Abstract

Begging which is a public disease, in legal products in Indonesia so far has two contradictory definitions. One side is the impact of poverty and the other side is considered a community disease. The existence of this difference needs to be analyzed by legal synchronization. The birth of Kudus regency regulation number 15 of 2017 is a legal product aimed at tackling begging in Kudus regency. The synchronization results show that the content of the content in the Perda is in line with the Constitution. But in the synchronization process, there are still some obstacles. That is because the meaning of the act of begging is still considered a community disease, and as an impact of poverty on the other side. AbstrakPengemisan yang merupakan penyakit masyarakat, dalam produk hukum di Indonesia selama ini mmemiliki dua definisi yang kontradiktif. Satu sisi sebagai dampak kemiskinan dan sisi lain dianggap sebagai penyakit masyarakat. Adanya perbedaan ini perlu dianalisa dengan sinkronisasi hukum. Lahirnya Perda Kabupaten Kudus Nomor 15 tahun 2017 merupakan produk hukum yang ditujukan untuk menanggulangi pengemisan di Kabupaten Kudus. Hasil sinkronisasi menunjukkan jika materi muatan dalam Perda tersebut sudah sejalan dengan Konstitusi. Namun dalam proses sinkronisasi tersebut, masih terdapat beberapa kendala. Hal tersebut dikarenakan pemaknaan tindakan pengemisan yang masih dianggap sebagai penyakit masyarakat, dan sebagai dampak kemiskinan pada sisi yang lain.

Abstract

The purpose of this study was to determine the impact of termination of employment during the Covid-19 pandemic on family resilience. This study uses a case approach and a law approach with primary legal sources and secondary legal sources in the form of books or legal journals related to the research title. The results of this study indicate that the termination of employment experienced by the head of the family or family member during the Covid-19 pandemic did not significantly affect family resilience, as evidenced by the divorce rate which did not increase significantly and was not caused by termination of employment. As for maintaining family resilience during the Covid-19 pandemic can be done by carrying out the rights and obligations of each family member in accordance with the study of Islamic family law, in addition to maintaining interpersonal communication between family members.

Abstract

The government's policy of issuing Presidential Instruction Number 8 of 2018 concerning Suspension and Evaluation of Oil Palm Plantation Permits and Improvement of Oil Palm Plantations can be interpreted as a step in structuring oil palm plantations in Indonesia as well as providing legal certainty. This paper aims to determine the achievements of the palm oil moratorium based on the Presidential Instruction Number 8 of 2018 and to find out the prospects and challenges faced by the government in implementing the palm oil moratorium program. To answer these problems, this paper uses a statutory approach, a case approach, and a conceptual approach. While the data sources used are secondary data in the form of Presidential Instruction Number 8 of 2018 and others. The results of this study can be concluded that the implementation of the Presidential Instruction regarding the Palm Oil Moratorium has positive implications, especially in preventing the rate of deforestation. The prospect of implementing a palm oil moratorium based on Presidential Instruction Number 8 of 2018 has achieved a conducive business climate and resolved overlapping problems related to palm oil business permits. In addition to these prospects, the government also faces difficult challenges, namely the potential for agrarian conflicts that are still high and law enforcement in a sustainable manner in the oil palm plantation sector it self.Kebijakan pemerintah menerbitkan Instruksi Presiden Nomor 8 Tahun 2018 tentang Penundaan dan Evaluasi Perizinan Perkebunan Kelapa Sawit serta Peningkatan Perkebunan Kelapa Sawit dapat dimaknai sebagai langkah dalam penataan perkebunaan sawit di Indonesia sekaligus memberikan kepastian hukum. Tulisan ini bertujuan untuk mengetahui capaian moratorium sawit berdasarkan Instruksi Presiden Nomor 8 Tahun 2018 dan untuk mengetahui prospek dan tantangan yang dihadapi pemerintah dalam menjalankan program moratorium sawit. Untuk menjawab permasalahan tersebut tulisan ini menggunakan metode pendekatan perundang-undangan, pendekatan kasus, serta pendekatan konseptual. Sedangkan sumber data yang digunakan yaitu data sekunder berupa Instruksi Presiden Nomor 8 Tahun 2018 dan lainnya. Hasil kajian ini dapat disimpulkan bahwa pemberlakuan Instruksi Presiden tentang Moratorium Sawit membawa implikasi positif terutama dalam mencegah laju deforestasi. Prospek dari pemberlakuan moratorium sawit berdasarkan Instruksi Presiden Nomor 8 Tahun 2018 telah tercapainya iklim usaha yang kondusif dan menyelesaikan permasalahan tumpang tindih terkait izin usaha sawit. Selain prospek tersebut pemerintah juga menghadapi tantangan yang tak mudah yakni potensi konflik agraria yang masih tinggi dan penegakan hukum secara berkelanjutan di bidang perkebunan kelapa sawit itu sendiri.

Abstract

The authority of the Chief of Village, which has so far been limited to mere administrative authority, may apparently be exceeded by the authority of the chief of Village in conducting customary mediation in marriage disputes in Taman Village, Sreseh sub-district, Sampang Regency, East Java, Indonesia, where so far the mediation authority lies in the competence of a certified mediator.  In this regard, two questions is discussed in this paper: first, how is process of customary mediation; and the second, how the implications of the customary mediation on family life in the Taman Village of Sreseh district, Sampang, East Java, Indonesia.  The research method used is a socio-legal approach by conducting interviews with the Chief of Taman Village, and local academics. Socio-legal selection is limited to methodology and analytically carried out by using the rules of legal research. The results show that the customary mediation process carried out by the Chief of Village is in line with the mediation process carried out by certified mediators with several similarities and one difference.  However, the results of customary mediation showed significant successes that surpassed the success rate of court mediation.   The implications of the customary mediation process are threefold.  First, it brings local values as the basic of customary mediations.  Second, it strengthens the local mediation that aids in reducing the divorce rate in Religious Courts.  Third, as a breakthrough in the role and function of the Chief of Village as the leader at the village level.
