Abstract

Indonesia telah meratifikasi Washington Convention 1965 melalui Undang-Undang No. 5 Tahun 1968. Pasal 25 dari konvensi yang diratifikasi mengatur tentang yurisdiksi lembaga arbitrase International Centre for The Settlement of Investment Dispute (ICSID), di antaranya adalah untuk menyelesaikan sengketa penanaman modal antara para negara peserta (dan warga negara dari negara peserta). Beberapa Bilateral Investment Treaties (BIT) yang disepakati menunjuk lembaga arbitrase ICSID sebagai lembaga penyelesaian sengketa apabila terjadi permasalahan. Namun demikian, pada tahun 2012, pemerintah mengeluarkan Keputusan Presiden No. 31 Tahun 2012 tentang Perselisihan yang dikecualikan dari yurisdiksi ICSID. Keputusan tersebut mengecualikan beberapa sengketa dari kewenangan ICSID. Sebagai hasil penelitian menggunakan metode yuridis-normatif, artikel ini berusaha untuk menjawab pertanyaan mengenai apakah tindakan hukum yang dilakukan oleh Indonesia untuk mengecualikan jurisdiksi ICSID sah berdasarkan hukum internasional yang berlaku. Dalam menjawab pertanyaan tersebut, selain harus dilakukan penelusuran hukum yang utuh menyeluruh, juga diperlukan pembahasan berbagai kasus yang relevan.

Abstract

The intrusive character inherent in international trade agreements makes the particular form of the treaty unique compared to other treaties. The trade agreements' intrusiveness means the treaty impacts individual rights relatively more than other treaties on its implementation. Confirming such a particular character, the Indonesian Constitutional Court, via its Decision No. 13/PUU-XVI/2018, provides additional criteria for the treaty ratified through an act, in addition to the general forms of treaties. This study comprehensively discusses the consistency of the instrument form and the clarity of the reference regulations related to the procedure for ratifying the international trade agreement in Indonesia after the ruling of the 2018 Constitutional Court Decision. This study uses a normative juridical approach by making a library of data covering principles, laws, and regulations or legal theories relevant to research as the main material. The study shows that Constitutional Court Decision No. 13/PUU-XVI/2018 has allowed the international trade agreement to be ratified consistently using a legislative act replacing the past practice of using a presidential act. Moreover, the provisions on international trade agreements ratification under Indonesian trade law and Indonesian treaty law must be enforced using "lex specialis derogat lex generalis" principle. Although they share the same norms after the Constitutional Court's Decision 13/2018, specific provisions under the trade law prevail over the general provisions of the Indonesian treaty law.

Abstract

ABSTRACTThe emerging practice of third-party funding provides an answer for the party whose rights has been breached but are financially constrained to bring forth its claims to an investment arbitration. However, the practice of third-party funding does not always run smoothly according to its optimistic expectations and noble goals. The lack of concrete regulations regarding its practice imposes several issues concerning its involvement in investment arbitration. By using normative legal and case analysis approach, this paper analyses legal doctrines and principles in investment arbitration law and their implementations in the community through comparative cases. The research uses a descriptive analytical method which describes the applicable legal regulations correlated with legal theories and their implementation in the research object. The research was conducted by finding secondary data using primary, secondary, and tertiary legal materials. The results of the research show that the regulations regarding the practice of third-party funding in addition to provide access to justice for financially constrained parties is also required to provide answers to concerns raised by its involvement in investment arbitration. The action that can be done by the Indonesian government to solve the aforementioned problem is to issue a specific international arbitration law which includes the regulations regarding the practice of third-party funding.Keywords: Third-Party Funding in International Investment Arbitration, Indonesian Arbitration Law, Model Implementation of Indonesian International Arbitration Law.
