Abstract

Sharī’ah is aimed for the goodness of mankind. By extrapolating the evidence from Qur'an and Sunnah. Islamic sharī’ah is believed to be the rules and objectives for the general interest of society and individuals. This paper focuses on the study of the concept of the nature of human rights in the view of Ibn ‘Āshūr in terms of the maqāṣid al-sharī’ah al-āmmah theory. The study is a kind of library research where the researcher collected the library data by reading books or magazines and other sources to collect data from various literatures. He used a qualitative approach by revealing the meaning of information or empirical data obtained from books, scientific or official research reports and from other literatures. This study, finally, found two results. First, there were found all characteristics of the law, the general purpose, and the meaning of sharī’ah as a whole. Second, it was found the meaning of law combined with four epistemological frameworks, namely: al-fiṭrah (religious instinct), al-samāḥah (tolerance), al-musāwah (egalitarian), and al-ḥurriyah (freedom of action). In the legality of al-maqāṣid law, this research contributes to the human rights of Ibn ‘Āshūr’s ijtihād which becomes the principle of humanity.

Abstract

This paper aims to explore Izzuddin’s jalb masalih concept and its relevance to the NU’s fatwa related to Friday Prayers during the Covid-19 pandemic. The authors use qualitative research with content analysis. The results of this study are. First. Izzuddin’s maqasid syari'ah leads to jalb masalih which also includes the concept of dzar'u mafasid. Second, Izzuddin integrates imanyah and ilmiyyah in the basic aspects of jalb masalih argumentation. Third, Izzuddin uses the two terms dzarury-hajiy-takmiliy and aliyat-mutawasitat-daniyat as levels of masalih and mafasid. The level of maslahah is influenced by differences in place and time. Fourth, dalil syara is used as the basis of the maqasid of the hereafter and logic, dzan, experiment, and habit as the basis of the maqasid of the world life. Fifth, the authors see the relevance between the results of the NU’s fatwa related to Friday Prayers during the Covid-19 pandemic and the concept of the jalb masalih conceptualized by Izzuddin ibn Abd Salam. The author's criticism is on the information about worship in the yellow zone where there should be a firmness in allowing Friday Prayers to comply with legal health protocols that are carried out based on WHO health recommendations and the rules of Izzuddin’s maqasid, Seventh, there needs to be a basis for differences in worship based on zone quality in the fatwa of Friday prayer. The conclusion obtained is the need for the adjustment of the NU Fatwa with the paguyuban Indonesian culture

Abstract

Islamic educational thought has an important role in counteracting moral decline and identity crisis. This study aims to examine Zakiyah Darajat's thoughts in Islamic education. This literature-type study shows the result that Zakiah Daradjat's thoughts in the realm of Islamic education encourage the study of progressive environmental aspects of Islamic education. This result is driven by a conceptual study of Islamic education which according to him must support the balance of the world and the hereafter. This balance will have implications for human behavior in developing social relationships. He also concluded that lifelong education which covers all dimensions of life is expected to achieve his rights in this world and the rights in the hereafter. From these findings, this research contributes to the formation of a new concept of Islamic education that is in line with the development of the modern world.

Abstract

This paper aims to formulate the relationship between the halal tourism concept and maqasid sharia. This library research collected the data from Arabic books, literature, journal articles, websites, etc, then were analyzed with a content analysis strategy. This study revealed that halal tourism is carried out to realize the benefit of religion (hifdz diin) by applying Islamic teachings in tourism activities. Some of the efforts to keep Islamic teachings are providing places of worship, halal food, halal lodging, halal financial services, and others. On the other hand, maqasid sharia can be the basis for developing halal tourism, along with al-Qur'an, al-Hadith, and other relevant bases. Jaser Auda’s concept of Maqasid Sharia stated that the tourism sector is carried out to improve community welfare. At least, maqasid sharia can reinforce seeing halal tourism from Islamic perspective.
