Abstract

Pekerja pensiun yang telah mengikuti Program MESOP atau ESOP merupakan investor pada perusahaannya, sehingga pekerja masih terikat pada perusahaan walaupun hubungan kerjanya telah berakahir. Melalui program kepemilikan saham bagi pekerja dapat menciptakan hubungan yang harmonis antara perusahaan dan pekerja, program ini penting untuk disosialisasikan bahwa tambahan kesejahteraan tetap melekat kepada pekerja pensiun selama tabungan sahamnya tetap dimiliki / tidak dilepaskan / dijual kepada pihak ketiga , sehingga program MESOP ini membuat pekerja memiliki investasi yang dapat memberikan tambahan kesejahteraan bagi pekerja dan keluarganya. Dalam pengabdian pada masyarakat ini akan memberikan sosialisasi mengenai Perlindungan Ekonomi dan Sosial bagi Pekerja Pensiun sebagai investor perusahaan public melalui Program MESOP yang dilaksankan oleh Tim Pengabdian Kepada Mayarakat (PPM) Fakultas Hukum Universitas Padjadjaran.Metode yang dipergunakan dalam kegiatan ini adalah diskusi terbuka dan terarah dengan sasaran seluruh Pengurus Serikat Pekerja di kabupaten Karawang, yang terdiri dari 4 Serikat Pekerja yang ada di Kabupaten karawang, sehingga dapat memahami, membuat dan menjalankan program MESOP untuk peningkatan kesejahteraan Pekerja aktif dan pekerja pensiun.Hasil Kegiatan Pengabdian Pada Masyarakat ini dapat memberikan tambahan pengetahuan dan pemahaman bagi pengurus serikat pekerja bahwa tambahan kesejahteraan yang didapatkan pekerja melalui program MESOP dapat terus dinikmati pekerja walaupun pekerja telah pensiun dan tidak lagi bekerja di perusahaan, karena pekerja pensiun yang memiliki tabungan saham sebagai investor yang kedudukannya sama dengan pemegang saham lainnya pada perusahaan publik.Kata Kunci: Pekerja Pensiun, Kepemilikan Saham Pekerja, Kesejahteraan Pekerja Retired workers who have participated in the MESOP or ESOP Program are investors in their companies, so workers are still bound to the company even though their employment relationship has ended. Through the share ownership program for workers, it can create a harmonious relationship between companies and workers, this program is important to socialize that additional welfare remains attached to retired workers as long as their stock savings are still owned / not released / sold to third parties, so this MESOP program makes workers have investment that can provide additional welfare for workers and their families. In this community service, it will provide socialization regarding Economic and Social Protection for Retired Workers as investors in public companies through the MESOP Program which is carried out by the Community Service Team (PPM) of the Faculty of Law, Padjadjaran University.The method used in this activity is an open and targeted discussion with the target of all the Management of Trade Unions in Karawang district, which consists of 4 unions in Karawang Regency, so that they can understand, create and run the MESOP program to improve the welfare of active workers and retired workers. The results of this Community Service Activity can provide additional knowledge and understanding for trade union officials that the additional welfare obtained by workers through the MESOP program can continue to be enjoyed by workers even though workers have retired and are no longer working in the company, because retired workers who have stock savings are investors who have the same position as other shareholders in a public company.Keywords: Retired Workers, Employee Share Ownership, Employee Welfare

Abstract

The purpose of this research is to determine the legal consequences for workers of the issuance of WSS Indonesia Director's Letter Number: 0307/WSS/SDM-Kesra/SK-BSU SS/X/2022 regarding BSU's stance in the form of wage cuts for WSS Indonesia Personnel in terms of labor law provisions, as well as to understand the legal protection for WSS workers receiving BSU who are subject to wage cuts based on the issuance of a WSS Director's Letter in terms of labor law provisions. This research uses normative juridical methods with analytical descriptive specifications. The research was conducted using data sources based on positive law which is secondary data, including primary legal sources and secondary legal sources. The data collection technique used is a literature study which is then analyzed qualitatively, by describing the data which is connected and arranged systematically. Based on the research results, the issuance of the WSS Director's Letter regarding wage cuts for workers receiving BSU has deprived workers of their right to wages, violated provisions regarding wage obligations for workers, and deprived workers of their right to receive government assistance. Therefore, there is an obligation for WSS to comply with administrative sanctions based on applicable laws and regulations. Legal protection for WSS workers receiving BSU who are affected by wage cuts can be seen from the existence of statutory regulations governing workers' wages as well as the existence of institutions and mechanisms for resolving rights disputes to protect workers' rights so that they can be fulfilled.
