Abstract

At the end of 2020, to be precise in November 2020, the government passed Law Number 11 of 2020 concerning Job Creation. Several months later, namely in February 2021, the government stipulated implementing regulations for Law Number 11 of 2020, namely Government Regulation Number 35 of 2020 concerning Specific Time Work Agreements, Outsourcing, Working Time and Rest Time, as well as Termination of Employment Relations. People infected by the COVID-19 outbreak continue to increase every day, and the number of deaths due to the COVID-19 outbreak continues to increase. The Central Government and Regional Governments have issued policies to prevent and overcome the spread of the COVID-19 outbreak, namely by implementing Large-Scale Social Restrictions (PSBB) and Implementing Community Activity Restrictions (PPKM). With the implementation of PSBB and PPKM by the government, several sectors, especially the accommodation provision sector, tourism businesses, food and beverage businesses, real estate, and construction experienced direct impacts as a result of the COVID-19 pandemic and the existence of PSBB and PPKM. The tourism sector, especially hotels, experienced a decline in income due to the lack of overnight guests, forcing entrepreneurs to lay off workers without providing wages to reduce expenses and save company finances. This thesis research analyzes the impact caused by laying off workers/laborers without being paid wages and legal considerations regarding the decision of the Industrial Relations Court at the Central Jakarta District Court with case number: 398/Pdt. Sus PHI/2021/PN. JKT. PST. The purpose of this decision analysis is to find out requests for termination of employment (PHK) by workers or employees due to being laid off for more than three months without wages based on Law Number 11 of 2020 concerning Job Creation.

Abstract

Juridical Analysis of Private Worker Training Responsibilities Comparative Study of Law no. 13 of 2003 concerning Employment With Law no. 11 of 2020 concerning Job Creation. The formulation of the problem in this research is: (1) What are the provisions that train private workers in Indonesia? (2) What are the Responsibilities and Obstacles of Implementing Private Worker Training Comparative Study of Law No. 13 of 2003 concerning Manpower and Law No. 11 of 2020 concerning Job Creation.? (3) How Should Private Workers in Indonesia be Trained in the Future Mass?. In this sentence using normative research methods. From the results of research, discussion and analysis it can be concluded that: That the comparison of Law. No. 11 of 2020 concerning Job Creation with the Manpower Law, which then contains several substances that change and delete the substance contained in the Manpower Law. work including regarding government training institutions as referred to in paragraph (1) letter a in organizing job training can cooperate with the private sector. As for the author's suggestion that local governments should prioritize Vocational Training Centers as a forum for handling unemployment rates in all private agencies throughout Indonesia especially in manufacturing companies.

Abstract

Keselamatan dan kesehatan kerja termasuk salah satu program pemeliharaan yang ada di setiap perusahaan. Pelaksanaan program keselamatan dan kesehatan kerja bagi pekerja/buruh sangat penting karena bertujuan untuk menciptakan sistem keselamatan dan kesatuan kerja yang nantinya dapat meningkatkan produktivitas kerjanya. Dalam hubungan industrial antara pemberi kerja (pengusaha) dan tenaga kerja (pekerja/buruh) masih banyak kasus Keselamatan dan Kesehatan Kerja (K3) di Indonesia. Maka dengan penelitian ini bermaksud untuk mencari tahu bagaimana ketentuan dan sistem pengawasan Dinas Tenaga Kerja, Transmigrasi dan Energi Provinsi DKI Jakarta dalam melakukan perlindungan hukum tenaga kerja terhadap keselamatan dan kesehatan kerja. Penelitian ini menggunakan jenis pendekatan kualitatif untuk mengkolaborasikan antara realita empirik dengan teori-teori yang berlaku dengan menggunakan teknik deskriptif dalam melakukan pengumpulan data secara observasi, wawancara dan dokumentasi. Hasil penelitian yang dilakukan ini bahwa Peningkatan kecelakaan kerja di wilayah Daerah Khusus Ibukota Jakarta relatif meningkat mencapai 32 persen lebih per tahunnya. Hal inilah yang dilakukan Dinas Tenaga Kerja, Transmigrasi dan Energi Provinsi DKI Jakarta dalam pengawasan dibidang keselamatan dan kesehatan kerja melalui kegiatan edukatif dan represif. Penelitian ini menyimpulkan bahwa setiap pekerja/buruh mempunyai hak untuk memperoleh perlindungan atas keselamatan dan kesehatan kerja, moral, dan kesusilaan, serta perlakuan yang sesuai dengan harkat dan martabat manusia serta nilainilai agama. Maka konsep perlindungan hukum tenaga kerja di masa yang akan datang harus memperhatikan tiga konsep seperti perlindungan secara ekonomis, sosial dan teknis.
