Abstract

This article aims to examine the method of ijtihad (independent reasoning) that is applied in constructing the fatwas issued by the National Sharia Council (DSN) under the Indonesian Ulema Council (MUI) as well as its philosophical values ​​by deeming the use of fiqh (Islamic jurisprudence) rules in terms of maslahah (benefits). A qualitative approach was employed in the study by exploring the DSN-MUI fatwas enacted ranging from 2000 to 2017. This present study highlights that the DSN-MUI used three approaches in establishing its fatwas, namely: naṣ qaṭ’i (definitive Islamic law in the Qur’an and Hadith), qauli (Muslim scholars’ perspectives), and manhaj (methodological interpretation). Additionally, the DSN-MUI completely concerned maṣālih ‘āmmah (public interests) and the objectives of Islamic law (maqāsid ash-shari’ah). Another finding promotes that 37 different types of fiqh rules were applied in the DSN-MUI fatwas, which were repeated 242 times. The Islamic jurisprudence rule that was widely implemented covered “the legal origins of muamalat (transactions) are permissible as there are no Islamic sources (dalil) that forbid them”. The quantity of use was 78 times with a percentage of 32.2. Furthermore, it can be noticed that 11 fiqh rules internalizing philosophical values were repeated 112 times. This study also offers that it is noteworthy to provide more norms of maqāsid ash-shari’a since there are lots of current issues in muamalat that have no legal considerations in the naṣ qaṭ’i.

Abstract

Perceraian dapat terjadi karena adanya suatu perkawinan yang sah. Pengajuan gugatan perceraian di Pengadilan Agama seharusnya didasarkan pada adanya perkawinan yang sah dan berkekuatan hukum yang hanya dapat dibuktikan dengan adanya akta nikah sebagimana dinyatakan dalam Pasal 7 ayat 1 Kompilasi Hukum Islam (KHI). Akan tetapi perkara gugatan perceraian dalam pernikahan sirri yang diajukan di Pengadilan Agama Kajen dapat diterima dan diputus dalam Putusan Nomor 539/Pdt.G/2020/PA.Kjn, dengan amar putusan Hakim mengabulkan gugatan perceraian Penggugat atas pernikahan siri dan menjatuhkan talak bai’in sughro. Yang menjadi permasalahan dalam penelitian ini adalah bagaimana pertimbangan hakim dalam mengabulkan gugatan perceraian dalam nikah sirri serta implikasi putusan tersebut terhadap pihak Penggugat dan Tergugat. Penelitian ini merupakan penelitian hukum normatif (yuridis normatif) yang dilakukan di Pengadilan Agama Kajen dengan menggunakan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan kasus. Hasil penelitian ini penulis menemukan bahwa pertimbangan hakim dalam mengabulkan gugatan perceraian penggugat dalam nikah sirri antara Penggugat dan Tergugat, Hakim terlebih dahulu menyatakan sahnya pernikahan dan kemudian menceraikan Penggugat dan Tergugat setelah diyakini adanya kemadlaratan apabila perkawinan dipertahankan, menurut penelitian penulis pertimbangan hakim tersebut telah sesuai dengan hukum Islam dan aturan hukum yang berlaku. Dan implikasi putusan tersebut dapat menggantikan kedudukan Akta Nikah sebagai alat bukti yang sah.

Abstract

The Covid-19 vaccination program in Indonesia, practically has received a pro and contra in the society. In this context, the Majelis Ulama Indonesia (MUI) came through its fatwa to respond the contra-productive of the community over the succession of the vaccination program. This study analysis the epistemological basis of Islamic law in the construction of the MUI Fatwa Number. 02 of 2021 about Covid-19 Vaccine Products from Sinovac Life Sciences Co. Ltd. China And Pt. Bio Farma (Persero). This qualitative research used philosophical approach, statute approach and conceptual approach. The results show, the epistemological construction of the MUI fatwa No. 02 of 2021 about the Covid-19 vaccine, Sinovac tends to integrate the paradigm of idealism and realism of Islamic law. The tendency of the integrative paradigm can be seen from the epistemological basis of the MUI fatwa formulation on the halalness of the Sinovac Covid-19 vaccine, which is normative-deductive and empirical-inductive, beside that still use preventive fiqh rules (sad al-dhariah) and benefit (maslahatul mursalah) as the basis for formulating a fatwa. This conclusion can be seen in various elements in the epistemological construction of the MUI Fatwa. First, universal ethical moral values ('am) are taken from the texts (al-Qur'an and Hadith). Second, several fiqh rules emphasize the sadd al-zari'ah (preventive action) and maslahah mursalah (public benefit). Third, the opinion of classical scholars. Fourth, the thought of experts regarding the Covid-19 vaccine.
