Abstract

In the last decade, the occurrences of natural disasters in ASEAN (Association South East Nations) regions have intensified. ASEAN was prone natural disasters such as earthquakes and tsunamis which frequently hit the region and as we know natural disasters can happen anytime. In a disaster management process, an understanding of law especially in the context of human rights protection is crucially needed, including in the prior disaster phases, in the emergency-disaster phase, and in the after-disaster phase. If such elements are excluded, it may postpone the implementation of humanitarian aid program and may even be a threat to the victims’ rights. This situation is more concretely illustrated in the after disaster phase, where law is needed to protect the vulnerable societies, namely in handling the problem of illegal adoption of an orphan child, child and women trafficking, and violation to marginal groups and discrimination in humanitarian aid distribution. The understanding human rights law in disaster situation will be tested in the field, as it often occurs that the law is not compatible with the situation, or that it is not complete or contrary to the system of law, or the lack of understanding regarding the law. Human rights are the basic rights which must be conferred to everyone. The international law and human rights posted the obligation to the state to protect, respect, and fulfill those rights without discrimination. ASEAN as a Regional International Organization has had the ASEAN Agreement on Disaster Management and Emergency Response and also The ASEAN Coordination Center for Humanitarian in related with disaster management.

Abstract

Provinsi DKI Jakarta merupakan ibu kota negara Indonesia dan juga pusat kegiatan penting lainnya di Indonesia. Akan tetapi di sisi lain, Provinsi DKI Jakarta termasuk ke dalam wilayah yang rawan bencana alam. Setiap tahun terutama pada saat musim penghujan, DKI Jakarta selalu dilanda banjir. Pada tahun 2021, DKI Jakarta dihadapkan pada persoalan penanggulangan banjir di tengah pandemi Covid-19. Tujuan penelitian ini untuk menganalisis tentang kesiapan Pemerintah DKI Jakarta dalam melakukan mitigasi banjir pada saat pandemi Covid-19. Metode penelitian yang digunakan adalah penelitian yuridis normatif yaitu penelitian yang mengutamakan data sekunder sebagai data utama. Hasil penelitian menunjukkan bahwa Pemerintah DKI Jakarta telah mengeluarkan Instruksi Gubernur Nomor 58 tahun 2020 tentang Kesiapsiagaan dan Antisipasi Ancaman Bencana Banjir dan Angin Kencang pada Musim Hujan di Masa Pandemi Covid-19. InGub ini menjadi pedoman hukum bagi pemerintah DKI Jakarta untuk melakukan mitigasi banjir pada saat pandemi Covid-19. Kebijakan tersebut membuahkan hasil yaitu dampak kerugian banjir pada tahun 2021 (pada saat pandemi Covid-19) di DKI Jakarta lebih rendah dibandingkan dengan banjir pada tahun 2020. Meskipun demikian di dalam praktik masih terjadi kegagapan pemerintah dalam penanggulangan banjir pada saat pandemi Covid-19. Terbukti dengan belum siapnya aturan terkait pengungsian pada saat pandemi Covid-19 dan ditemukannya kasus positif Covid-19 dari klaster pengungsi pada saat banjir di Jakarta pada tahun 2021. Hasil penelitian ini bermanfaat bagi pemerintah pusat dan pemerintah daerah dalam membuat kebijakan penanggulangan bencana banjir pada saat pandemi Covid-19.

Abstract

As one of the countries which is ratifying the 1951 Refugeee Convention and the 1967 Protocol, Australia has an obligation to protect refugees and guarantee their rights as stated in the provisions. With the issuance of the Pacific Solution Policy by the Australian Government to restrict refugees who come to Australia, Australia has reneged on international treaties on the protection of refugees that have been ratified. Based on the results of normative juridical research which is used in this paper, it can be seen that the state sovereignty principle which is used as the legal basis for implementing the policy cannot necessarily erase the obligations that have been imposed on it, especially with the development of the current understanding of the state sovereignty principle that links human rights protection. In addition, the attachment to international agreements that have been agreed based on the principle of Pacta Sunt Servanda becomes the basis for strengthening legitimacy that the Australian Government can be held responsibility in connection with the implementation of the Pacific Solution Policy in the handling of refugees in Australia.

Abstract

Since entry into force of the ASEAN Charter in 2008, ASEAN has moved from a loose organization to a rule-based one. The ASEAN Secretary General has the important position in related to conduct the role of ASEAN. The ASEAN Secretary General has the privileges and immunity rights. These rights are based on the functional necessity principle and ruled in the ASEAN Charter and ASEAN Treaty on the privileges and immunity right.Keywords: Functional Necessity Principle, the Privileges and Immunity Rights, the ASEAN Secretary General.

