Abstract

The development of BUMDes is one of the methods used by the government to develop and improve the economy of rural communities and increase the income of Village Original Income, including for Lemjut Village. Lemujut village has a BUMDes that is already operating with several existing business units including kiosk rental business units, PAMSIMAS, village banks and TPS management. The obstacle faced is the lack of human resources (HR) in managing the business units in the BUMDes of Lemujut. In addition, the understanding of the village government and the management of the Lemujut bumdesa which is less related to the mechanism of the bumdesa and the legal culture problems that occur are one of the obstacles in the development of the Lemujut bumdesa. The solution offered is for the village government to carry out a Good Governance corporate scheme in the management of the Lemujut bumdesa. The expected output target is the existence of a mechanism in a good BUMDes governance scheme, which provides good benefits for BUMDes Lemujut and MSMEs as a solution for the development of BUMDes. In addition, it also provides convenience for third parties who want to become investors in business units managed by BUMDes.

Abstract

As one of the largest organizations in Indonesia, the attitudes and policies taken by Muhammadiyah affect the life of the nation and state. One of these attitudes is the Role of Muhammadiyah's legal attitude towards the policy of protecting sexual violence. The methodology used in this research is the method of statutory and historical research. The results of the research with this literature study conclude that Muhammadiyah's attitude in responding to the Policy for the Protection of Sexual Violence is very firm, this can be seen from 2 aspects, namely, first, the basis of thought, which is based on the jurisprudence of child protection, then second, Muhammadiyah's attitude towards the PKS Bill, where Muhammadiyah pushed for the immediate ratification of the PKS Bill with a note that there were changes in problematic articles, supported by the facts presented by 'aisyiah, namely the increasing prevalence of sexual violence against women and children. In addition, Muhammadiyah also took a stand against Permendikbud 30 of 2021 regarding the Prevention and Handling of Sexual Violence in Higher Education Environments due to legal defects, so the policy must be revoked. Muhammadiyah in its attitude related to government policies related to the protection of sexual violence always adheres to the Qur'an and Sunnah as the basis for taking a stand for the benefit of the people and the state

Abstract

The recent development of Village-Owned Enterprises (BUMDesa) along with their business units must entail separation, which means that the business units of BUMDesa have their own legal entity as separate subjects of law from the main legal entity of BUMDesa. The purpose of the study is to determine the appropriate legal form for the business units of BUMDesa. The research method used in this study is the statutory approach, linking the regulations concerning BUMDesa with relevant legal theories. The findings of the study conclude that the legal standing of BUMDesa as a legal entity is established based on Village Regulations, both from the perspective of public and private law. The differentiation of BUMDesa's legal status from the perspective of public law is largely determined by the law, while from the perspective of private law, registration is required to fulfill the principle of publicity. The legal form of the business units of BUMDesa can be established as either a Cooperative or a Limited Liability Company (PT). The choice between a Cooperative or Limited Liability Company is based on the governance characteristics of the BUMDesa business units. The consequence of this independent legal status for the business units of BUMDesa allows them to effectively carry out their business activities to achieve profits as commercial enterprises, prioritizing the primary goal of optimizing the welfare of the village community.
