Abstract

The study aims to find out and analyse what qualifications for criminal acts of Macar and to know and analyze when the perpetrators of the matter convey public opinion can be categorized as Makar crime. The methods of study used are normative juridical, based on the principles of the law, the rules of the law and the legislation or books/literature relating to Makar action. Normative legal research is a study that examines prevailing norms including laws that have relevance to the problem as the source of legal material. Based on the results of the study can be concluded that communicating in public is permissible because it is part of human rights, namely the right of freedom to convey opinion as stipulated in article 28 CONSTITUTION of the Republic of Indonesia year 1945. Expressed opinion may be categorized as a criminal offence if it meets the provisions of article 88 of KUHAP. In article 88 the criminal CODE stated that there is an evil agreement, if two or more people have agreed to commit the crime, continued in article 88 of the bus with the overthrow of the government is negating or changing the form of unauthorized government under the Constitution. Therefore, presenting opinions in public can be categorized as Makar action if it is evident that in the implementation there is an indication or that has an intention to overthrow the government, with the intention to kill, or seize independence, or negate the ability of the President or vice President ruled.

Abstract

One of the main pillars of democratic governance is the implementation of general elections (Elections), the Election Organization involves at least 3 (three) important actors who interact with each other, namely Election Contestants, Election organizers and citizens who hold the right to vote (Voters). In its interactive relationship in the stages of the Election process, there can be a hormonal relationship or a conflict relationship. The enactment of Law number 7 of 2017 concerning General Elections as the basis for holding simultaneous Elections in 2019. Giving authority to Bawaslu, Provincial Bawaslu and Regency / City Bawaslu in resolving disputes in the Election process, due to the issuance of KPU, provincial KPU or regency / city KPU decisions. The Bawaslu Decision is final and binding except relating to 3 (three) matters, namely verification of the Election Contesting political parties, determination of the permanent candidate list for DPR, DPD, provincial and regency / city DPRD candidates and Candidate Pairs. The Election Supervisory Body's decision in resolving election disputes is almost the same as other judicial institutions, this is seen from the character of the Election Supervisory Body's final and binding decision, the substance of the decision is almost the same as the judiciary and procedural aspects of the electoral process dispute through the trial mechanism. Seeing the legal construction of judicial authority, Bawaslu is not a judicial body, because it does not belong to the judiciary under the Supreme Court, the Constitutional Court and is not included in the special court. The authority of the PTUN in dispute over the election process can only be done, if administrative efforts to Bawaslu have been made and the decision is final and binding and no other legal efforts can be made. However, the Election Law does not mention sanctions for those who do not follow up on PTUN decisions, this can be seen in the case of Oesman Sapta Odang, the KPU finally chose to follow the Court's Decision more.

Abstract

This research is a legal research (legal research). In this study, the approach used is the statutory approach, the case approach, and the conceptual approach. The legislative approach because the legal material used is the 1945 Constitution of the Republic of Indonesia, Law No. 10 of 2008 concerning General Elections for Members of the DPR, DPD, and DPRD, and Law no. 8 of 2012 concerning the Election of Members of DPR, DPD and DPRD. Case approach because the writer will refer to MKRI decisions related to the parliamentary threshold. The conceptual approach in this study because it refers to the views of scholars and legal doctrines. These three approaches, the author uses to give an exact position on how the principles of democracy should be used as guidelines related to the implementation of parliamentary training. The provisions of the parliamentary threshold in the Legislative Election Law are aimed at simplifying political parties. However, PT caused a serious consequence to thwart candidates who had fulfilled the BPP to sit in parliament. This condition is contrary to the principle of democracy in which one of its elements is the protection of minority representation. A near perfect representation will be realized when using a BPP benchmark and accompanied by a fractional threshold.

Abstract

Guna memberikan kepastian, keadilan dan tidak dibedakan dari tujuan hukum maka dilakukan penelitian terhadap pemilik kendaraaan/konsumen yang kendaran miliknya hilang dengan meminta tanggunggugat pemerintah provinsi yang menarik pajak kendaraan atau pemerintah kabupaten/kota selaku menarik retribusi parkir dan pajak parkir terkait adanya kehilangan kendaraan bermotor. Penelitian ini menggunakan kajian normatif dengan mengelola data-data dari aturan-aturan yang berlaku serta buku dari para ahli yang banyak digunakan sebagai bahan yang berhubungan dengan penelitian yang akan dibahas dalam penelitian ini. Kebaruan apa saja yang akan bicarakan didalam penelitian ini adalah mengenai tanggunggugat pemerintah daerah terhadap kehilangan kendaraan bermotor dilahan parkir yang di kelolanya sebagaimana disebutkan didalam UU No. 30 Tahun 2014 tentang Administrasi Negara yang memberikan penjelasan bahwa pemberian delegasi dari pejabat yang lebih tinggi kepada pejabat yang lebih rendah memiliki konsekuensi tanggungjawab dan juga tangguggugat.