Abstract

Since the flow of goods and services begins to cross national borders, threats to human security do not originate solely from war. The era of traditional security has begun to shift towards non-traditional security or human security. In this concept, threats to security are directed directly at humans such as natural disasters, epidemics, drugs and human trafficking, and terrorism. Southeast Asia is the region most vulnerable to natural disasters. Relations between countries in this region are under the auspices of ASEAN. ASEAN Way is an ASEAN mechanism based on the principle of state sovereignty and non-intervention. ASEAN Way and Human Security are two different concepts. The ASEAN mechanism cannot be applied absolutely to overcome natural disasters that are massive, cross-border and occur in areas of armed conflict in Southeast Asia. In this case, it is necessary to broaden understanding of the nature of the principle of state sovereignty and non-intervention.Keywords: ASEAN Mechanism, Human Security, Southeast Asia

Abstract

Climate change is a serious problem that threatens humanity in the world, and this can be categorized as a non-traditional security problem known as human security. Climate change in the world is marked by the increase in the temperature of the earth's air and rising sea levels due to the melting of ice in the polar regions. This condition will cause disasters both natural disasters such as drought and forest fires, as well as non-natural disasters such as conflicts and epidemics, which will ultimately threaten world peace and security. In January 2019, Indonesia was officially elected as a non-permanent member of the UN Security Council. The election of Indonesia is evidence of the confidence of the international community in Indonesia's diplomatic capabilities. Indonesia will carry out its role as a non-permanent member of the UN Security Council for two years, from 1 January 2019 to 31 December 2020. With its position as a non-permanent member of the UN Security Council, Indonesia is expected to be actively involved in efforts to tackle climate change. Based on this, in this paper, the author will raise the topic of "The Legal Capacity of Indonesia as a Non-Permanent Member of the UN Security Council in Handling Global Climate Change Issues”.

Abstract

State has the main responsibility in any disaster management process. The Sendai Framework for Disaster Risk Reduction (SFDR) is an international disaster management agreement in a country which Indonesia also ratifies. The research objective is to determine how the reliability test of the SFDRR in the rehabilitation of the Tanjung Lesung Special Economic Zone (KEK) after the 2018 tsunami. This research is an empirical juridical study, primary data as the main data obtained from field research and interviews, as a complement, a literature study was conducted to obtain secondary data. The results of the study concluded that rehabilitation efforts based on the SFDRR had been carried out by the government but there were no direct coordination and communication between the government, KEK managers, local communities, and tourists.

Abstract

Apart from being intended to establish friendly relations, diplomatic relations are also carried out to improve cooperative relations in various fields. The objectives of this study include: 1) to find out whether the diplomatic representatives of Afghanistan in Indonesia are also responsible for handling Afghan refugees in Indonesia based on the 1961 Vienna Convention, 2) to find out how Indonesia's role as a receiving country in efforts to handle refugees from Afghanistan in Indonesia is based on the Convention. Wina 1961. This legal research uses the normative juridical legal method. Secondary data obtained through literature study is used as the main data. The findings of this study indicate that Afghan diplomatic representatives have no responsibility towards refugees from Afghanistan because they have abandoned their citizenship when they left their country. As a receiving country based on the 1961 Vienna Convention, Indonesia has played a role in handling refugees from Afghanistan by issuing Presidential Regulation no. 125/2016 concerning the Handling of Refugees from Abroad which is used as a normative and coordinative basis for Ministries / Agencies and in handling refugees from abroad by involving the role of the Regional Government.

Abstract

The threat of natural disasters in Indonesia can occur at any time and has caused suffering for humanity. The tourism industry also feels the impact and consequences of natural disasters. Tsunami on the coast of Banten at the end of 2018 has caused economic losses of up to hundreds of billions in the tourism sector. Mitigation of natural disasters, especially in the tourism industry, is still lacking the attention of the government. In the disaster management system, the state is the main actor who has full responsibility for dealing with the effects of natural disasters. The Government of Indonesia in 2005 ratified the 2005-2015 Hyogo Framework for Action as the government's guidelines in dealing with natural disasters, especially in the field of natural disaster mitigation. This study examines the implementation of HFA concerning natural disaster mitigation in the Special Economic Zone of Tanjung Lesung-Banten, and Cikadu Tourism Village Community. Socio-legal research is used as a research method and uses qualitative data analysis that is analytical descriptive and emphasizes primary data as the main data. This data was obtained by interview and observation. As for supporting primary data, library research is conducted. Based on the results of the study it can be seen that the Government of Indonesia has implemented the HFA by making Law No. 24 of 2007 concerning Disaster Management, but in practice law enforcement has not been felt by Banten coastal communities other than that there is no habit or cultural awareness of disaster response in the community.
