Abstract

The movement of peoples in today’s refugees problems is more complicated than thephenomena of refugees in pre 21st century or the era of world war I and II, which wereland borders and identities unified by the terms of nation-state, defining the citizens andaliens through the solid model of nationality. In contemporary refugees discourse, theproblems of unwanted forced migration not only covering the protection of people bysupplying their standard of living as an effect of displacement peoples living out of theircountries, but also facing new variables of problem, including economic and ideologicalfactors that became their motives of migration. More than half of all current refugees in theworld come from many states of Muslim countries as a consequence of war and conflictsthat still lasted for more than decades. The conception of Ummah in Islam doctrine ofsociety encourage all Muslims in the world to take a part of responsibility sharing theburden Muslims refugees condition, including receiving them to live and survive inside thestructure of society based on same faith and equal status before Allah the Creator, but inmany cases, this policy contradicted to the concept of nationality which based on nationstateconception of identity and state sovereignty. Indonesia, country with largest Muslimpopulation in the world, has received mass influx of Muslim refugees during the recentyears.

Abstract

that true religious and social solidarity is a supporting factor in the handling ofrefugees in Indonesia. The groups are voicing solidarity keumatan Islam as thecornerstone of refugee protection in Indonesia, either by the strengthening of thecivil society as well as with the approach of religious behavior such as infaq,zakat, sadaqah, sacrificial, and pegumpulannya used to fund the protection andhandling of refugees in Indonesia, even some group voiced that the oppressedMuslim Rohingya refugees to be recognized as part of the citizens of Indonesia,this is all a form of commodification of religion in handling the issue of refugees inIndonesia. Although there are no clear synchronization between communitysolidarity with national interests, even precisely tend paradox, but unconsciouslycommoditization of religion in handling the issue of refugees is preciselystrengthen the role of the international regime to intervene against the nationalinterests of the handling of refugees in Indonesia.

Abstract

Tulisan ini merupakan rangkaian dari tema kajian tentang pemikiran kontemporer dalam kajian keislaman, dimana pada bagian ini merupakan penggalan yang membahas tentang Islam dan permasalahan Hak Asasi Manusia, khususnya mengenai pemikiran seorang pemikir, akademisi, dan praktisi hukum asal Sudan, Abdullahi Ahmad An-Naim sebagai perpanjangan dari ide-ide yang dilahirkan oleh gurunya, Mahmoud Mohammed Thaha dalam The Second Message of Islam untuk merespon masalah HAM. Berangkat dari responnya terhadap persoalan HAM di Sudan, pemikiran An-Naim justeru dapat dianggap sebagai formula baru dalam usaha menyelesaikan masalah-masalah Hukum Islam kekinian, khususnya yang berkaitan dengan permasalahan Hukum Publik. Islam secara umum tidak membuat perbedaan antara ranah Hukum Publik dan Hukum privat, tetapi pendidikan An-Naim yang berlatar belakang hukum Anglo- Common Law- memetakan responnya terhadap masalah hukum ke dalam kategori antara ranah publik dan ranah privat, masalah HAM termasuk kategori ranah publik

Abstract

Pelecehan seksual dari dulu hingga saat ini sangat menarik perhatian publik, terlebih dalam waktu belakangan kini. Pelecehan seksual sendiri tidak hanya meninggalkan bekas pada fisik, akan tetapi juga pada psikis korban. Meningkatnya jumlah korban dari pelecehan seksual terus saja bertambah dari tahun ke tahun. Terlebih lagi saat kodisi pandemi seperti ini, tingkat kasus pelecehan seksual masih saja bertambah banyak. Banyakya korban pelecehan seksual adalah para perempuan khususnya di usia yang masih muda. Tidak jarang tindakan pelecehan seksual juga kerap terjadi di lingkungan sekolah bahkan pesantren. Pelaku dari tindakan tersebut adalah oknum tak bertanggung jawab, sedangkan yang menjadi korban adalah murid santriwati yang menimba ilmu di pesantren tersebut. Tidak hanya itu bahkan pelecehan seksual juga kerap terjadi di dalam lingkungan keluarga maupun sosial. Saat ini pun sangat diperlukan upaya penegakan hukum yang adil dan setimpal bagi para pelaku pelecehan seksual dan juga tindakan atau penanganan yang baik untuk korban pelecehan seksual.
