Abstract

Tujuan penelitian menganalisis penyelesaian sengketa lelang hak tanggungan pada akad pembiayaan syariah dan pertimbangan hukum yang tepat dari Hakim Pengadilan Agama Makassar dalam putusan Perkara Nomor 1848/Pdt. G/2019/PA Mks. Metode penelitian menggunakan penelitian hukum normatif. Hasil penelitian bahwa perkara tersebut diregister dalam bentuk Perdata Perlawanan (Pdt.Plw), seharusnya majelis hakim menggunakan istilah perlawanan Pelawan di satu pihak, sedangkan pihak lainnya disebut sebagai Terlawan I dan Terlawan II. Kesemuanya telah dinyatakan tidak beralasan menurut hukum dan telah dinyatakan ditolak, maka terhadap angka 1 perlawanan Pelawan, harus pula dinyatakan tidak beralasan menurut hukum. The research objective to analyze the settlement of mortgage auction disputes in sharia financing contracts and proper legal considerations from the Makassar Religious Court Judges in the decision of Case Number 1848/Pdt. G/2019/PA Mks. The research method uses normative legal research. The results showed that the case was registered in the form of Civil Resistance (Pdt.Plw), the panel of judges should have used the term Resistance on the one hand, while the other party was referred to as Opponent I and Opponent II. All of them have been declared unreasonable according to law and have been declared rejected, then the number 1 of the resistance of the Opponent must also be declared unreasonable according to law.
