Abstract

Tujuan penelitian menganalisa Formulasi Penerapan Tindak Pidana Pencemaran Nama Baik dalam Undang Undang Informasi Dan Transaksi Elekronik Saat Ini dan untuk mengetahui Reformulasi Pengaturan Tindak Pidana Pencemaran Nama Baik Melalui Media Elektronik yang akan datang. Metode penelitian menggunakan penelitian hukum yuridis normatif. Hasil penelitian menunjukkan Formulasi penerepan pasal tindak pidana pencemaran nama baik dalam UU ITE dianggap telah melanggar asas lex certa sehingga berpontensi melanggar hak asasi manusia khususnya hak berpikir dan menyatakan pendapat. Serta Reformulasi pasal ini didalam UU ITE dianggap sangat perlu hal ini karena lemahnya penghargaan dan perlindungan hak asasi manusia serta sanksi pidana yang masih mengedepankan ultimum remedium sehingga formulasi ideal sudah seharusnya menghargai dan melindungi HAM khusus hak berpikir dan menyampaikan pendapat serta menakar ulang formulasi sanksi pidananya. The research objective is to analyze the Formulation of the Application of the Crime of Defamation in the Current Electronic Information and Transaction Law and to see the upcoming reforms to regulate the crime of defamation through electronic media. The research method uses normative juridical legal research. The results showed that the formulation of the application of criminal defamation in the ITE Law has even violated the principle of lex certa so that it has the potential to violate human rights, especially the right to think and to express opinions. And the reformulation of this article in the ITE Law is very necessary because of the weak appreciation and protection of human rights as well as criminal sanctions that still prioritize ultimum remedium so that the ideal formulation should respect and protect human rights specifically the right to convey and convey and measure the formulation of criminal regulations.
