Abstract

Tujuan penelitian menganalisis optimalisasi penyidikan tindak pidana pencemaran nama baik melalui media sosial di Polres Maros dan faktor-faktor yang mempengaruhinya. Metode penelitian ini menggunakan tipe penelitian yuridis empiris. Sifat penelitian ini adalah deskriptif analitis. Penelitian ini dilaksanakan di Kabupaten Maros, dengan responden: Penyidik 10 orang, Advokat 5, dan Masyarakat Umum 10 orang. Secara keseluruhan sampel untuk seluruh lokasi penelitian sebanyak 25 orang yang dipilih secara random sampling. Hasil penelitian ini menunjukkan bahwa penyidikan tindak pidana pencemaran nama baik melalui media sosial di Polres Maros kurang optimal. Kurang optimalnya penyidikan dikarenakan terkendala oleh identitas beberapa terlapor yang menggunakan akun palsu atau identitas pemilik akun tersebut diketahui. Faktor-faktor yang mempengaruhi optimalisasi penyidikan tindak pidana pencemaran nama baik melalui media sosial di Polres Maros yang dilaporkan ke Polres Maros adalah faktor substansi hukum, faktor aparat penyidik, faktor sarana prasarana, faktor kesadaran hukum masyarakat dan budaya hukum masyarakat. The Research objective to analyze the optimization of criminal defamation investigations through social media at Polres Maros and the factors that influence it. This research method uses the type of empirical juridical research. The nature of this research is descriptive analytical. This research was conducted in Maros Regency, with the respondents: 10 investigators, 5 advocates, and 10 general public. Overall, the sample for all research locations was 25 people who were selected by random sampling. The results of this study indicate that the investigation of criminal acts of defamation through social media at the Maros Police Station is less than optimal. The investigation was not optimal because it was constrained by the identity of several reported parties using fake accounts or the identity of the owner of the account was known. The factors that influence the optimization of criminal defamation investigations through social media at the Maros Police Station that are reported to the Maros Police Station are the legal substance factor, the investigator apparatus factor, the infrastructure factor, the community legal awareness factor and the community's legal culture.
