Abstract

Abstract: The Constitutional Court of the Republic of Indonesia has 4 (four) authorities and one obligation, as for those authorities, namely: (1) The Constitutional Court has the authority to adjudicate at the first and last level whose decisions are final to test the Law against the Constitution, (2) decide authority disputes of State Institutions whose authority is granted by the Constitution, (3) decide upon the dissolution of political parties, (4) and decide upon disputes about the results of general elections. The obligations, namely the Constitutional Court is obliged to give a decision on the opinion of the House of Representatives regarding the alleged violation by the President and / or Vice President. Beyond the specified authority, the Constitutional Court has increased its authority to test the Substitute Government Regulations. The research method used in this study is a type of normative legal research that is a literature study or documentary, by examining theories, concepts and legal principles. The results of this study found that there is indeed no rule that gives the Constitutional Court authority to test regulation in lie of law, but the Constitutional Court has the consideration that the legal norms contained in the Perppu are the same as the Law. The results of this study are that the interpretation used by constitutional justices to test Perppu is a teleological and sociological interpretation.Keywords: Interpretation; Test; PERPPU; Constitutional Court.

Abstract

This study aims to uncover the meaning behind the tedhak siten tradition and its relationship to the changes and structure of life in society. Although there are many studies that discuss this from its philosophical values, there is no character value that discusses it. These findings at least prove that tradition can provide a positive value in social life. This study uses descriptive-qualitative research with primary data researchers obtained from interviews and observations during the procession of Tedhak siten ceremony in Tanah Laut, South Kalimantan. The results of this study prove that the tedhak siten tradition practiced by the Javanese people still adopts Islamic teachings. The ceremony has a meaning related to the formation of the child's character, changes in attitude and self in life in society in the future. This tradition tends to bring up the values of goodness in the form of patterns of alms, giving thanks, praying, and being hopeful. This theory tends to be called Education optimism about what will and will be achieved later.

Abstract

Abstract This thesis explores the idea that the students are able to understand even though they are not educated or accomplished. Some scholars assume, however, that the educational path must go through classrooms. At least this result will give anyone the potential to enhance strong listening skills. The book Diwan Al-Mubtada Wa Al-Khabar Fi Tarikh Al-'Arab Wa Al-Barbar Wa Man 'Asarahum Min Dzawi Al-Sha'ni Al-Akbar by' Abdurrahman Ibn Khaldun with hermeneutic methodology is study using library study with the key source. The outcomes of this research are the principle of fatqu al-lisan by giving preference to basic education abilities by learning soft skills and hard skills of special interest. Abstract

Abstract: In order to develop information technology, the national education system must be improved, and Pondok Pesantren is no exception. Since the ratification of Islamic Boarding School Law there have been at least four key fields, including the eight aspects of digital-age literacy, core literacy, science, information, visuals, technology, multicultural awareness and global knowledge. The tool used in the present study was to develop the teaching abilities of Islamic boarding school students and to write them through a bibliography approach and approach to education through Kelvin Seifert's digital literacy techniques, opportunities and challenges. These findings show the students' ability to learn and comprehend it again with good analytics can be enhanced with the approach to classical book studies with critical thinking skills. Keywords: Ability; Digital-Age Literacy; Islamic education; boarding school; Abstrak: Untuk mengembangkan teknologi informasi, sistem pendidikan nasional harus diperbaiki, tidak terkecuali Pondok Pesantren. Sejak disahkannya UU Pesantren setidaknya terdapat empat bidang utama, yaitu delapan aspek literasi era digital, literasi inti, sains, informasi, visual, teknologi, kesadaran multikultural, dan pengetahuan global. Alat yang digunakan dalam penelitian ini adalah untuk mengembangkan kemampuan mengajar siswa pesantren dan menuliskannya melalui pendekatan bibliografi dan pendekatan pendidikan melalui teknik literasi digital, peluang dan tantangan Kelvin Seifert. Temuan ini menunjukkan kemampuan siswa untuk belajar dan memahaminya kembali dengan analitik yang baik dapat ditingkatkan dengan pendekatan studi buku klasik dengan kemampuan berpikir kritis. Abstract

ABSTRAK Penelitian ini ingin mereview tentang penggunaan dan fungsi obligasi serta surat berharga berjangka dalam tinjauan hukum ekonomi Syariah. Peneliti melihat ada celah yang datang dari praktik ini dalam penggunaan Akad yang dapat digunakan dalam penerbitan obligasi syariah meliputi mudharabah, musyarakah, salam, istisna, dan ijarah. Metode yang digunakan dalam penelitian ini kajian pustaka terhadap review artikel tentang obligasi dan surat berharga berjangka. Penelitian ini membuktikan bahwa Pendapatan (hasil) yang diperoleh pemegang obligasi syariah sesuai akad yang digunakan. Pemindahan kepemilikan obligasi syariah juga mengikuti akad-akad yang digunakan. Perbedaan obligasi syariah dan obligasi konvensional adalah penggunaan konsep imbalan dan bagi hasil sebagai pengganti bunga. Kata kunci: Obligsi,syariah, surat berharga, hukum, ekonomi ABSTRACT This study wants to review the use and function of bonds in a review of Islamic economic law. we see that there is a gap that comes from this practice in the use of Akad that can be used in the issuance of Islamic bonds including mudharabah, musharakah, salam, istisna, and ijarah. The method used in this study is a literature review of review articles on bonds and futures securities. This study proves that the income (yield) obtained by Islamic bondholders is by the contract used. The transfer of ownership of Islamic bonds also follows the contracts used. The difference between Islamic bonds and conventional bonds is the use of the concept of reward and profit sharing instead of interest. Keywords: bonds, sharia, securities, law, economy

