Abstract

Decentralization is the delegation of authority to make decisions and policies to the manager or the people at the lower levels of an organization in the area of autonomy decisions are trimmed, just at the local level that save energy and money. In the concept of decentralization of the central government still has a role as a conduit of the budget through the budget deconcentration will be up to the province. Logically deconcentration will decrease along with the increasing decentralization of funds. In practical terms it is manifested in its merger phenomenon regional offices ministries to local governments. Enforced vertical pattern of deconcentration is embodied in the pattern of deconcentration in the provincial government is still funded by the center. Based on this reality, the criteria for transfer of funds from the central government to the regions is important.

Abstract

Abstrak:Tujuan dari penelitan ini yaitu untuk mengetahui bagaimana mekanisme pengisian posisi kepala daerah secara demokrasi menurut prinsip demokrasi pancasila setelah amandemen UUD 1945. Metode penelitian yang digunakan dalam penelitian ini yaitu menggunakan metode normative dengan Pendekatan normatif meliputi asas hukum, sistem hukum, sinkronisasi hukum, dan sejarah hukum. Hasil dari penelitian menunjukkan bahwa adanya perbedaan dengan Sistem Pilkada Langsung yang berlangsung pada tahun 2005 dengan metode pemilihan umum yang demokratis berdasarkan prinsip langsung, umum, bebas, rahasia, jujur dan adil, namun ditemukan bahwa sistem ini dapat melemahkan posisi DPRD dan menyebabkan politik yang lebih besar. Dapat dipahami bahwa mekanisme pengisian jabatan Kepala Daerah mengikuti kondisi kebutuhan masyarakat di suatu daerah dan perlu diperhatikan bahwa konstitusi yang diterapkan pada setiap periode mempengaruhi karakter undang-undang yang melaksanakan dan mengatur pemerintahan daerah yang berlandaskan Pancasila. Kerangka dari gagasan Demokrasi Pancasila, berarti bahwa demokrasi bukanlah tiruan dari demokrasi liberal atau lainnya, tetapi lahir secara alami dari nilai-nilai luhur budaya dan suku bangsa Indonesia itu sendiri, dan ditandai dengan sistem organisasi negara yang dijalankan. Baik sistem Pilkada secara langsung maupun tidak langsung tetap sesuai dengan nilai-nilai Demokrasi Pancasila, karena Pancasila sendiri merupakan ideologi terbuka yang artinya hanya mengatur hal-hal yang pokok saja sedangkan pelaksanaannya disesuaikan dengan kondisi sosial politik yang ada.Kata Kunci: Kepala Daerah, Demokrasi Pancasila, Amandemen   Abstract: The purpose of this study is to find out how the mechanism for filling the position of regional head in a democratic manner according to the principles of Pancasila democracy after the amendment of the 1945 Constitution. The research method used in this research is using a normative method with a normative approach covering legal principles, legal systems, legal synchronization, and history. law. The results of the study indicate that there is a difference with the Direct Pilkada System which took place in 2005 with a democratic general election method based on the principles of direct, general, free, secret, honest and fair, but it was found that this system can determine the position of the DPRD and cause political the greater one. It can be understood that filling the position of Regional Head follows the conditions of the needs of the community in an area and it should be noted that the constitution applied in each period has the character of the law that implements and regulates regional government based on Pancasila. From the idea of Pancasila Democracy, it means that democracy originates from liberal democracy or others, but is born naturally from the noble values of Indonesian culture and ethnicity itself, and is characterized by the state system that is run. Both the direct and indirect Pilkada system remain in accordance with the values of Pancasila Democracy, because Pancasila itself is an open ideology which means that it only regulates basic matters while its implementation is adjusted to the existing socio-political conditions.Keywords: Regional Head, Pancasila Democracy, Amendment

Abstract

Kesehatan adalah keadaan yang sehat, baik fisik dan mental maupun spiritual dan sosial, yang memungkinkan setiap orang dapat hidup produktif secara sosial dan ekonomis. Oleh karena itu dalam Negara Hukum Republik Indonesia, masalah kesehatan termasuk didalamnya kesehatan lingkungan serta keselamatan dan kesehatan kerja menjadi hal yang diatur dalam peraturan perundang-undangan. Kesehatan Lingkungan bertujuan untuk mewujudkan kualitas lingkungan yang sehat secara fisik, kimiawi, biologis, dan sosial untuk mencegah penyakit dan / atau gangguan kesehatan yang disebabkan oleh faktor lingkungan dan bahaya. Sementara perlindungan Keselamatan dan kesehatan kerja bagi pekerja merupakan langkah preventif agar tidak terjadi kecelakaan kerja dan penyakit yang berhubungan dengan pekerjaan. Oleh karena itu, keselamatan dan kesehatan kerja harus dimasukkan dalam kontrak kerja, karena keselamatan dan kesehatan kerja merupakan hak standar pekerja dan harus disediakan oleh perusahaan., sebagai wujud Negara hadir memberi perlindungan kepada warganya.---Health is a healthy condition, both physically and mentally as well as spiritually and socially, which enables everyone to live productively socially and economically. Therefore, in the constitutional state of the Republik of Indonesia, health issues including environmental health and safety and occupational health are things that are regulated in statutory regulations. Environmental health is an activity or a series of activities aimed at a healthy environmental quality from physical, chemical, biological, and social aspects in order to prevent disease and/or health problems caused by environmental risk factors. Meanwhile, the protection of occupational safety and health that is provided to workers is a preventive measure so that there are no occupational accidents and occupatinal diseases. Therefore, occupational safety and health are the normative right of workers that must be granted by companies, as a form of the state being present to provide protection to its citizens.

