Abstract

Penulisan ini bertujuan menganalisa dan memahami fenomena sewa rahim atau surrogate mother melalui pandangan hukum yang berlaku di Indonesia khususnya menurut Kitab Undang-undang Hukum Perdata dan Kompilasi Hukum Islam. Tipe penelitian ini adalah normatif dengan dilandasi dengan pendekatan yuridis perundang-undangan, serta pendekatan kualitatif deskriptif dengan menggunakan analisis konten terhadap bahan-bahan hukum yang primer, sekunder maupun tersier. Hasil penelitian didapat penganalisaaan pandangan hukum bervariatif dan komlikatif dari pandangan KUHPerdata dan Kompilasi Hukum Islam,bahwa; KUHPerdata menyamakan kedudukan status anak hasil surogasi dengan anak sah,menurut KHI anak hasil sewa Rahim adalah anak kandung diluar kawin sedangkan segi hak kewarisan menurut KUHPerdata anak hasil sewa Rahim tidak melebihi 1/3 bagian dari pewaris bagiana naksah sedangkan menurut KHI hanya boleh mendapat kewarisan dari garis turunan ibunya. This writing aims to analyze and understand the phenomenon of surrogate mother rent through the perspective of the applicable law in Indonesia, especially according to the Civil Code and the Compilation of Islamic Law. This type of research is normative based on a statutory juridical approach, as well as a descriptive qualitative approach using content analysis of primary, secondary and tertiary legal materials. The result of this research is that the analysis of the varied and comlicative views of law from the view of the Civil Code and the Compilation of Islamic Law, that; The Civil Code and KHI equalize the status of a child resulting from surrogation with a child outside of marriage, whereas in terms of the inheritance rights according to the Civil Code, the child who leases the uterus does not exceed 1/3 of the inheritance of the legal part of the child, while according to KHI only inheritance is allowed from the line of the mother'sdescent.
