Abstract

The payment system in Indonesia has undergone significant changes to date. Starting from the barter system to the existence of an electronic payment system. This change is caused by the development of technology, which has an impact on changing people's lifestyles. The payment system has been known to the public since 2014 when Bank Indonesia issued the National Non-Cash Movement (GNNT) policy. This policy aims to create a cashless society eco-system while at the same time introducing the advantages of electronic payments to the public. Electronic payments are considered safer, more efficient, and easier to track. However, electronic payments are also inseparable from their shortcomings. The electronic payment system, which is relatively new in Indonesia, will face several problems, especially with the legal system. Until now, there has been no law specifically regulating electronic payment systems, specifically E-wallet. This legal vacuum will cause problems both in terms of security and legal protection for users. This study aims to find out the problems that will arise from the E-wallet and provide solutions to the problems raised from a legal perspective. The research method used is normative juridical, using a conceptual approach and a statutory approach to review E-wallets in Indonesia. The results of this study indicate that several problems arise from electronic payments. Therefore, regulations are needed to protect user security, oversee the smooth implementation of E-wallet and maintain Indonesia's economic stability.

Abstract

This study aims to examine the elements that must be met by white-collar crime and the factors that cause white-collar crime, as well as preventive measures that can be taken to prevent the occurrence of white-collar crime. The research method used in conducting this research is a normative juridical research method using a conceptual approach to study white-collar crime in Indonesia. The results of this study indicate that there are elements that must be met to be categorized as a white-collar crime and there are various factors that cause white-collar crime in Indonesia. Therefore, several preventive measures are needed to prevent and hinder the occurrence of white-collar crimes in Indonesia to maintain the Indonesian economy and improve the lives of the Indonesian people.

Abstract

Pasal multitafsir atau kerap dikenal sebagai pasal karet dalam Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Teknologi Elektronik merupakan permasalahan yang sudah lama berada di Indonesia. Pasal karet tersebut tentunya menunjukan bahwa terdapat pasal yang tidak tercerminkan dalam asas pembentukan perundang-undangan yang seharusnya dianut secara mutlak dalam setiap pembentukan peraturan perundang-undangan. Dalam penelitian ini, Peneliti akan membahas mengenai pasal-pasal yang dianggap multitafsir dalam undang-undang tersebut beserta dampak-dampak yang akan diakibatkan karena pasal karet tersebut. Penelitian ini bertujuan untuk memberikan solusi untuk pemecahan masalah yang timbul akibat pasal karet yang terkandung dalam undang-undang informasi dan transaksi elektronik. Hasil penelitian ini menunjukan bahwa pasal karet yang terkandung dalam Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Teknologi Elektronik memiliki dampak buruk terhadap perkembangan Indonesia sehingga untuk turut ijut serta dalam mewujudkan Indonesia yang lebih baik maka timbul sebuah gagasan yang akan dituangkan dalam penelitian ini.

Abstract

The enactment of Law No. 11 of 2020 resulted in revisions to Indonesia's labor rules. The employment agreement is one of the elements that has altered. An employment agreement is a contract between a worker and his or her employer that specifies the working conditions, rights, and duties of the parties. The employment agreement signed between the employee and the employer attempts to ensure both parties' rights and duties in order to achieve a healthy working relationship. According to the findings of interviews and observations conducted with PT. Rimba Rezeki Makmur, awareness of the value of work agreements in a firm is inadequate. As a result, legal counseling is required, as well as the design and writing of an employment agreements for a certain period of time and an indefinite employment agreement for PT. Rimba Rezeki Makmur in order to protect the rights and duties of employees and employers. This Student Creativity Program activity is carried out in phases and in a coherent way, namely preparation/pre-implementation, implementation, and assessment. The success of this community service activity is measured by increasing PT. Rimba Rezeki Makmur's understanding of the importance of employment agreements and the establishment of employment agreements that can be used by PT. Rimba Rezeki Makmur in the future to guarantee and protect the rights and obligations of workers and employers.