Abstract

Hubungan Pemerintah Pusat dengan Daerah dapat dirunut dari alinea ketiga dan keempat Pembukaan Undang-Undang Dasar Negara Republik Indonesia. Tujuan penelitian ini adalah untuk mengakselerasi pengembangan potensi nasional yang diarahkan bagi penguatan integrasi nasional, akselerasi pengembangan ekonomi dan meningkatkan kualitas pelayanan publik bagi masyarakat seluruh daerah di Indonesia. Metode yang digunakan dalam penelitian ini yaitu, metode kualitatif dan kuantitatif. Hasil penelitian ini yaitu Pro kontra kebijakan moratorium pemekaran daerah masih menjadi isu yang terus digulirkan hingga saat ini. Pemerintah masih belum akan mencabut moratorium tersebut. Kebijakan moratorium merupakan imbas dari masifnya pemekaran daerah yang terjadi di era reformasi sejak diberlakukannya UU Nomor 22 Tahun 1999 tentang Pemerintahan Daerah. Berdasarkan hasil penelitian dapat disimpulkan bahwa Dilihat dari hakikatnya Otonomi Daerah diberikan kepada rakyat sebagai satu kesatuan masyarakat hukum yang diberi kewenangan untuk mengatur dan mengurus sendiri Urusan Pemerintahan yang diberikan oleh Pemerintah Pusat kepada Daerah dan dalam pelaksanaannya dilakukan oleh kepala daerah dan DPRD dengan dibantu oleh Perangkat Daerah.

Abstract

Tujuan hukum Kesehatan pada intinya adalah menciptakan tatanan masyarakat yang tertib, menciptakan ketertiban dan keseimbangan. Dengan tercapainya ketertiban didalam masyarakat diharapkan kepentingan manusia akan terpenuhi dan terlindungi. Dengan demikian jelas terlihat bahwa tujuan hukum kesehatanpun tidak akan banyak menyimpang dari tujuan umum hukum. Hal ini dilihat dari bidang kesehatan sendiri yang mencakup aspek sosial dan kemasyarakatan dimana banyak kepentingan harus dapat diakomodir dengan baik. Pembangunan kesehatan bertujuan untuk meningkatkan kesadaran, kemauan, dan kemampuan hidup sehat bagi setiap orang agar terwujud derajat kesehatan masyarakat yang setinggi-tingginya, sebagai investasi bagi pembangunan sumber daya manusia yang produktif secara sosial dan ekonomis. Tenga kesehatan sering kali mengalami traumatis akan berhadapan dengan maslah hukum, untuk itu dipandang perlu mengetahui dan memahami ancaman hukum dibidang kesehatan.

Abstract

The General Election (Pemilu) is a democratic party held every 5 (five) years, the Election Supervisor (Bawaslu) has an important role in electoral process disputes that occur between election participants and election participants and election organizers, as a result of the stipulation of Decisions and/or The Official Report of the KPU which is considered detrimental to the rights of election participants. Bawaslu's role is to accept process disputes, mediate the parties, if in the mediation process no agreement is found, then the Election Bawaslu carries out adjudication, Bawaslu can also correct decisions from Provincial Bawaslu and/or Regency/City Bawaslu.

Abstract

The purpose of the issuance of this Government Regulation concerning Large-Scale Social Restrictions is to ensure that the Regional Government does not take individual steps, so that with the existence of this Government Regulation, steps handling of Covid 19 can be in line with the Central Government. For this reason, the author is interested in conducting research with the aim of finding out whether Pergub Number 88/2020 is the implementing regulation of the legislation. This study uses a normative juridical approach. In conducting the research, the writer uses the library research method to review a statutory regulation, which can be obtained from a literature research by using primary, secondary, and tersier legal materials. Based on the discussion of this research, it is concluded that the Governor's Regulation Number 88 of 2020 concerning the Implementation of Large-Scale Social Restrictions (PSBB) in Handling Corona Virus Disease 2019 (Covid-19) which was issued first before the regional regulations that were formed later needed to be updated in substance into a Regional Regulation and issued back to the new Governor Regulation. This step is taken to ensure the synchronization of the national legal system by means of vertical synchronization and horizontal synchronization. In Government Regulation No. 38 of 2007 which is a derivative of Law no. 32 of 2004 regulates the division of government affairs between the Government, Province, and Regency/City.

Abstract

The low graduation rate for the selection participants for the procurement of Government Employees with Work Agreements (PPPK) Technical Functional Positions for the 2022 Budget Year, the Government evaluates the results of the selection which in conclusion needs to give awards for dedication to participants with ex-THK-II and Non ASN status while still guaranteeing the quality of Employees Government with Employment Agreement. There is a Decree of the Minister of Administrative Reform and Bureaucratic Reform Number 571 of 2023 concerning Optimization of Filling the Need for Technical Functional Positions in the Procurement of Government Employees with Work Agreements for the 2022 Fiscal Year, only carried out for positions whose needs have not been met. However, it is very unfortunate that this optimization was carried out only for 2 elements, namely: ex THK-II participants; or Non ASN Participants. Kepmenpan-RB Concerning Optimization has limited participants who are not from Ex THK-II and Non ASN elements from contributing to Government. Apart from being discriminatory, the Kepmenpan-RB Regarding Optimization also cannot guarantee the quality of Government Employees with Work Agreements for Technical Functional Positions for the 2022 Fiscal Year, the results of optimization.
