Abstract

Usaha Pertambangan adalah kegiatan dalam rangka pengusahaan mineral atau batubara yang meliputi tahapan kegiatan penyelidikan umum, eksplorasi, studi kelayakan, konstruksi, penambangan, pengolahan dan pemurnian, pengangkutan dan penjualan, serta pasca tambang. Penelitian ini mengkaji Iklim Investasi Penanaman Modal Pertambangan Di Indonesia Sejak keluarnya Peraturan Pemerintah (PP) No 24 tahun 2012 tentang pelaksanaan kegiatan usaha pertambangan Mineral dan Batubara, serta Peraturan Menteri ESDM No. 7 Tahun 2012 yang kemudian disempurnakan dengan 2 Permen ESDM No 11 tahun 2012 tentang Peningkatan Nilai Tambah Mineral melalui kegiatan Pengelolaan dan Pemurnian Mineral (smelter). penelitian ini digolongkan kepada penelitian yuridis normatif. Pemerintah telah mengeluarkan Peraturan Pemerintah (PP) No 24 tahun 2012 tentang pelaksanaan kegiatan usaha pertambangan Mineral dan Batubara. dimana materi pokok yang terkandung didalamnya menyebutkan bahwa perusahaan pertambangan dapat melakukan ekspor bijih (ores) mineral ke luar negeri sebelum bullan Januari 2014 apabila telah mendapatkan rekomendasi dari Menteri ESDM. Berdasarkan Surat Permintaan Kerjasama kajian tambang dan mineral dari Direktorat Eskpor Industri dan Pertambangan (Ditjen Daglu) Nomor: 1022/DAGLU.3.4/ND /8/2013 tertanggal 13 Agustus 2013, maka Pusat Kebijakan Perdagangan Luar Negeri akan melakukan evaluasi berkaitan dengan pelarangan ekspor dalam bentuk bijih (raw material atau ores).

Abstract

This study aims to analyze the innovation of population and civil registration services through the Bekasi City e-Open application in Kelurahan Bintarajaya Village. The research was conducted using a qualitative descriptive analysis method to describe and explain in detail the existing phenomena using interview techniques as a supporting instrument. In this study, innovation in population and civil registration services through the Bekasi City e-Open application in Kelurahan Bintarajaya was measured by 3 (three) performance indicators, namely: responsiveness, responsibility, and accountability. The results of the study conclude that the innovation of population and civil registration services through the Bekasi City e-Open application in Kelurahan Bintarajaya has been running well although there are still shortcomings and obstacles in its implementation. Obstacles to innovation in population and civil registration services through the Bekasi City e-Open application in Kelurahan Bintarajaya include disruption of the serve network system and data overload, which has an impact on the quality of services that is supposed to be fast.

Abstract

Keberadaan hukum benda sangat mempengaruhi dalam segala perbuatan-perbuatan yang akan timbul antar sesama manusia, dengan adanya pasal 499 KUHPerdata yang menyatakan bahwa tiap-tiap barang dan tiap-tiap hak, yang dapat dikuasai oleh hak milik sehingga pengertian benda dapat dipahami sebagai benda yang dapat dilekatkan hak atau dijadikan sebagai hak milik. Hak kebendaan ialah hak mutlak atas suatu benda Hak ini memberikan kekuasaan langsung atas suatu benda dan dapat dipertahankan terhadap siapa pun juga. Hak kebendaan mempunyai sifat dan ciri unggulan bila dibandingkan dengan hak perorangan. Alasan dilakukannya penyuluhan hukum ini adalah karena sebagian masyarakat di Desa Sei. Rambai, Kecamatan Kampar Kiri Kabupaten Kampar Provinsi Riau mempunyai hak kebendaan berupa benda tidak bergerak yaitu tanah yang menjadi objek dalam perlindungan hak. Tujuan pelaksanaan penyuluhan hukum ini adalah untuk memberikan informasi kepada masyarakat Desa Sei. Rambai, mengenai dasar hukum kebendaan. Pelaksanaan penyuluhan hukum dilaksanakan lansung di Kantor desa pada hari Senin tanggal 19 September 2022 yang hadiri oleh beberapa masyarakat dari desa sei rambai. Hasil dari kegiatan penyuluhan hukum ini masyarakat dapat memahami tentang adanya pasal 499 KUHPerdata yang memudahkan masyarakat dalam menjaga hak atas kebendaannya demi tidak terjadi konflik antara hak sesama masyarakat mulai dari kepemilikan yang dikuasai oleh orang lain.

Abstract

Daily workers often express concerns about whether their wages are sufficient to provide them with a decent standard of living. Government Regulation Number 36 of 2021 regarding Wages states that the calculation of minimum wage is determined based on economic and employment conditions, which differs from the previous regulation that emphasized setting the minimum wage according to a decent living standard. This change has had a significant impact on wage determination. This study aims to examine how the latest wage policy can contribute to ensuring a decent living for daily laborers in Indonesia. The study adopts a normative legal research method and provides analytical descriptive data. It involves analyzing legal materials and comparing them with the main issues at hand. The calculation of wages for daily laborers is based on factors such as working hours, working days, or work results. However, it is important to note that the mandatory wage component for daily workers is solely the minimum wage, excluding allowances and non-wage income components. This confirms that the current wage structure for daily workers falls short of meeting the needs of a decent life for both workers and their families, as it solely relies on working hours. Therefore, it is crucial to prioritize efforts to improve the standard of living for daily workers in Indonesia.

Abstract

The objective of this study is to investigate the relationship between investment law and state sovereignty, and subsequently formulate a framework for future national investment law policies aimed at promoting economic growth and safeguarding sovereignty. The present study is characterized as normative in its methodology, employing both a statutory and conceptual approach. The findings indicate that investment plays a significant role in enhancing both the economy and employment expansion. Governments globally are engaged in a competitive effort to establish an improved business climate that facilitates investment activities. However, it is imperative to restrict this endeavor and prioritize domestic capital, as evidenced by the 1966 MPRS Decree. This directive provides guidance to Indonesian policymakers that foreign investment or aid should not be disregarded for its role in developing the struggling Indonesian economy. Nevertheless, it is crucial to first rely on the potential of domestic resources as a means of generating development funds. This approach ensures that the availability of foreign funding sources does not lead to dependence on external parties. Furthermore, foreign sources of funds must be utilized for the benefit of the domestic economy.  Foreign investment in Indonesia must also be subjected to limitations in this context
