Abstract

Research entitled Liability for Apartments Developers Who Sell Apartments Who Still Have Not Got Building Permits, by addressing the issue How legal protection of consumers who buy an apartment does not have a building permit and How is the liability of apartment developers who sell apartments that still have not obtained a building permit. Research with the approach method of legislation and concept approach, obtained a conclusion as follows: Legal protection of consumers who buy an apartment does not have a building permit, that developers in building an apartment must meet the requirements of which must have IMB. Developers build apartments up to level 25, whereas they do not have an IMB (still in the process of applying for permits), have marketed their apartment, when the DKI Government prohibits apartment developers from building up to elevation / level 20. So it hurts buyers who have bought apartments at that level. Consumers and developers have been bound in the sale and purchase agreement, so that failure gives the right to the consumer to sue for damages. The liability of apartment developers who sell apartments that still do not get a building permit, that developers who failed to build, due to a ban from the DKI Government Agency, can be said to have committed unlawful acts. X Developers who commit unlawful acts, grant the consumer the right as a form of legal protection to obtain compensation

Abstract

Every business actor in Indonesia must be in a situation of fair and fair business competition, so as not to cause a concentration of economic power on certain business actors, by still obeying various existing laws and regulations in force in the State of Indonesia. Abstract

This writing discusses the issue of nominee agreements related to ownership rights to land and buildings for foreign citizens by lending the names of Indonesian citizens as a bridge. This writing aims to analyze the validity of nominee agreements according to Civil Law in Indonesia and to analyze the legal power of nominee agreements on property rights for foreign citizens in the event of a conflict between the parties according to Indonesian Civil Law. This research is a normative juridical research to solve problems in accordance with the provisions of the norms that apply to the law. The primary source of legal materials used is the Civil Code, Basic Agrarian Law Regulations. Sources of secondary legal materials are obtained through literature review and references from journals, articles and law books. The results show that the Nomine Agreement is one of the categories of Inominaat agreements, or what is often referred to as an unknown agreement with a certain name, which is an agreement that is unknown or not regulated in civil law in Indonesia. Abstract

Wirausaha berperan penting dalam perekonomian suatu negara karena dapat menciptakan lapangan kerja baru. Di banyak negara, wirausaha adalah aspek penting yang memainkan peran vital dalam perekonomian. Pasalnya, sektor swasta yang digerakan para wirausaha ini menjadi penyumbang ekonomi terbesar. Sikap wirausaha yang selalu ingin tahu membuat wirausaha selalu dapat menemukan inovasi baru di dunia usaha. Oleh karenanya, seorang wirausaha harus memiliki sifat wirausaha agar bisnisnya bisa berkembang dengan baik. Dalam hal ini wirausaha yang dimaksud adalah UMKM. UMKM merupakan peluang dan pilihan bagi masyarakat untuk melakukan aktifitas dalam menunjang bagi berkembangnya ekonomi nasional, dan hambatan2 yang dihadapi dapat diatasi dengan membentuk jejaring usaha/bisnis antar pelaku usaha yang bersifat saling menguntungkan berdasar hukum yang berlaku. Kegiatan Pengabdian ini menggunakan metode pendekatan sosiologis dengan mendekatkan kepada masyarakat. Bahan materi diambil dari peraturan perundang-undangan, buku-buku, makalah-makalah dan dokumen-dokumen lain yang berkaitan dengan penelitian. Permasalahan yang diambil dari penelitian ini adalah bagaimana menumbuhkan sifat-sifat wirausaha bagi masyarakat RT 05-RW 05 Gayung Kebonsari Timur Kec. Ketintang Kota Surabaya.
