel of judges was sentenced to death penalty. Suggestions When we get some information, it is best if the information obtained first is clarified or asked for the truth so that we are not mistaken in taking an action and drawing conclusions. So that it can avoid actions that can be detrimental to both parties.

Abstract

Penelitian ini mengkaji tentang Anak sebagai korban tindak pidana pencabulan yang masuk dalam pelanggaran Hak Asasi Manusia (HAM) Hak-hak anak melekat pada diri mereka dan tidak dapat dicabut oleh siapapun, Hak-hak tersebut meliputi untuk hidup, hak kebebasan beragama, hak untuk memperoleh keadilan, hak untuk memperoleh penghidupan yang layak, hak untuk mendapatkan kebebasan, hak keadilan, hak kemerdekaan, hak berkomunikasi, hak keamanan, hak kesejahteraan. Tujuan penelitian ini untuk mengetahui pandangan Hukum terhadap tindak pidana pencabulan anak dibawah umur dan bagaimana dasar pertimbangan hakim dalam memutuskan perkara pidana nomor: 27/Pid.Sus-Anak/2022/PN.Srg tentang Tindak Pidana pencabulan Anak dibawah umur di Pengadilan Negeri Serang. Penelitian ini merupakan penelitian hukum normative dengan menggunakan pendekatan studi kasus berdasarkan Putusan Nomor:27/Pid.Sus-Anak/2022/PN.Srg di Pengadilan Negeri Serang. Hasil penelitian pemidanaan terhadap anak  sebagai pelaku tindak pidana pencabulan berdasarkan Putusan Nomor:27/Pid.Sus-Anak/2022/PN.Srg tidak tepat karena putusan hakim dianggap masih belum sesuai dengan isi Pasal 81 Undang - Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak, yang menjelaskan bahwa untuk perkara pidana pencabulan diancam dengan hukuman penjara minimal selama 5 (lima) tahun dan jika terpidana adalah anak maka anak dipidana paling lama ½ (satu perdua) dari ancaman maksimum yang dijatuhkan terhadap orang dewasa, tetapi praktiknya menjatuhkan pidana hanya perawatan/rehabilitasi selama 6 (enam), selain itu hakim tidak memperhatikan kondisi korban anak yang mengalami trauma berat. Hakim juga menjatuhkan pemidanaan lebih rendah.

Abstract

Tujuan dari penelitian ini adalah untuk menyelidiki dasar-dasar hukum yang menjadi dasar hakim dalam menjatuhkan hukuman terhadap tindak pidana narkotika. Di dalam ruang sidang, hakim bertanggung jawab untuk memeriksa dan mengadili terdakwa. Penentuan dasar hukum yang digunakan pengadilan dalam putusan No.706/Pid.Sus/2022/Pn.Srg tentang pecandu narkotika merupakan tujuan dari penelitian ini. Pendekatan penelitian yang dikenal sebagai penelitian hukum normatif digunakan dalam penelitian ini untuk menemukan jawaban atas permasalahan yang telah dipaparkan. Sebagai hasil dari temuan investigasi, pengadilan memutuskan untuk menjatuhkan hukuman penjara kepada seseorang yang terlibat dalam penyalahgunaan narkotika. Keputusan hakim didasarkan pada peraturan yang relevan dengan penyalahgunaan narkoba serta persidangan yang telah berlangsung. Hakim menjatuhkan hukuman dua tahun penjara sesuai dengan pasal 127 Undang-Undang Nomor 35 Tahun 2009 tentang narkotika, khususnya pasal 127 dan 112 tentang penyalahgunaan narkotika dan kepemilikan narkotika. Menurut hakim, hukuman tersebut dijatuhkan setelah mempertimbangkan hal-hal yang memberatkan dan meringankan terdakwa.
