Abstract

Religion is a social institution, especially for the Muslim community in general, determine the dynamics of the entire development community. In many cases the social processes that marginalizing women, intentionally or not, often involving religion as elements forming knowledge about relationships between men and women are unequal, and often used as a source of theological legitimacy of the above indisputable fact that marginalize women. During this time, the field of study of the Qur’an many scholars dominated philology and history. This led to a prolonged confusion between the text and the history of salvation history, which is implicit in it. This needs to be solved, with the view that the text of the Quran and his commentary as an expression of the views of Islam. This is where the importance of the legacy of structuralism in a given interpretation. By using Levi-Strauss structuralism, an attempt to determine the relationship webs in the narrative, the relationship is either syntagmatic or paradigmatic, to find hidden messages or messages that are deepest in the verses of the Qur’an.

Abstract

Nushuz is a classical conception of law that has been codified as standard the rule of law in the Compilation of Islamic Law (KHI). Some Muslims consider the explanation of the scholars about nushuz is taken for granted, mainly because it was labeled “religion” that is considered sacred and there is no room for change especially criticized. KHI is certainly not free from power, value s, and interests, in particular, of its the patriarchal apparatus of constituent, so women tend to be faced with a wall of injustice, subordination, masculine superiority and imbalance. This is reflected in provisions of nushuz in KHI that apply to the wife only and does not apply to husbands. Terms of nushuz in KHI also justify domestic violence, especially in the case of forced sexual intercourse by a husband against his wife. This article explains that in fact issue of nushuz is for husband and wife. However, the plains of empirical, KHI in explaining provisions of of nushuz apply to the wife only. This is where KHI has been marginalized and dehumanization of women.[Nusyu>z merupakan konsepsi hukum klasik yang telah terkodifikasikan sebagai aturan hukum baku dalam Kompilasi Hukum Islam (KHI). Sebagian umat Islam memandang penjelasan para ulama tentang nusyu>z merupakan hal yang terberi (taken for granted), terutama karena sudah diberi label “ajaran agama” sehingga dipandang sakral dan tidak ada ruang untuk mengkritisinya apalagi mengubahnya. KHI tentu tidak bebas dari kuasa, nilai, dan kepentingan, terutama, dari apparatus pembentuknya yang patriarkis, sehingga perempuan cenderung dihadapkan dengan tembok ketidakadilan, subordinasi, superioritas maskulin, dan ketidakseimbangan (dis-equilibrum). Hal itu tercermin dariketentuan nusyu>z dalam KHI yang hanya diberlakukan terhadap isteri saja dan tidak berlaku bagi suami. Ketentuan nusyu>z dalam KHI juga membenarkan tindakan KDRT, terutama dalam hal pemaksaan hubungan seksual oleh suami terhadap isterinya. Artikel ini memberikan penjelasan bahwa sebenarnya persoalan nusyu>z adalah bagi isteri dan suami. Namun pada dataran empirik, KHI dalam menjelaskan ketentuan nusyu>z hanya berlaku untuk isteri saja. Di sinilah KHI telah memarginalkan dan mendehumanisasi perempuan.]

Abstract

This article explains the concept of leadership in the family (qiwāmah) gender justice perspective. The focus of the study on the interpretation of Surat an-Nisā '[4] verse 34 which becomes the theological and socio-cultural foundation of society. The letter interprets that the husband is superior to the wife, so marriage relations tend to be hierarchical (the husband becomes the head of the family, while the wife has the subordinate status). This lame husband and wife relationship makes the wife vulnerable to violence. The author considers that this verse must be reinterpreted from the point of view of gender justice given the sociological shift. This study led the writer to the conclusion that the concept of qiwāmah in Islamic jurisprudence is open and dialogic with the times. The concept of qiwāmah now must be interpreted based on human values rather than gender, so that women as wives not only serve their husbands, but partners and partners who are both subjects and objects. The relationship between them is in the form of symbiosis of mutualism (mutual benefit), not only in the family but also for the community and the State. There is no difference between the two, except in matters of devotion to God. [Artikel ini menjelaskan konsep kepemimpinan dalam rumah tangga (qiwāmah) perspektif keadilan gender. Fokus kajian pada penafsiran Surat an-Nisā’ [4] Ayat 34 yang menjadi landasan teologis dan sosio-kultural masyarakat. Surat tersebut menafsirkan bahwa suami lebih unggul daripada istri, sehingga hubungan perkawinan cenderung hierarkis (suami menjadi kepala keluarga, sementara istri berstatus subordinat terhadapnya). Relasi suami istri yang timpang ini membuat istri rentan terhadap kekerasan. Penulis memandang bahwa ayat ini harus ditafsir ulang dari sudut pandang keadilan gender mengingat adanya pergeseran sosiologis. Kajian ini mengantarkan penulis pada kesimpulan bahwa konsep qiwāmah dalam yurisprudensi Islam bersifat terbuka dan dialogis dengan perkembangan zaman. Konsep qiwāmah sekarang harus dimaknai berdasarkan nilai-nilai kemanusiaan bukan jenis kelamin, sehingga perempuan sebagai istri bukan hanya melayani suaminya, melainkan patner dan mitra yang sama-sama menjadi subyek sekaligus obyek. Relasi keduanya berupa simbiosis mutualisme (saling menguntungkan), tidak hanya dalam keluarga tetapi juga untuk masyarakat dan Negara. Tidak ada perbedaan di antara keduanya, kecuali dalam hal ketakwaan kepada Tuhan.]

