Abstract

Advokat atau pengacara adalah sebuah profesi bidang hukum yang saat ini telah ramai menjadi profesi dari kalangan ahli hukum. selain daripada itu keberadaan advokat sebagai seorang penegak hukum sejatinya telah diatur didalam Pasal 5 Undang undang 18 Tahun 2003 tentang Advokat (UU Advokat). Namun, keberadaan pasal 5 ayat (1) belum memberikan penjelasan mengenai bentuk konkrit advokat sebagai penegak hukum, hal ini menjadikan keberadaan advokat sebagai penegak hukum masih belum memiliki kejelasan khususnya dalam perannya ia sebagai salah satu komponen didalam sistem peradilan pidana di Indonesia. Berdasarkan penelitian ini, maka terdapat empat urgensi kedudukan advokat dialam sistem peradilan pidana, yaitu : (a) advokat sebagai penyedia jasa hukum dan pemberi bantuan hukum, (b) advokat sebagai pengawas dan pengawal integritas peradilan, (c) advokat sebagai penyeimbang terhadap dominasi penegak hukum, (d) advokat sebagai pembela atas harkat dan martabat manusia. Dengan adanya empat urgensi kedudukan advokat sebagai penegak hukum. Diharapkan penulisan ini mampu mempertegas dan memperkuat peran advokat sebagai salah satu komponen didalam sistem peradilan pidana di Indonesia dan seluruh komponen hukum, lebih lanjut perlu dilakukan adanya perubahan terhadap regulasi Advokat khususnya terhadap masalah mafia peradilan dan penjelasan secara konkrit mengenai peran advokat sebagai seorang penegak hukum di Indonesia.

Abstract

The purpose of this paper is to review the decision of the Constitutional Court made due to the criminal act of bribery on constitutional judges. Based on the Constitution of the Republic of Indonesia of 1945 in article 24 C and Article 10 paragraph (1) of Law Number 24 of 2003 concerning the Constitutional Court states that the Constitutional Court has the authority to adjudicate at the first and last level whose decision is final, namely a decision that immediately obtains permanent legal force since it is pronounced and no legal remedy can be taken. However, what would be the legal consequences if the Constitutional Court's decision was made on the basis of the criminal act of bribery. This research is a conceptual study that examines the thoughts of reviewing the Constitutional Court's decision on the existence of a bribery crime. The results of this study include (1) the legal consequences if the decision of the Constitutional Court is made on the basis of the criminal act of bribery is Null and Void with all its consequences, and (2) The decision of the criminal case may be used as a basis for review of the decision of the Constitutional Court.

Abstract

The subject matter of this research is about how consumer protection is regulated in cyber law in Indonesia. Legal protection of consumers in buying and selling transactions through electronic media is regulated in Law Number 8 of 1999 concerning Consumer Protection, Law Number 7 of 2014 concerning Trade and Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Electronic Information and Transactions. The type of research used in this research is library research with a normative basis. While the approach used by the author is the statute approach so that the primary source of material is obtained from statutory literature, minutes or official records in making legislation, and judges' decisions. The research results show: First, the need to create a consumer protection system that contains elements of legal certainty. Second, legal protection for consumers in buying and selling transactions through electronic media consists of two concepts of legal protection, namely preventive legal protection and repressive legal protection.Keywords: Legal Protection, Consumers; Electronic buying and selling transactions