Abstract

Abstrak:Tulisan ini akan mengungkap bahwa kemampuan membaca kitab kuning santri di Pondok Pesantren Al-Falah Banjarbaru menggunakan pendekatan yang berbeda dengan Teknik lainnya. Kemampuan membaca ini dilatih secara kontiniu dan berbasis pada konteks masyarakat menarik untuk diteliti sebagai ciri khas pondok pesantren. Meskipun banyak yang sudah membahas kemampuan membaca, tapi ciri khas membaca kitabkuning berbahasa tanpa baris/harakat menjadi penting dan layak untuk diteliti. Teori yang digunakan adalah teori behaviorisme sebagai dasar dalam mengungkap kemampuan yang didapat. Metode yang digunakan dalam penelitian ini adalah metode deskriptif analytic kualitatif berupa studi kasus di Pondok Pesantren Al-Falah di Banjarbaru, Kalimantan Selatan, Indonesia. Teknik pengumpulan data dalam penelitian ini adalah observasi partisipan terhadap system Pendidikan dan pembelajaran di kelas. Temuan dari penelitian ini adalah system pengulangan dalam pembelajaran kitab kuning menjadi bagian termudah dalam mempercepat pemahaman santri dalam membaca kitabkuning secara konseptual.Kata kunci: Konsep, literasi, kitab kuning, Pesantren Abstract:The Al-Falah Islamic Boarding School in Banjarbaru employs a unique method for teaching its pupils how to read the Kitab Kuning (arabic book) that will be demonstrated in this essay. It's fascinating to research how Islamic boarding schools have this reading proficiency that is regularly practiced and dependent on the community environment. Though reading comprehension has been covered extensively, study should also focus on the peculiarities of reading kitab kunings in harakat, a language without lines. The theory used is the theory of behaviorism as the basis for revealing the abilities that students get in reading Kitab. The Al-Falah Islamic Boarding School in Banjarbaru, South Kalimantan, Indonesia served as the site for this qualitative descriptive analytic case study that served as the research methodology. The data collection technique in this study is participant observation of the education and learning system in the classroom. The repetition approach for learning the kitab kuning is the portion that makes it simplest for pupils to comprehend how to read it conceptually, according to the study's findings.Key words: Concept, literacy, kitab kuning, Islamic boarding school

Abstract

This study seeks to reveal that sirri marriages, which are usually secret, in the Banjar community are carried out openly and are carried out by walimah 'ursy (wedding ceremonies). In contrast to other studies, most of them only discuss the law of unregistered marriage and its legality in Indonesia. This study tends to pay more attention to aspects of habits and shifts in the meaning of the sirri marriage. The method used in this study is empirical with an ethnographic-phenomenological approach to the celebration of sirri marriages in the Banjar community, South Kalimantan. The results of this study prove that the legality of sirri marriages is illegal in Indonesia State because it is not recorded at the Office of Religious Affairs. However, aspects of the habit of unregistered marriages and holding wedding celebrations in the Banjar community,  make sirri marriages "as if" they have legal rights in society based on social norms.

Abstract

Abstrak Penelitian ini membahas tentang penggunaan e-learning ketika terjadinya pandemic covid-19 terhadap mahasiswa di beberapa perguruan tinggi di Kalimantan Selatan, Indonesia. Meskipun ada beberapa yang meneliti tentang e-learning pada masa pandemi, tapi peneliti lebih menekankan pada efektifitas daring dibandingkan ketika berada di ruang kelas. Penelitian ini merupakan penelitian lapangan yang bersifat kuantitatif dengan pendekatan fenomenologi terhadap pembelajaran yang bersifat daring dampaknya terhadap kesiapan peserta didik. Penelitian ini membuktikan bahwa 80% mahasiswa belum siap mengikuti pembelajaran daring secara total, kecuali jika menggunakan metode blended learning. Sebanyak 60% mahasiswa berpendapat bahwa finansial merupakan bagian terpenting dalam pembelajaran daring berdasarkan kuota, sementara 25% responden tidak mempermasalahkan ekonomi. Dengan pendapatan per-kapita yang harus tinggi menyebabkan pola yang digunakan hanya smartphone saja. Hasil yang didapat juga bertolak bekalang dengan tujuan e-learning, sehingga pembelajaran kurang efektif. Hal ini disebabkan ketidaksiapan para mahasiswa dalam menghadapi new normal dalam pembelajaran secara daring. Kata kunci:, Pendidikan; Pemecahan Masalah; Pengukuran; Pembelajaran; Abstract This research explores the use of E-learning in many universities in Southern Kalimantan in Indonesia in the Covid-19 pandemic against students. Although some researchers study e-learning during a pandemic, researchers concentrate more on the quality of e-learning than in a classroom. This study is a phenomenologically focused quantitative field research which has an impact on the students' preparation. This study shows that 80 % of students are not prepared to completely engage in online learning unless they use the combined form of learning. Sixty percent of students agree that finance is the key part of online quota-based learning, while 25 percent of students do not care about the economy. This results in a trend which is only used by smartphones with a high per capita income. The findings also run counter to the goal of e-learning, which makes learning less efficient. This is attributable to students being unprepared to face the latest online learning standard. Keywords: Education; Problem Solving; Measurement; Learning;
