Abstract

Tanggung jawab pelaku usaha kepada konsumen diatur oleh Norma Pasal 19 UUPK Tahun 1999 tentang Tanggung Jawab Pelaku Usaha jo Pasal 3 Permenkes Nomor 43 Tahun 2010 Tentang Hygiene Sanitasi Depot Air Minum. Namun dalam praktiknya di Kota Banda Aceh ditemukan pelaku usaha depot air minum isi ulang belum memenuhi tanggung jawabnya dalam menerapkan kualitas standar mutu untuk melindungi hak konsumen. Tujuan penulisan skripsi ini untuk mengetahui dan menjelaskan tanggung jawab pelaku usaha depot air minum dalam penerapan kualitas standar mutu air minum isi ulang telah dilaksanakan oleh pelaku usaha depot air minum. Bentuk kerugian konsumen akibat pelaku usaha yang tidak menerapkan kualitas standar mutu air minum isi ulang, dan upaya yang telah dilakukan oleh Dinas Kesehatan Kota Banda Aceh dalam melindungi hak-hak konsumen berkaitan dengan air minum isi ulang. Penelitian ini bersifat yuridis normatif, yaitu suatu pendekatan yang menggunakan konsep legal positif dengan cara mengkaji penerapan kaidah atau norma dalam hukum positif. Data penelitian yuridis normatif berupa bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier didukung oleh data primer di lapangan sebagai ilmu bantu. Berdasarkan hasil penelitian diketahui bahwa tanggung jawab pelaku usaha depot air minum isi ulang belum memenuhi persyaratan hygiene sanitasi air minum di antaranya ada beberapa perlengkapan dan peralatan yang digunakan seperti kran pengisian air minum, kran pengisian galon sudah berkarat, tendon air minum sering terbuka, lantai hanya dilapisi karpet sehingga tidak kedap air, bangunan terbuat dari kayu sehingga tidak mudah untuk dibersihkan. Bentuk kerugian yang diderita konsumen karena tidak adanya penerapan kualitas standar mutu air minum isi ulang mengalami keracunan bakteri sehingga menyebabkan diare, gejala tifus, pusing. Upaya yang telah dilakukan oleh Dinas Kesehatan Kota Banda Aceh seperti melakukan pengawasan, sosialisasi, dan pembinaan, namun pengawasan yang dilakukan belum maksimal sebagaimana dalam peraturan perundang-undangan seperti belum memberikan sanksi terhadap pelaku usaha yang belum memenuhi kualitas standar mutu, belum adanya data yang terpilah, belum adanya kerja sama yang bersinergi dengan Yayasan Perlindungan Konsumen Aceh  (YAPKA), sehingga masih ditemukan pelaku usaha yang belum menerapkan kualitas standar mutu. Diharapkan kepada pelaku usaha depot air minum isi ulang di Kota Banda Aceh menyadari tanggung jawabnya karena akan menimbulkan resiko bagi konsumennya dan pelanggaran terhadap hal tersebut dikenakan sanksi dalam aturan yang berlaku, oleh karena itu perlu mengikuti berbagai bentuk pelatihan, sosialisasi, dan pembinaan. Disarankan kepada konsumen agar lebih cermat dan berhati-hati untuk memilih depot air minum isi ulang. Diharapkan kepada Dinas Kesehatan Kota Banda Aceh adanya data terpilah mengenai pelaku usaha yang telah dan yang belum menerapkan kualitas standar mutu air minum isi ulang, berkoordinasi dan bersinergi kepada YAPKA, memberikan sanksi administratif seperti larangan distribusi air minum isi ulang kepada depot yang tidak menerapkan kualitas standar mutu. The responsibility of businesses to consumers is governed by the norms of Article 19 of the Consumer Protection Law of 1999 on the responsibility of business operators in conjunction with Article 3 Health Ministers Regulation No. 43 Year 2010 on hygiene sanitation drinking water refill. However, in practice in Banda Aceh found businesses refill drinking water has not fulfilled its responsibility in applying quality standards to protect consumer rights. The purpose of this script to investigate and clarify the responsibility of business operators refill drinking water quality standards in the application of quality drinking water refills has been implemented by businesses refill drinking water. Forms of consumer losses due to businesses that do not implement quality standards of drinking water quality refill, and the efforts made by the City Health Office Banda Aceh in protecting consumer rights related to drinking water refills. This study is normative, ie an approach that uses positive legal concept by reviewing the application of the rules or norms in the positive law. Normative research data in the form of primary legal materials, secondary law, and tertiary legal materials supported by primary data in the field as an auxiliary science. Based on the survey results revealed that the responsibility of business operators refill drinking water do not meet the requirements of hygiene sanitation of drinking water in between there are some supplies and equipment used such as faucets filling drinking water, faucet filling gallon rusty, tendon drinking water is often open, the floor is just lined carpet so it is not waterproof, the building is made of wood so it is not easy to be cleaned. Form of losses suffered by consumers due to lack of implementation of quality standards of drinking water quality refill poisoning bacteria causing diarrhea, typhoid symptoms, dizziness. Efforts have been made by the Health Department of Banda Aceh as supervision, socialization, and coaching, but the supervision is done not maximized as in the legislation as not to impose sanctions against businesses that do not meet the quality standards of quality, the lack of disaggregated data, the lack of cooperation in synergy with Yayasan Perlindungan Konsumen Aceh  (YAPKA), so still found businesses that have yet to implement the quality standards of quality. Expected to businesses refill drinking water in Banda Aceh aware of his responsibility because it would pose a risk to consumers and violation of the terms of sanctions in the rules, therefore, need to participate in various forms of training, socialization, and coaching. It is suggested to consumers to be more careful and cautious to choose depot refill drinking water. City Health Department is expected to Banda Aceh their disaggregated data about businesses that have yet to adopt the quality and standards of quality of drinking water refill, coordinate and synergize to YAPKA, to impose administrative sanctions such as a ban on the distribution of drinking water refill to refill drinking water entrepreneurs who do not implement the quality standards of quality.
