Abstract

Abstract This article discusses the DSN MUI Economic Decree from the perspective of legal arguments and its social and legal implications. Of the 82 statutes, the 17 that will be discussed include: Banking, Insurance, Capital Markets and Mortgage Statutes, but the author focuses more on Islamic capital markets. A collection of theories and/or legal concepts that are the subject of legal issues from the conceptual approach is used as a method of analysis, the results of which are presented in the form of a qualitative description. The study found that DSN fatwas always refer to the Quran and Hadith, and sometimes to Ijmak, Qiyas, and the opinions of scholars. On the other hand, however, it should be noted that these fatwas are too impressive to provide "confirmation" to traditional banking instruments through the use of hlah and akad murakkab prohibited by the Prophet. This study also identifies the impact of DSN mandates on state laws and regulations. Keywords: DSN-MUI, Fatwa, Islamic Capital Market, Islamic Law.

This article aims to determine the form of contracts contained in multiservice ijarah financing as an alternative to financing health services in the Covid-19 pandemic. This type of research is normative legal research. The data were obtained from library materials such as books, journals, etc. The analysis results show that health financing can be carried out in two ways: the ijarah contract, which begins with the bank through investors doing the health institution after making the contract, and the wakalah contract through the customer himself. Abstract

This research is motivated by the concept of wages originating from ijarah contracts more widely used in Islamic Economic Institutions than wages derived from ju'alah contracts. While the two contracts are contracts that cause the provision of wages. Therefore, this study will describe the application of the concept of wages to ijarah and ju'alah contracts at the Islamic Economic Institution. This research is a secondary research with a literature study method whose data comes from various literatures through a normative juridical approach. This research is a type of qualitative research with technical data analysis through three stages, namely reducing data, presenting data and drawing conclusions. The results of this study reveal the fact that the concept of wages that is widely used in Islamic economic institutions is wages derived from ijarah contracts. This is because the legal consequences that have the concept of justice are that wages are based on the amount and results that have been completed, rather than wages derived from the ju'alah contract which will be given when a job can be completed perfectly. Therefore, the concept of wages is more identical to the ijarah contract for service benefits, so that there is a development of the meaning of ujrah in the form of wages and rental prices in accordance with the object of the contract exchanged in the ijarah contract.

Abstract

Restructuring non-performing financing is one of the solutions to save financing performance as one of the largest contributors to Islamic banking revenue. However, in practice it is not easy for Islamic banks to do so, because Islamic banks must consider the precautionary principle which has implications for risks that will occur in the future. In addition, the use of hybrid contracts in the restructuring mechanism for non-performing financing is an integral part in minimizing these risks. This study tries to reveal the application of hybrid contracts in the restructuring of non-performing financing in Islamic banking. This article uses a descriptive literature research method obtained from the results of the analysis of the primary data source, namely the substance of the legislation and the DSN-MUI fatwa. So this research uses a normative juridical approach. This type of research includes qualitative research with data analysis techniques that provide a conclusion in the form of accountable information. The results of this study reveal the fact that the application of hybrid contract contracts in the restructuring of non-performing financing in Islamic banking uses a lot of hybrid types of assembled contracts (al-'uqud al-Mujtami'ah), namely the existence of an association of contracts between tabarru' (qordh) and contracts mu'awadhat (sale and purchase, ijarah, IMBT, mudharabah and musharaka).
