Abstract

Tujuan studi ini untuk mengkaji tanggung jawab notaris atas pembatalan akta hibah tanpa persetujuan ahli waris yang dibuat olehnya. Studi ini menggunakan metode penelitian hukum normative dengan pendekatan perundang-undangan dan komparatif. Hasil studi dalam penelitian ini menunjukkan bahwa keabsahan dari akta hibah yang tidak disetujui oleh ahli waris adalah tidak sah dan notaris yang membuat akta hibah tanpa persetujuan ahli waris dapat dikenai sanksi administratif maupun perdata apabila terjadi kerugian bagi para pihak The purpose of this study is to analize the notary’s responsibility fot the cancelation of the grant deed without the approval of the heirs. This study uses legal normative research method with statutory and comparative approach. The result of this study indicate that the validity of grant deed that doesn’t have approval from the heirs is not valid and the notary who makes grant deed without approval from the heirs can be subject to administrative and civil sanctions in the event of loss of the parties.
