Abstract

The mention of 'violations' in any criminal act that violates the criminal provisions of the Immigration Law, certainly cannot be allowed to go on, because the theory of criminal law has classified the distinction between Crime and Violation. Likewise, in the formulation of the Immigration Law Criminal Provisions, there has been a fairly clear distinction between crime and violation itself. Through a theoretical study of punishment, this short and simple writing provides a description of the location of the distinction, which is very easy to identify. The condition needed is re-habituation to differentiate the mention of immigration crime in accordance with its classification.

Abstract

Trafficking in persons is a criminal act of organized crime that occurs internationally. Indonesia, as one of the countries with the fourth largest population, has experienced this crime. One of the provinces that is the center of this biggest crime is East Nusa Tenggara. In this case, the Indonesian government through existing state institutions coordinates to eliminate the crime of trafficking in persons. Immigration as one of the agencies that deals with immigration traffic problems plays a major role in efforts to deal with the Crime of Trafficking in Persons. Coordination between one party and another is carried out by the provincial government of East Nusa Tenggara. However, improving coordination is a key point of success in handling the Crime of Trafficking in Persons. This research was conducted by conducting a literature case study which aims to find out more about the crime in question. This writing is done with a descriptive research method by describing the research results in a case study literature from various literatures used by the author.

Abstract

Thisiarticle describes the problems of crimes against humanity, namely human trafficking and peopleismuggling that occuriin Indonesia. Thereiareithreeicomponents thatiwillibeitheisubject ofithisiarticle.iFirst,ithisiarticleiwillianalyzeitheicausesiofihumanitraffickingiand peopleismuggling in Indonesia. Second,ithisiarticle will examine human traffickingiin Indonesia,iwhich,iasiitiis known,iis a transit country for those who intend to commit transnational crimes. Third, the Indonesian government's efforts to combat human trafficking and people smuggling are viewed from the aspects of international law and immigration crimes. As is well known, from most cases of human trafficking and people smuggling that have occurred, the majority are women and children. Therefore, the crime of smuggling and trafficking in personsiisiaireflectioniofitheiIndonesianigovernmentiwhich does not yet fully have a permanent andibindingilawirelateditoipolicies regulating the movement of people in this case.

Abstract

Immigration Administrative Policy or commonly known as TAK, is a right that can be carried out by the immigration authorities in providing an action on a problem faced in order to maintain the sovereignty of the Unitary Republic of Indonesia. The existence of this action certainly gives the authority to deal with the State of Foreign Affairs (WNA) which is quite extensive but aimed at the same results, namely deportation or ending in jail. It is undeniable, that there are still many important points in Law No. 6 of 2011 which still need a lot of explanation, as well as leading to the Immigration Adminstrative Act. The process of investigating perpetrators of violations of the Immigration Act is carried out based on the provisions in the Criminal Procedure Code as a lex generalis and the Immigration Act as a lex specialis. In carrying out immigration law enforcement functions, there are still constraints faced by PPNS. Immigration includes lack of knowledge, lack of operational funds, lack of community participation in reporting the presence of foreigners in their environment, weak coordination with other legal apparatuses and obstacles originating from legal factors that are still taken lightly . It is hoped that the writing of this paper will awaken various parties who still view the immigration law as one eye, because immigration is an important thing for a country to maintain the country's sovereignty. Legal services through a variety of actions, one of which is the Immigration Administration.

Abstract

This paper attemps to explain national policies that provide protection for refugees, human trafficking, and protection for foreign workers in an international context. Migration can occur because of the desire of the person or forced circumstances that make a person have to migrate. Migration is generally carried out by a person or group of people who want to get a more decent life by looking for a more decent job in another country. On the other hand, other factors cause disease, natural disasters, outbreaks of disease, and high crime rates in their home countries. Therefore, the role of the government through law enforcement officials and related public officials must coordinate well, firmly and fairly in enforcing the law. The results of this study indicate that the fact that the statement of the government in implementing its policies is that the government implements the policy is good or not. As smart as someone who makes policies, will always be smarter for someone who wants to violate the policy.

Abstract

Foreigners who use free visa facility can freely travel domestically to other provinces in Indonesian. That condition affects the implementation of immigration operation which further has implications for legal compliance. This research aims to explain the implementation of immigration operation for foreigners using free visa facility who travel domestically in the area of Immigration Office Mataram. Moreover, the relation between the legal compliance and the implementation of immigration operation for foreigners who travel domestically to minimize immigration violations. This research uses a socio- legal research method that has similarities to empirical method. The results are the implementation of immigration operation for foreigners who travel domestically conducted in administrative or field (routine activities and joint operations) by Immigration Office Mataram. The relation between the legal compliance and the implementation of immigration operation is marked with the issues and factors that implicate forigners’s self-awareness who using free visa facility which create non- compliance or immigration violations. Furthermore, the compliance of forigners who using free Visa facility is connected to the compliance indicators and made in the scheme of compliance by emphasizing three elements. They are compliance of stakesholders, Registration of foreigners traveling domestically, and mapping the immigration operation areas.

Abstract

Immigration Office Unit in Gadjah Mada University is one of the breakthroughs in helping Immigration duties and Immigration functions by Class I Immigration Office Yogyakarta. Immigration services at that Immigration Office Unit has started since November 25th 2020 (soft launching). Nevertheless, from November 25th 2020 until June 3rd 2021 the authorized decision letter by the director general of immigration related to establishment of Immigration Office Unit in Gadjah Mada University based on article 8 section 1 letter h Director General Immigration Regulations Number: IMI-0746.OT.01.01 2017 about Technical Procedure Establishment of Immigration Office Unit has not been released. Hereafter, this research is to find out how is the role of Immigration Office unit in Gadjah Mada University to support immigration services in Class I immigration Office Yogyakarta and how is the legality of the immigration documents which have been released. The research method is using normative-empirical. As the result, the immigration documents which have been released by that Immigration Office Unit at that period didn’t disturb the legality of documents. However, to make sure that conclusion is strong enough, thing that needed to be done is changing the authorized decision letter about Immigration Office Unit in Gadjah Mada.