Dalam banyak kasus proses sosial yang memarginalisasikan perempuan, sengaja atau tidak, sering melibatkan agama sebagai unsur pembentuk pengetahuan tentang relasi laki-laki-perempuan yang timpang dan seringkali dijadikan sumber legitimasi teologis yang tidak terbantahkan atas kenyataan yang menyudutkan perempuan. Selama ini, bidang kajian al-Qur’an banyak didominasi sarjana filologi dan sejarah. Ini memunculkan kerancuan berkepanjangan antara sejarah teks tersebut dan sejarah penyelamatan, yang secara implisit terkandung di dalamnya. Hal ini perlu dipecahkan, dengan memandang bahwa teks al-Qur’an dan tafsirnya sebagai ungkapan pandangan-pandangan Islam. Di sinilah pentingnya strukturalisme dalam memberi kekayaan khazanah penafsiran. Abstract

In the marriage law in Indonesia, the guardian (wali) becomes very complicated issue. It is certainly not out of the understanding of the scholars, both conventional scholars, contemporary or legislation. Because the arguments are held down by both the Qur'an and hadith still interpretable. Although the validity of guardians according to scholars and the reading of legislation is very diverse, the majority of Muslims still requires a guardian of marriage even if it will be able to fertilize the patriarchal practices. But despite it all, there are values that are contained behind the role of guardian. Among other things, the value of the benefit, equality, consultation, wisdom, freedom, justice and prosperity.

Abstract

Women and identity politics are actual problems and often invite endless long debates. Women are often forgotten in the history of the Indonesian Nation, especially related to policies such as sharia regulations. The birth of Islamic sharia regulations is not from a vacuum, but is born from a very long and twisted process. Regional autonomy has become the main entrance to the emergence of shari'a regulations as a form of regulatory decree both whose authority is attributive (inherent) or delegative (derivative). The rise of the expansion of new regions as a result of regional autonomy policy, apparently also led to the strengthening of identity politics that seemed to be inherent and must be present in every regional policy taken especially in sharia regulations. Women and sharia regulations become interesting phenomena to be studied from various sides, both political, cultural, legal and religious aspects. This paper portrays women and identity politics in shari'a regulations. A review of how women's representation and identity politics influence the contents of shari'a regulations.

Abstract

Bidang kajian al-Qur’an selama ini banyak didominasi sarjana filologi dan sejarah. Ini memunculkan kerancuan berkepanjangan antara sejarah teks tersebut dan sejarah penyelamatan, yang secara implisit terkandung di dalamnya. Hal ini perlu dipecahkan, dengan memandang bahwa teks al-Qur’an dan tafsirnya sebagai ungkapan pandangan-pandangan Islam. Mohammed Arkoun menguak kembali esensi wahyu sebagai kalam Allah yang transenden dan wacana wahyu sebagai perwujudan kalam tersebut dalam dataran imanen. Dengan menggunakan linguistik semiotik, sebuah upaya untuk Arkoun berusaha menunjukkan fakta sejarah tentang bahasa al-Qur’an dan kandungannya, untuk mengetahui hidden message yang terdapat dalam Surat al-Fatihah. Terlepas dari Pro dan Kontra, Arkoun berhasil mengetengahkan sudut pandang Islam yang dapat diterima dalam lingkungan ilmiah Barat, dan menarik minat kebanyakan kalangan orientalis untuk mengkaji al-Qur'an. Abstract

Abstrak Keluarga dalam perspektif psikologi mempunyai tujuan untuk menjalankan hubungan dalam keluarga dan keberfungsian dalam keluarga dengan baik sehingga terwujudlah keluarga yang bahagia dan tentram. Dalam Islam keluarga yang bahagia dan tentram dikenal dengan istilah keluarga sakinah, mawaddah, dan rohmah. Diperlukan upaya-upaya untuk mencapai keluarga sakinah. Dengan mengetahui fungsi-fungsi keluarga dalam perspektif psikologi diharapkan upaya membentuk keluarga sakinah bisa tercapai. Dalam kajian pustaka ini dijelaskancara untuk mencapai keluarga sakinah, di antaranya adalah menjalankan fungsi keluarga dengan baik, memupuk rasa sayang dan cinta, adanya saling pengertian antara suami istri, saling menerima kenyataan, saling melakukan penyesuaian diri, dan mengedapankan asas musyawarah. Abstract

Abstract: The lack of culinary treasures in our historical literature is the background of this research. Therefore, this study aims to find out the history and philosophy of Tumpeng in the tradition of pre-Islamic Javanese society and to understand the development of Tumpeng in the bancakan tradition of Javanese society after the arrival of Islamic influence. This study uses historical (historical) research methods which include heuristic methods, source verification, text interpretation, and historiography, as well as using a gastronomic approach. Apart from that, this study also uses the theory of symbolic culture based on Clifford Geertz's version as a tool for historical analysis. The results of this study found several historical facts, namely: 1) Tumpeng is a food that has existed since the Javanese people still embraced the Kapitayan belief, which is served and offered as a means to worship "God" which they believe is something that cannot be explained and cannot be reached by the five senses, or better known as Sang Hyang Tunggal. 2) After the Hindu-Buddhist influence entered and took root firmly in the beliefs of the Javanese people, the shape of Tumpeng began to change into a cone (mountain). 3) After the spread of Islam carried out by Walisongo through a process of assimilation and syncretization of culture which was previously thick with the teachings of Kapitayan and Hindu-Buddhist beliefs into a culture that has internalized Islamic values, Tumpeng automatically also experiences a shift in values.
