Abstract

Abstrak Artikel ini membahas tentang Ketetapan Ekonomi DSN-MUI dari segi dalil hukum dan implikasi sosial dan hukumnya. Dari 82 fatwa tersebut, 17 di antaranya dibahas, antara lain: perbankan, asuransi, pasar modal, dan fatwa gadai, namun penulis lebih fokus pada pasar modal syariah. Metode analisis yang digunakan adalah seperangkat konsep teoritis dan/atau hukum yang membahas pokok permasalahan hukum dari pendekatan konseptual, yang hasilnya disajikan dalam bentuk deskripsi kualitatif. Kajian ini menemukan bahwa fatwa DSN selalu mengacu pada Al-Qur'an dan hadits, dan terkadang pada ijmak, qiyas, dan pendapat ulama. Namun di sisi lain, harus dicatat bahwa fatwa ini terlalu mengesankan untuk "mengkonfirmasi" instrumen perbankan tradisional apa pun melalui penggunaan hlah dan akad murakkab yang dilarang oleh Nabi. Studi ini juga menemukan dampak keputusan DSN terhadap peraturan perundang-undangan pemerintah. Kata Kunci: DSN-MUI, Fatwa, Hukum Islam, Pasar Modal Syariah. Abstract This article discusses the DSN MUI Economic Decree from the perspective of legal arguments and its social and legal implications. Of the 82 statutes, the 17 that will be discussed include: Banking, Insurance, Capital Markets and Mortgage Statutes, but the author focuses more on Islamic capital markets. A collection of theories and/or legal concepts that are the subject of legal issues from the conceptual approach is used as a method of analysis, the results of which are presented in the form of a qualitative description. The study found that DSN fatwas always refer to the Quran and Hadith, and sometimes to Ijmak, Qiyas, and the opinions of scholars. On the other hand, however, it should be noted that these fatwas are too impressive to provide "confirmation" to traditional banking instruments through the use of hlah and akad murakkab prohibited by the Prophet. This study also identifies the impact of DSN mandates on state laws and regulations. Keywords: DSN-MUI, Fatwa, Islamic Capital Market, Islamic Law.

Abstract

The United Arab Emirates is a federation of seven emirates: Ajman, Dubai, Sharjah, Abu Dhabi, um Al-Quwain, Ras Al Khaimah and Emirate of Ras Al Khaimah. The United Arab Emirates is located near the Persian Gulf in the Northeastern part of the Arabian Peninsula; it was founded in 1971 by Sheikh Zayed Al Nahyan. The country's diverse culture and geographic location as a crossroads make it a prime location for commerce and trade. There are currently three emirates in the country: Fujairah, Ras al-Buradj, and Sharjah. Islam plays a crucial role in Gulf culture. Because of this, the role of Islamic principles in dispute resolution and trade is considered a key aspect. This article discusses how Sharia Economic Law affects both Muslim and non-Muslim business relationships in the United Arab Emirates and Dubai. Abstract

This study aims to determine whether there is a difference between the performance of conventional and sharia mutual funds and to find out the difference between the sharia index (JII) and the conventional index (IHSG). The population of this research is all stock mutual funds that cooperate with Indo Premier Sekuritas. Based on the purposive sampling method, there were 65 samples consisting of 14 Islamic stock mutual funds and 51 conventional stock mutual funds. Empirical results show that the performance of Islamic mutual funds is lower than that of conventional mutual funds. In addition, the performance of Islamic and conventional equity mutual funds is better than JII and JCI.

Abstract

This paper makes a connection between the global financial crisis and an Islamic financial model. The goal is to downplay the severity and frequency of the financial crisis by sharing risk among financial participants. This is accomplished through a system of shared credit creation. When purchasing real goods and services from people who have them and need to sell, people are given access to credit that they can use to buy what they need. Both sellers and buyers want to receive delivery of their purchased items, so the system creates economic growth through increased credit availability. Studying Islamic finance literature allows people to explore the possibilities and restrictions of inherited situations. This leads to new financial design solutions for the current financial crisis as well as future financial collapses. It also uses critical thinking and analysis to create new possibilities and constraints in situations. New financial systems should use a business model based on shared profits and losses. This was based on academic studies and doesn’t include any real-world testing. By incorporating Islamic financial principles into business practices, a new financial model could help finance businesses.
